At the time of this writing, the United States Embassy in Bangkok, Thailand is closed due to the political unrest in the urban areas surrounding the Embassy compound. That being said, the United States Citizenship and Immigration Service (USCIS) Centers in the United States are likely not impacted by this state of affairs. As a result, USCIS is processing petitions in much the same manner as usual. Below are the current USCIS processing time estimates for commonly filed US Family Immigration Petitions:

On this blog, we try to provide up to date information regarding the processing time estimates of certain family based, and in limited instances non-family based, United States Immigration Petitions.

Below are the current processing time estimates from the USCIS Service Center in California as of February 28, 2010:

The following are processing time estimates for the USCIS Vermont Service Center as of February 28, 2010:

These estimates should not be viewed as accurate for each individual case as each case is unique and some cases take more time to process through the United States Citizenship and Immigration Service (USCIS) and others may take considerably little time to process through the Service Center. In any case, the assistance of a US Visa Lawyer can be helpful to clients as an authorized representative is entitled to correspond with USCIS on behalf of clients and can thereby streamline the overall visa process.

It should be noted that these estimates do not include the time that it takes to get the case processed through a US Embassy or US Consulate overseas. For those processing a Thai case, it usually takes about 6-8 weeks to process through the US Embassy Thailand.

The US visa process begins with an initial petition which is submitted to the United States Citizenship and Immigration Service (USCIS). Below are the updated processing times for the two USCIS service centers which handle the vast majority of United States family-based visa petitions. The information below was updated by USCIS on February 17, 2010.

For those who are unfamiliar with the visa process, the I-129f petition is used when filing for K1 visa on behalf of a foreign fiancee. This petition can be used by those seeking K3 Visa benefits as well. The I-130 petition is also utilized by those seeking family visa benefits, but the I-130 is used to petition for Immigrant visa benefits.

Those researching the US visa process for the first time should be aware the USCIS processing is simply the initial phase of the overall process as the petition must be forwarded to the National Visa Center and eventually a US Consulate or Embassy abroad. In the case of Thai nationals seeking US visa benefits, virtually all family based applications are processed by the US Embassy Thailand.

One of the major questions invariably on the lips of prospective visa applicant’s and petitioners is: how long will the process take? This question is not as easily answered as some might think because the entire process is actually three processes in one. First there is the United States Citizenship and Immigration Service (USCIS) adjudication phase, then there is the National Visa Center (NVC) processing phase, and finally there is the US Embassy interview and adjudication phase. In most cases, the interview phase is the final phase of the process as the visa application is either approved or denied at this point. However, if there is a legal grounds of inadmissibility or if the applicant has previously been subject to deportation or expedited removal in the US, then either an I-601 waiver or an I-212 waiver may be necessary. In routine cases, the interview is usually the last major phase of the visa obtainment process.

That being said, the first major phase of the process involves the submission of petitions to USCIS. As many petitions are filed with USCIS each year, this phase of the process is often the most time consuming as the US Citizen or Lawful Permanent Resident’s petition must wait in the queue for adjudication.

Recently, USCIS updated their processing time estimates, below please find the most recent processing time estimates for family based petitions for K-1 visas, K-3 visas, and Immigrant visas.

One should not misunderstand the above information, these processing times do not reflect the entire time that it takes to complete the entire visa process as a US Family visa petition must also process through the National Visa Center as well as the Embassy in the country where the visa is to be issued. In Thailand, most visa applications for family members of US Citizens or Lawful Permanent Residents are adjudicated at the US Embassy in Bangkok.

In previous posts on this blog we have provided information regarding the updated processing time estimates for K1 visa applications, K3 visa applications, and CR1 visa applications. This is simply an update as to the processing times at the time of this writing. Always remember that USCIS Processing times are estimates only as each and every case is unique and therefore determining the processing time of one particular case can be very difficult.

There are essentially three government agencies that have a hand in the US Visa process: the United States Citizenship and Immigration Service (USCIS), the National Visa Center (NVC), and the United States Department of State (the Department with jurisdiction over the US Embassies, Consulates, and Diplomatic Posts abroad). Of these three agencies, USCIS has the case in its possession for the longest period of time because the petition must be initially adjudicated by their officers.

Within the USCIS administrative structure there are two service centers that handle the adjudication of the K1 visa application and K3 visa application for fiancees of United States Citizens (in both cases, the actual application form is called the I-129f). The Services Centers are located in California and Vermont, respectively. They each have their own unique jurisdiction depending upon the residence of the petitioner.

Within the past few days, the USCIS service center in California issued a revised estimate regarding how long it is taking for adjudication of K-1 visa applications and K-3 visa applications. They are now estimating that it will take 5 months for the average visa petition to be adjudicated. This is compared to the previous estimate of 6 months.

As I have explained on this blog and to people in the past. This estimate tends to be quite conservative as we tend to see these petitions adjudicated by USCIS in a much more timely manner than this. That being siad, the prospective immigrant or sponsor should be aware that the petition must also pass through the National Visa Center (which generally processes I-129f petitions faster than Immigrant Visa petitions) and the US Embassy Bangkok.

K3 visas a re also different because one needs to take into account the underlying I-130 petition that acts as the foundation for the supplemental I-129f petition that garners an expedited visa.

At the back of everyone’s mind should be the idea that all time frames for visa obtainment are estimates only as many factors can be at play when a visa application is processing. The best advice is to plan for the worst, but hope for the best. It has been our experience that the US Embassy in Thailand works in a very efficient manner in an effort to get petitions adjudicated quickly. The USCIS service centers are generally the “bottleneck” where visa applications can get delayed.
