Can I get a US Tourist Visa for My Cambodian Girlfriend or Boyfriend?

A routinely asked question by many American Citizens who have been living overseas is: can I get an American tourist visa for my foreign girlfriend or boyfriend? In the context of Cambodia, the question is usually phrased as “Can I get my Cambodian girlfriend (or boyfriend) a US Tourist visa?” In most cases, the applicant cannot obtain a United States tourist visa pursuant to section 214(b) of the United States Immigration and Nationality Act.
For those who are unfamiliar with the American Immigration process or the visa application process, the United States offers a recreational visa for foreign nationals under the category B-2. The B2 visa is highly sought after by those wishing to travel to the United States for recreational purposes. That said, the US Tourist visa application, and virtually all non-immigrant visa applications, requires that the applicant have true Non-Immigrant intent when traveling to the United States of America. Furthermore, pursuant to language contained in section 214(b) of the United States Immigration and Nationality Act a Consular Officer is required to presume that all non-immigrant visa applicants are actually intending immigrants unless evidence can be produced to the contrary. This creates a so-called “strong ties” vs. “weak ties” analysis whereby an applicant must show that he or she has strong ties to, in this scenario, Cambodia (or another country outside of the USA) and weak ties to the United States. Oftentimes, the mere existence of an American Citizen significant other is a mitigating factor in favor of denial. Therefore, those boyfriends and girlfriends of US Citizens applying for US tourist visas find their applications rejected pursuant to 214b.
Those who wish to reside in the United States should not apply for a Tourist visa. However, in the past, some tried to use the US tourist visa as a method of circumventing the comparatively longer processing times of the K1 visa (for foreign fiancees) or the Immigrant visas (for the spouses of US Citizens or Lawful Permanent Residents). Under US Immigration law it is illegal to intentionally mislead an interviewing officer when applying for a visa. Therefore, those who apply for a B2 visa (or an F1 visa, J1 visa, or B1 visa for that matter) with the preconceived intention to use it to immigrate to the US could be severely penalized if the deception is discovered. For this reason, those who wish to bring a foreign loved one to the United States to reside are well advised to apply for a family based immigration petition rather than attempt to deceive Consular Officers abroad.
Even if a US Citizen’s girlfriend or boyfriend obtains a US visa, this does not necessarily mean that they will gain entry into the United States. In recent years, this author has noted that the United States Customs and Border Protection (USCBP) Service has been increasingly vigilant in watching for those “immigrants” traveling to the United States without proper documentation. Pursuant to legislation passed in the 1990s, USCBP is authorized to place those traveling to the US on tourist visas with undisclosed immigrant intent into expedited removal. Those who are removed from the United States in this manner may be ineligible to return for a substantial period of time.
Those seeking non-immigrant visa benefits are well advised to be clear and honest on a visa application. While those who wish to bring a fiance or spouse to the USA to reside should seriously consider the status of their relationship and submit an application or petition that accurately reflects the parties’ intentions.

The United States Customs and Border Protection Service (USCBP) is tasked with maintaining the security of America’s ports and overseeing the execution of customs regulations. In previous posts on this blog, it has been noted that there is a great deal of economic opportunity in the Asia-Pacific region. Some Americans are unfamiliar with a body known colloquially as APEC (Asia Pacific Economic Cooperation). This body has become an increasingly important platform for discussion of various subjects pertaining to inter-jurisdictional matters arising in the Asia-Pacific region. To quote the APEC website directly:
Asia-Pacific Economic Cooperation, or APEC, is the premier forum for facilitating economic growth, cooperation, trade and investment in the Asia-Pacific region .
APEC is the only inter governmental grouping in the world operating on the basis of non-binding commitments, open dialogue and equal respect for the views of all participants. Unlike the WTO or other multilateral trade bodies, APEC has no treaty obligations required of its participants. Decisions made within APEC are reached by consensus and commitments are undertaken on a voluntary basis.
This consensus driven initiative has proven effective in facilitating international trade, cooperation, and dialogue. In a recent press release it was announced that the USCBP will likely be taking on a more hand-on role within the APEC framework. To quote the press release as distributed by the American Immigration Lawyers Association (AILA):
U.S. Customs and Border Protection announced today that it will host the Subcommittee on Customs Procedures as part of the 2011 Asia-Pacific Economic Cooperation (APEC) meetings that will be chaired by the United States. The Sub-committee on Customs Procedures coordinates CBP’s efforts in customs, immigration and counter-terrorism with partner agencies throughout APEC member countries. The yearlong chairmanship will be handed over to CBP from the Japan Customs and Tariff Bureau today.
“CBP is proud to be hosting the distinguished members of the Sub-committee on Customs procedures for the 2011 APEC meetings,” said Commissioner Alan Bersin. “It is of vital importance to the security of our global economy for the members to coordinate and share
customs best practices.”The subcommittee is a working level group within APEC. It brings Customs administrations of APEC Member Economies together to simplify and harmonize customs procedures and to ensure trade moves efficiently and safely across the Asia-Pacific region. APEC is the premier forum for facilitating economic growth, cooperation, trade and investment in the Asia-Pacific region. The APEC region is home to more than 2.7 billion
people and represents approximately 60 percent of the world GDP and 44 percent of world trade.Japan officially turns over the Chair of APEC to President Barack Obama at the November 13-14, 2010 Leader’s Meeting in Yokohama, Japan.
This is a very interesting development from an economic perspective as it would appear that the United States is taking a keener interest in Asia-Pacific affairs. This may be due to the recent downturn in the US economy as well as the rise of The Peoples’ Republic of China as a major player in global economic relations. Whatever the reason for this increasing interest in the region, this author welcomes further streamlining of Customs procedures in an effort to stimulate new transnational trade and facilitate preexisting trading relationships in an effort to increase the volume trade between the United States and the members of APEC.
Hopefully, through voluntary cooperation trade can be increased and the security of the USA and the other APEC member nations will be increased. To further quote the aforementioned press release distributed by AILA:
U.S. Customs and Border Protection is the unified border agency within the Department of Homeland Security charged with the management, control and protection of our nation’s borders at and between the official ports of entry. CBP is charged with keeping terrorists and terrorist weapons out of the country while enforcing hundreds of U.S. laws.
Hopefully, this new multilateral initiative will be beneficial for all concerned as US officials and Customs authorities from other participating nations can pool some resources in an effort to combat international crime and facilitate the execution of relevant immigration laws.
Many Americans and foreign nationals are under the mistaken impression that Customs and Border Protection simply “rubber stamps” entrants to the United states who are either from countries participating in the Visa Waiver Program or have a US Tourist Visa. Nothing could be further from the truth as even those entering the USA with a valid visa could be turned away or placed in Expedited removal proceedings depending upon their travel history. Those familiar with this blog may recall that new measures have been implemented that can have an effect upon those traveling to the United States on the Visa Waiver Program. The Department of State (DOS) recently released a cable which outlines soon-to-be implemented changes to the Electronic System for Travel Authorization (ESTA). The following is quoted directly from the Department of State Cable as distributed by the American Immigration Lawyers Association (AILA):
Summary: This cable provides additional information on implementation of the Travel Promotion Act of 2009 (TPA) and fee collection for the Electronic System for Travel Authorization (ESTA), requests posts to engage in outreach, and provides talking points. End summary.
3. As previously reported (Ref a), President Obama signed the TPA into law on March 4, 2010. The TPA will create a partnership between the U.S. government and the private sector to market the United States as a travel destination for international visitors. Fees collected from international travelers from Visa Waiver Program (VWP) countries, matched by private sector contributions, will fund the Corporation for Travel Promotion. The fees will be collected through the ESTA system, which the Department of Homeland Security (DHS) administers.
4. On August 6, 2010, DHS announced an interim final rule that amends DHS regulations to require travelers from VWP countries to pay operational and travel promotion fees when applying for ESTA beginning September 8, 2010. The total fee will be $14.00, with $4.00 to recover the cost of administering the ESTA system and $10.00 as mandated in the TPA.
5. The Department is working with DHS and the Department of Commerce to notify foreign and domestic media, the travel industry, and other stakeholders about this change. The Department requests that consular officers in VWP countries, in coordination with DHS and Commerce representatives, meet with host government officials, and airline, tourism, and other stakeholders to inform them of the new fee provisions connected to ESTA. Please contact the ESTA Program Management Office [redacted] for outreach materials or requests for ESTA representatives to travel in-country. They will do their best to accommodate. This cable is being sent as an ALDAC to facilitate all posts answering questions from citizens of VWP countries and the general public.
6. The Department supports the TPA goal of attracting international visitors to the United States. Our greatest diplomatic tool for sharing American values is America itself, and we recognize the critical importance of travel and tourism to our economy and job creation. The Department looks forward to working with the Corporation for Travel Promotion to ensure that prospective visitors to the United States receive comprehensive, up-to-date information on travel documents and requirements for entry.
The Travel Promotion Act mentioned above will likely have significant consequences for those foreign nationals traveling to the United States pursuant to the conditions of the visa waiver program. Therefore, those originating in a country that has visa-free travel privileges to the USA may be wise to research both the US Visa Waiver Program and the ESTA program. Fortunately, the aforementioned cable also included a Frequently Asked Questions Section. The following FAQ’s were quoted from the previously mentioned DOS cable distributed by AILA:
Q. What is the new fee charged to travelers?
A. It is $14.00. Since the implementation of ESTA, DHS has had discretion to charge a fee to cover administrative costs. DHA determined that cost to be $4.00 per registration. The TPA fee adds an additional $10.00.
Q. When will the fee go into effect?
A. ESTA registrations on or after September 8, 2010, will be subject to the fee.
Q. How do travelers pay the fee?
A. At this time, payment is required through the following credit cards: Mastercard, Visa, American Express, and Discover. Payments can also be made with a debit card that holds the Visa or Mastercard symbol. Please check with your bank on the compatibility of your debit card. We are continuing to explore other payment measures. The ESTA registration form already in use will walk users through the payment process.
Q. What types of privacy protection exist on the website?
A. “Pay.gov” uses advanced encryption to protect transactions while applicants are logged in. When accessing a profile, any account numbers entered will be masked on-screen.
Q. How long are ESTA approvals valid?
A. Each approved ESTA application will be valid for a period of two years unless the traveler’s passport expires sooner. It allows for multiple visits to the United States within that application.
Q. If I have a valid ESTA, will I have to re-register when the new fees go into effect?
A. No, existing ESTA registrations remain valid for travel through their expiration date.
Q. Is ESTA approval like a visa?
A. An ESTA approval is not a visa under U.S. law, nor does it confer the same benefits as a visa.
Q. Will this attract more international visitors to the United States?
A. Oxford Economics, a leading economic forecasting consultancy, estimates that the TPA program will generate $4 billion in new visitor spending, and lead to the creation of 40,000 new jobs.
Q. Why do VWP countries have to fund this travel promotion program through ESTA fees?
A. Some countries fund tourism promotion through airline or hotel taxes. The Travel Promotion Act legislation specified that the U.S. government fund this program through a $10 fee added to ESTA registration.
8. The following are Visa Waiver Program member countries: Andorra, Australia, Austria, Belgium, Brunei, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Japan, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, The Netherlands, New Zealand, Norway, Portugal, San Marino, Singapore, Slovakia, Slovenia, South Korea, Spain, Sweden, Switzerland, and the United Kingdom…
At the time of this writing, the Kingdom of Thailand is not a member of the United States Visa Waiver Program. Therefore, ESTA rules have little impact upon most Thai nationals. That said, as pointed out in previous blog posts, relevant regulations may require those who have been issued a 221g refusal to disclose this refusal as a “visa denial” for purposes of travel to the USA on the Visa Waiver Program. It would seem that at the time of this writing the Department of State and the United States Customs and Border Protection Service (USCBP), an agency under the authority of the US Department of Homeland Security, view 221(G) refusals differently. Those who have been issued a 221g who still wish to travel to the United States may be wise to contact a US lawyer in order to deal with a pending 221g refusal.

Laypeople sometimes confuse the process of adjustment of status with the change of status process. This confusion is directly related to the subject of this post: change of status from US Tourist Visa status to US Student Visa status. Many are under the mistaken impression that it is legal to attend school in the USA on a tourist visa. This is not the case. In a recent announcement promulgated by the US Department of Homeland Security and distributed by the American Immigration Lawyers Association (AILA), the question was posed: “Is it permissible to enroll in school while in B-1/B-2 status?” The answer is quoted directly from the aforementioned announcement:
No, it is not. The regulations, at 8 CFR 214.2(b)(7), specifically prohibit study in the United States while in B-1 or B-2 status.
Before enrolling in classes, individuals who are in B-1 or B-2 status must first acquire F-1 (academic student) or M-1 (vocational student) status. Enrolling in classes while in B-1/B-2 status will result in a status violation. Individuals in B-1 or B-2 status, who have violated their nonimmigrant status by enrolling in classes, are not eligible to extend their B status or change to F-1 or M-1 status. Theseregulations provide no exceptions.
If you currently hold B-1 or B-2 nonimmigrant status and would like to enroll in classes, you may apply for a change of status to F-1 or M-1, as appropriate, if:
You have not yet enrolled in classes
Your current status has not expired
You have not engaged in unauthorized employment
To change your nonimmigrant status from B-1/B-2 to F-1 or M-1, you must file an Application to Extend/Change Nonimmigrant Status (Form I-539), and include the required fee and documents listed in the filing instructions.
Please Note:
If you enroll in classes before USCIS approves your Form I-539, you will be ineligible to change your nonimmigrant status from B to F or M. If you are applying to extend your B-1/B-2 stay and you have already enrolled in classes, USCIS cannot approve your B-1/B-2 extension because of the status violation.
For some, the change of status process can be confusing and difficult as few are familiar with DHS forms and protocols, but for those who obtain an F1 visa, the educational rewards can offset the time and resources expended obtaining the visa. Those who are not eligible to receive a change of status may find the following excerpt from the previously mentioned announcement helpful:
If you are not eligible to change your nonimmigrant status to F-1 or M-1, you may apply for an F-1 or M-1 visa at a consular post abroad…We encourage all students and prospective students to work closely with their designated school official (DSO) to coordinate the timing of applying for change of status and enrolling in classes.
Those staying in the United States on any type of visa are required by law to fully comply with the terms of their visa. Failure to do so could lead to severe civil and criminal penalties. Those wishing to travel to the United States of America are well advised to seek the type of visa that truly comports with proposed activity in the USA. As extraneous circumstances can cause unforeseen problems it may be necessary to apply for a change of status if one’s current visa does not provide proper benefits.
Adjustment of status, which can be confused with changing status, is the process of switching a foreign national from a non-immigrant visa to Lawful Permanent Residence (Green Card). Those traveling to the United States of America on a K1 visa must adjust their status within 90 days of their arrival after their marriage to the US Citizen petitioner.

US B2 Tourist Visa Thailand: The New DS-160

A frequently discussed topic on this blog is the US Tourist Visa. The US Embassy Bangkok processes a significant number of US Tourist Visa applications each year. In the past, most non-immigrant visa applications required the submission of form DS-156. Recently, the US State Department announced that the DS-156 should no longer be used by those seeking a US B2 Tourist Visa:
The new DS-160, Nonimmigrant Visa Electronic Application, is a fully integrated online application form that is used to collect the necessary application information from a person seeking a nonimmigrant visa. The DS-160 is submitted electronically to the Department of State via the Internet. Consular Officers use the information entered on the DS-160 to process the visa application and, combined with a personal interview, determine an applicant’s eligibility for a nonimmigrant visa.
Apparently, the DS-160 has been introduced in an effort to streamline the visa process for those seeking non-immigrant visas outside of the United States of America. To quote the above announcement further:
All U.S. Embassies and Consulates that process nonimmigrant visas now use the new online DS-160. Therefore, visa applicants will need to apply using the online DS-160 for most, but not all, nonimmigrant visa categories. Review the [State Department] FAQs for exceptions and to find out which nonimmigrant categories continue to use the DS-156 at this time.
There are many who worry that these recent changes will impact other types of applications. This worry seems to be most prevalently felt by those seeking K1 visa benefits or K3 Visa benefits for a foreign fiancee or spouse. That said, consultation with an American legal professional may be necessary in order to determine which forms should be used when filing for certain visa categories. As always, it should be noted that only a licensed American attorney is entitled to assist in American Immigration matters. That said, many find that applying for a US Tourist Visa does not require the assistance of an American lawyer as such assistance would likely add little value to such an application. However, many applicants for US family immigration benefits find that attorney assistance is beneficial.
It should be noted that many applicants find their application for a visa denied pursuant to the Consular Officer’s application of Section 214(b) of the United States Immigration and Nationality Act. Such a finding basically means that the applicant was unable to show requisite “strong ties” to their home country and “weak ties” to the United States. Those seeking a visa to the USA should be advised that if immigration is the ultimate goal, then a tourist visa is not the proper travel document. Even if a visa application is approved by a US Consulate overseas, the foreign national could still be placed in expedited removal proceeding upon arrival at the port of entry in the USA if the Customs and Border Protection officers have reason to believe that the applicant is an undisclosed intending immigrant attempting to enter the USA.

It is common knowledge that many people seek United States travel documents from the US Embassy Thailand. However, are those who have complex questions regarding United States Tourist visas and in many cases, these questions can only be answered by either an attorney or a Foreign Service Officer. Thanks to the internet, there are more and more opportunities for those with sought out knowledge to communicate with those who need specific questions answered. The website Thaivisa.com is reporting that the US Embassy in Bangkok has initiated a live chat program to allow the public to interact directly with Embassy personnel online:

Although this chat session has already occurred one should note that this is a terrific resource for those interested in a tourist visa as it allows for an applicant to have their inquiries answered in real time by one who is knowledgeable about US visa matters. It is interesting to note that the Thaivisa.com posting only makes reference to the the US Tourist Visa and not other visa categories. This is probably due to the fact that employment based visas such as the E2 visa or the L1 visa are granted after an assessment of the unique set of facts and issues in a given case so it would be difficult to discuss such visas through the internet. That being said, tourist visa adjudications are based upon the facts in the case, but judging an applicant’s likelihood of obtaining a US visa is often easier, compared to employment based cases, due to section 214(b) of the US Immigration and Nationality Act. Family based visa applications for visas such as the K1 visa, the K3 Visa, the IR1 visa and the CR1 Visa are also adjudicated based upon the facts of the case and in many cases the likelihood of ultimate approval is not easy to determine unless one delves deeply into the details of the case. This could explain why these types of applications do not appear to be the intended topic of discussion in the aforementioned live chat session.

B2 Visa Thailand: Fraud and Misrepresentation, What is a Fiance?

There are many people of all nationalities who submit applications for a US Tourist Visa at the US Embassy Thailand. Although these applications are quite common, they are becoming increasingly subject to denial pursuant to section 214(b) of the United States Citizenship and Nationality Act. This provision basically requires that the Consular Officer make a presumption that the tourist visa applicant is an undisclosed immigrant unless the applicant can provide strong evidence to the contrary. This creates the “strong ties” vs. “weak ties” analysis which requires that the applicant show “strong ties” to a country outside of the United States and “weak ties” to the USA. This can be a very problematic provision especially for those Americans who wish to bring a Thai significant other back to the US.
The existence of an American Citizen boyfriend can be very detrimental for a Thai’s B2 visa application (or any non-immigrant visa application for that matter ex: F-1 visa, J-1 visa, B-1 visa, etc). The detriment arises from the fact that the applicant has a primary relationship with an American and therefore could be construed to have a “strong tie” to the USA. Some couples try to get around this problem by “not mentioning” the existence of a relationship with an American. This is not a good idea, in this author’s opinion, because any dishonesty, even dishonesty by omission, is unethical and could be viewed by the Embassy and/or Consulate as an attempt to defraud the US government. For an American Citizen, a finding of fraud and misrepresentation could lead to penalties, but such a finding could have a highly negative impact upon the applicant’s chances of ever obtaining a US visa in the future as fraud and misrepresentation is considered a legal grounds of inadmissibility to the USA that would likely only be remedied upon the approval of an I601 waiver.
However, the DS-156 form that is used to apply for a US tourist visa does not ask “do you have an American boyfriend/girlfriend?” Instead the forms asks:
“Are Any of The Following Persons in The U.S., or Do They Have U.S. Legal Permanent Residence or U.S. Citizenship? Mark YES or NO and indicate that person’s status in the U.S. (i.e., U.S. legal permanent resident, U.S. citizen, visiting, studying, working, etc.)”
The form then allows the applicant to note family relationships, including “fiance/fiancee.” The reason this is being discussed is due to the fact that the rest of the form’s questions can be relatively easily answered. For example, one can say with near certainty if they have a US Citizen husband, but “fiance” is another, more opaque, concept. Defining “fiance” is difficult as relationships, prior to marriage, are fairly fluid from a legal standpoint. In this author’s opinion, if the applicant has a romantic relationship with an American Citizen, then this fact should be disclosed to the Consular Officers either in writing or at the visa interview, but if there is any inkling that marriage and adjustment of status may be a possibility, then it may be better to forgo an attempt at a tourist visa, as this is not really the proper travel document, and submit a petition for a K1 visa.

Since the recent worldwide economic downturn the global tourism industry has suffered a great deal. Much can be attributed to the fact that people have less disposable income, but others are of the opinion that increased promotion may be the key to dealing with this issue. In the United States, the government and business leaders have devised a plan to promote more travel to the USA. To quote a recent posting on CNN’s website:
“President Obama signed legislation into law Thursday to create the United States’ first national travel promotion program…The act will create a nonprofit Corporation for Travel Promotion that will promote the United States as a travel destination and explain travel and security policies to international visitors…”
One aspect of the new program that is stirring up some resentment is the addition of a $10 fee that much be paid by those wishing to enter the United States on the visa waiver program (not to be confused with an I-601 waiver of inadmissibility):
“A $10 fee charged to visitors from countries included in the Visa Waiver Program will partially fund the public-private organization. These visitors will pay the fee every two years when they register online using the Department of Homeland Security’s Electronic System for Travel Authorization…”
As readers may recall, The Electronic System For Travel Authorization (ESTA) is used by those who wish to seek entry into the USA on a visa waiver. This system pre-screens foreign entrants for security purposes. As mentioned previously, tourism around the world is declining, but this program may provide stimulus to this sector of the US economy:
“Despite strong global growth in long-haul international travel between 2000 and 2008, the U.S. welcomed 633,000 fewer overseas visitors in 2008 than it did in 2000, according to figures from the U.S. Department of Commerce. Oxford Economics, an economic consulting and forecasting company, estimates a well-executed promotional program would draw 1.6 million new international visitors annually and generate $4 billion in new visitor spending.”
It remains to be seen how this program will work, but certainly encouragement of tourism is necessary. However, some have questioned how requiring a new fee for travel to the United States will encourage tourism. This is certainly a valid point as increased restrictions on travel for so-called “visa waiver countries” may be one of the reasons behind decreased tourism. Virtually every United States Embassy or Consulate will close in recognition of United States Federal Holidays. Most will also close in recognition of local holidays or customs. In Vietnam, the bulk of United States visa and immigration matters are handled at the US Consulate in Ho Chi Minh City. This situation is the opposite of the internal mechanics of the posts in Thailand as the US Embassy in Bangkok handles nearly all Immigrant visa petitions while the US Consulate in Chiang Mai deals with Non-Immigrant visa applications for visas such as the US Tourist Visa, the J1 visa, and the F1 visa. That being said, the holiday closing schedule of the US Consulate in Ho Chi Minh City (HCMC) is identical to the schedule of the US Embassy in Hanoi. Therefore, those interested in that post’s closing schedule should look to the information above.
For those in a legitimate emergency, it may be possible to contact the Embassy during a holiday. That being said, this is contacting Embassy staff may be difficult as most Embassy and Consulate personnel use holidays to take much needed time off. Therefore, those with an impending issue would be wise to take care of it before a holiday as it is unlikely that the Embassy will make special accommodations.

The B-1 Visa in 2010
In this writer’s opinion, the US Business Visa Process will probably remain relatively unchanged in 2010. That being said, it does provide an opportunity to re-explore this American travel document.
The B-1 Business visa is a non-immigrant visa intended for those who wish to travel to the United States for short term business purposes. It is not a dual intent visa meaning that one who applies for a B-1 visa must have bona fide non-immigrant intent. Those who have an undisclosed intention to immigrate to the United States of America at the time of application should disclose this fact in the application form and/or the visa interview. Failure to disclose immigrant intent could be construed as fraud and/or misrepresentation of a material fact. A finding of fraud and misrepresentation of material fact could lead to the applicant being found inadmissible to enter the United States. This inadmissibility would likely then only be remedied by an approved I-601 waiver application. Due to the drastic consequences that can befall a non-immigrant visa applicant, it is always wise to be completely candid on a visa application and explain all of one’s reasons for traveling to the United States of America.
The B1 visa is often issued in tandem with a US tourist visa, also known as a B2 visa. This visa category is utilized by those traveling to the United States for recreational purposes. Consular Officers will often issue combined B1/B2 visas because the applicant is planning a trip which combines elements of both business and pleasure. For example, a Thai doctor may travel to the United States to attend a medical seminar and visit family and friends after the seminar ends. In this case, a B1/B2 visa would be optimal because it encompasses all of the activities that the applicant will be undertaking in the United States.
As with many types of non-immigrant single intent visas, the applicant must overcome the statutory presumption of immigrant intent under section 214b of the United States Immigration and Nationality Act. The applicant must essentially show that they have such strong ties to Thailand (or any other country outside of the USA) that they will not remain in America past the expiration of their visa.
