หลายๆเดือนนี้มีแนวโน้มที่รัฐบาลจะปิดดูเหมือนจะเป็นการยิ่งทำให้นัการเมืองต่างๆในสหรัฐอเมริกาแบ่งพรรคแบ่งพวกกันมากขึ้น ในข.ระเดียวกัน ข้อถกเถียงในเรื่องการปิด(แม้แต่การขยายเวลาการทำงานในระหว่างการปิด) ในเวลาเดียวกัน หลายๆฝ่ายวิพากษ์วิจารณ์การปิด  โดยไม่คำนึงถึงความเห็นของฝ่ายหนึ่ง ดูเหมือนการปิดนั้นจะเป็นไปได้และในกรณีที่มีการปิด กระบวนการทั้งหลายที่เกี่ยวกับการเข้าเมืองอาจจะมีการศึกษาถึงผลกระทบว่าการปิดอาจจะมีผลต่อกระบวนการเข้าเมือง

ข้อความที่อ้างข้างต้นอาจจะเป็นที่ชัดเจนและกระชับในการที่จะสรุปถึงกรณีที่เกี่ยวข้องกับความเป็นไปได้ในการปิด หน่วยงานทาปกครองแนะนำให้ผู้อ่านคลิกที่ลิงค์ซึ่งเป็นประเด็นที่ค่อนข้างซับซ้อน ผู้ที่สนใจในการยืนยันการปิดอาจจะเป็นเรื่องที่หาได้จากโดยหน่วยทางปกครองอ้างโดยตรงจากวิกกิพี่เดีย

การปิดของรัฐบาลเกิดขึ้นเมื่อรัฐบาลไม่ได้จัดการกับสิ่งที่สำคัญ  โดยทั่วไปแล้ว การบริการซึ่งจะคงดำเนินต่อไปโดยไม่คำนึงถึงการปิดของรัฐบาล เช่น ตำรวจ การดับเพลิง การทหาร สาธารณูปโภค การจัดการทางอากาศ และการควบคุมประพฤติ

While surfing the World Wide Web, this blogger came across an interesting piece on the Diplopundit blog pertaining to the United States Embassy in Bangkok, Thailand. The administration of this blog highly recommends that readers go to the Diplopundit blog to read the entry in its entirety. That said, the following was quoted directly from the aforementioned blog:

We understand that Bangkok’s FY 2009 NIV workload declined by over 20,000 cases from its FY 2008 high. The IV workload also declined from a FY 2006 high of approximately 8,500 to fewer than 3,000 cases in FY 2009. Still — we feel bad for the ELOs [English Language Officers] — no counseling, late performance reviews and a rotation program that spans 3-4 months — are not/not great introductions to a new career.

There is obviously a leadership disconnect here. The CG meets with the officers regularly but the Visa Chief reportedly does not, and neither were “regular participants in [visa] line work.” Ever wonder how this translates to — lead by example? Or building great teams?

The above quotation seems to drip with a certain level of sarcasm while maintaining a genuine concern for efficiency at American Missions abroad. That stated, this blogger cannot comment upon the caseload, processing policies, or personnel issues at the US Embassy in Bangkok due to a general lack of personal knowledge regarding the overall staffing situation at the Post. However, this blogger can state from personal experience that the officers at the US Embassy Thailand really did “go above and beyond” during the year 2010.

The Kingdom of Thailand saw a great deal of political, economic, and social turbulence in 2010. Most notable for those interested in matters pertaining to the US Embassy was the fact that the Post was closed for a number of days due to the riots in the late spring and early summer in Bangkok, Thailand. The so-called “Red Shirts” mounted a protest which eventually lead to a government crackdown, but not before causing major disruptions in the Bangkok Metropolitan area. The reason this riot is pertinent to this posting is the fact that this blogger personally saw, on more than one occasion, Consular Officers, of virtually every level, at the US Embassy in Bangkok going out of their way to assist and provide services to people leading right up to the actual crackdown (the same could also be said for the USCIS office in Bangkok, but that is a digression from the point of this posting).

In many ways, the situation in Bangkok could have been detrimental to the health and safety of the Consular Officers at the Post, but said employees continued to diligently perform their duties nonetheless. Although none of this goes precisely to the heart of the issues discussed in the Diplopundit blog posting this blogger felt that it should be noted in order to provide a human, if somewhat intangible, perspective on the situation in Bangkok over the past year. Perhaps this blogger is being “soft,” but it is simply the opinion of this blogger that credit ought to be given where it is due.

For those who read this blog with any frequency it has no doubt been noted that the administration often attempts to post the holiday closing schedules of the various US Embassies and Missions outside of the United States of America as a convenience to travelers who may be in need of services abroad. Below is the is the holiday closing schedule for the United States Embassy in the Kingdom of Thailand as quoted from the official website of the US Embassy in Bangkok, Thailand:

Those interested in receiving Consular services such as notary services and/or issuance of a Consular Report of Birth Abroad, US Passport, or additional visa pages are well advised to contact an American Citizen Services Section of the nearest US Mission with Consular jurisdiction over the area in which one is located.

Each year, many Thai-American couples opt to seek US immigration benefits in the form of travel documents such as the K-1 visa or the CR-1 Visa. Meanwhile, many multi-national companies or individual immigrant investors seek investment or business based visas such as the L-1 visa for intra-company transferees, the E-2 visa for Treaty Investors traveling to the USA, or the EB-5 visa for Immigrant Investors making a minimum $500,000 investment in an eligible program in the United States. In most cases, Thai applicants for the visas noted above will be required to process their visa application with the Immigrant Visa Unit or Business Travel Unit of the US Embassy in Bangkok, Thailand.

Those Thai nationals seeking Non-immigrant visas such as the J-1 visa (Exchange Visitor Visa), F-1 visa (Student Visa), B-2 visa (Tourist Visa), or the B-1 Visa (Business Visa) must process their application through the Non-immigrant Visa Unit in Bangkok if the Thai applicant resides within the Consular jurisdiction of the US Embassy in Bangkok as opposed to the Consular jurisdiction of the US Consulate-General in Chiang Mai Thailand.

The American Department of State’s website can be a useful resource for those interested in US Immigration. That said, there are many repositories of good information throughout the internet and some less-than-ideal resources. The following announcement was posted on the website of the American Immigration Lawyers Association (AILA):

Due to technical software problems, the Department of State’s “Visa Policy Updates” page of their website is currently unavailable for updates. Please note: the webpage itself is currently available; however, it does not include recent updates by DOS. Until further notice, Visa Policy Updates will not be sent to subscribers, but many documents still can be found on the Department of State website at the Visa Policy Update page.

The Department of State is responsible for administering the various American Missions located abroad. These include American Embassies, Consulates, and Institutes located in Asia. Many find that information on the Department of State can be very helpful when trying to decide what type of visa is most suitable for an individual wishing to travel to the United States of America.

Some Embassies and Consulates are considered to be so-called “high volume” Posts.  In matters involving US Immigration, this appellation could be applied to the US Embassy Thailand or the US Consulate HCMC as these posts handle a larger caseload of American Immigration matters compared to some of their counterparts in Southeast Asia.  That said, adjudications of visa applications are conducted by an officer at the US Embassy or US Consulate with jurisdiction over the proposed beneficiary.  Such an adjudication is made pursuant to relevant US Immigration law and based upon the Consular Officer’s findings of fact. Each case is adjudicated based upon the unique set of facts in the case. In a recent announcement from the American Department of State it was revealed that those agencies tasked with issuing US visas are to add security features to American travel documents issued to foreign nationals. To quote the announcement as posted on the American Immigration Lawyers Association (AILA) website:

This public notice announces an amendment to the Biometric Visa Program. Section 303 of the Enhanced Border Security and Visa Entry Reform Act of 2002 has required, since October 26, 2004, that all visas issued by the Department must be machine-readable and tamper-resistant and use biometric identifiers. In consultation with the Department of Homeland Security (DHS) and the Department of Justice (DOJ), the Department determined that fingerprints and a photo image should be required as biometric identifiers. When the biometric visa program began, available technology allowed for the efficient capture and comparisons of only two fingerscans. As a result of technological improvements, the Department instituted a ten fingerscan standard to raise the accuracy rate in matching fingerscans and enhanced our ability to detect and thwart persons who are eligible for visas.

As implied above, the Department of States is not the only American agency which will have a role in creating more effective security enhancements for American visas. The Department of Homeland Security will also play a part in this important endeavor. To further quote the announcement posted on the AILA website:

In establishing the Biometric Visa Program, the Department coordinated closely with the Department of Homeland Security (DHS). The Biometric Visa Program is a partner program to the DHS US-VISIT Program that is in effect at U.S. ports of entry and that uses the same biometric identifiers. By coordinating these two programs, the two departments have ensured the integrity of the U.S. visa. This is accomplished by sending the fingerscans and photos of visa applicants to DHS databases. When a person to whom a visa has been issued arrives at a port of entry, his or her photo is retrieved from a database and projected on the computer screen of the Customs and Border Protection officer. The person’s fingerscans are compared to the fingerscans in the database to ensure that the person presenting the visa is the same as the person to whom the visa was issued.

The new security features are likely be used for visa categories such as the K1 visa, the K3 Visa, and the common US Family Immigrant visas (CR1 Visa, IR1 visa) not to mention the non-immigrant visa categories such as the B1 visa and the B2 visa. That said, it seems unlikely that this will have an adverse impact upon those who seek a US visa in compliance with relevant US law.

Although the full-scale implementation of this program has yet to take effect, there are many who feel that more effective security measures will help ensure that there will be less fraud perpetrated against the United States government by foreign nationals wishing to illegally enter the USA.

On this blog we often discuss issues associated with US passports and US Immigration. Recently, this author discovered that the Department of State (DOS) is seeking comments regarding a proposed rule change which would alter the way in which DOS collects information prior to American passport issuance. The following excerpts are taken from the American Immigration Lawyers Association (AILA) website. To quote one page from the AILA website:

The Department of State is seeking Office of Management and Budget (OMB) approval for the information collection described below. The purpose of this notice is to allow 60 days for public comment in the Federal Register preceding submission to OMB. We are conducting this process in accordance with the Paperwork Reduction Act of 1995….

Abstract of proposed collection:

The information collected on the DS-3053 is used to facilitate the issuance of passports to U.S. citizens and nationals under the age of 16. The primary purpose of soliciting the information is to ensure that both parents and/or all guardians consent to the issuance of a passport to a minor under age 16, except where one parent has sole custody or there are exigent or special family circumstances.

Methodology:

Passport Services collects information from U.S. citizens and non- citizen nationals when they complete and submit the Statement of Consent or Special Circumstances: Issuance of a Passport to a Minor under Age 16. Passport applicants can either download the DS-3053 from the Internet or obtain one from an Acceptance Facility/Passport Agency. The form must be completed, signed, and submitted along with the applicant’s DS-11, Application for a U.S. Passport…

Clearly the Department of State wishes to use the DS-3053 in order to collect what they deem to be the necessary information before issuing a passport to a minor child. The public policy reasons for this change of rules is somewhat obvious as the Department is likely concerned about improper issuance of a US passport to minor.

The information collected on the DS-5504 is used to facilitate the re-issuance of passports to U.S. citizens and nationals when (a) the passport holder’s name has changed within the first year of the issuance of the passport; (b) the passport holder needs correction of descriptive information on the data page of the passport; or (c) the passport holder wishes to obtain a fully valid passport after obtaining a full-fee passport with a limited validity of two years or less. The primary purpose of soliciting the information is to establish citizenship, identity, and entitlement of the applicant to the U.S. passport or related service, and to properly administer and enforce the laws pertaining to the issuance thereof…

In this instance, it would seem that the Department of State is primarily concerned with collecting necessary data so as to issue US passports only to those individuals who are legally entitled to such travel documents. US Citizenship has many benefits that are not accorded to Non-US Citizens. Therefore, those issuing US passports must take appropriate measures to ensure that US passports are not issued to individuals who are not legally entitled to such status. With laws such as the Child Citizenship Act, these measures are likely to become more necessary as individuals are deriving their US Citizenship in different way compared to Americans in previous generations.

The Department of State (DOS) is a multifaceted government agency as it is tasked with handling American foreign relations as well as Consular Affairs. That said, an often overlooked aspect of the American State Department’s mandate is refugee assistance. Unfortunately, throughout the world, economic and political turbulence causes the displacement and migration of local populations. In a recent government press release Eric Schwartz, Assistant Secretary of State for Population, Refugees, and Migration, had this to say about DOS’s role in international population migration:

In my first 11 months on the job, many friends, colleagues and counterparts have asked me about the scope of the humanitarian work of the State Department’s Bureau of Population, Refugees and Migration (PRM), which I am honored to lead. For those of you who already know our Bureau well, this note may not be critical reading. For those who don’t, I thought I’d take some time to describe the Bureau and its priorities, and finish by introducing our new Front Office team. Within the Department of State, PRM serves as the principal humanitarian advisor to the Secretary of State, provides key leadership on population and migration issues, and manages two high-impact foreign assistance accounts that totaled over $1.7 billion in FY 2009. Our mandate is to provide protection and solutions to the world’s most vulnerable people: refugees, conflict victims, stateless persons, and vulnerable migrants, and to do so by integrating diplomacy, advocacy and humanitarian assistance programs. In this effort, we seek to help realize the commitments of President Obama and Secretary Clinton to alleviate human suffering and create the conditions for sustainable recovery, and to build a more effective multilateral system for humanitarian response.

It is interesting to note that many of the issues associated with refugee assistance can trace their roots to routine diplomatic issues which is why the Department of State is an ideal mechanism for providing assistance to refugee populations. To quote the aforementioned press release further:

Most of the humanitarian situations to which PRM responds are rooted in political or security challenges. For this reason, our access to foreign heads of government and other key foreign government decision-makers is critical, as it fosters the integration of humanitarian diplomacy within a full range of U.S. government assistance and protection programs, and leverages these programs to achieve critical humanitarian objectives. Over the past many months, I’ve pursued international humanitarian objectives in visits with a range of senior foreign leaders and officials, including with President Fernandez of the Dominican Republic on issues relating to the status of Haitians; the Prime Minister of Jordan and the Vice Foreign Minister of Syria on issues relating to Iraqi and Palestinian refugees; and the President, Defense Minister and Foreign Minister on conditions for internally displaced persons in Sri Lanka.

In this author’s opinion, assisting refugees and displaced individuals is a noble pursuit. Therefore, the efforts of DOS in this regard should be applauded as this type of activity ought to continue as countries around the world strive for greater international harmony.
