In an interesting recent decision by the United States Circuit Court of Appeals for the 8th Circuit the Court found that they indeed have the prerogative to review and rescind an I-130 denial. The following is a direct quotation from the Court’s opinion which was distributed by the American Immigration Lawyers Association (AILA):
In addition, interpreting the statutory language as the government advocates would force this court to classify every decision involving fact-finding by the Attorney General as discretionary and would remove all such decisions from judicial review. That is not a reasonable interpretation in light of the provisions of the Immigration and Nationality Act itself setting forth our standard of review for factual determinations in removal proceedings.
As one could likely gather from the above cited quote, the United States government’s position regarding denial of I-130 petitions basically could have created a situation in which Courts would not be able to review the decisions made by adjudicators at the United States Citizenship and Immigration Service (USCIS). It was interesting that the Court was not persuaded by this argument and reviewed the decision notwithstanding government objection.
For those who are unaccustomed to the US visa process, the I-130 petition is generally the first step in bringing an alien immediate relative to the USA. This petition is often utilized by those wishing to bring a foreign spouse to the United States. In cases where the I-130 petition is approved, the case file is usually forwarded on to the United States National Visa Center (NVC) which is an agency under the jurisdiction of the American State Department. The NVC acts as a sort of clearinghouse for visa applications. Therefore a Vietnamese spouse will likely process his or her visa application at the United States Consulate in Ho Chi Minh City via the NVC. Meanwhile, a Thai spouse will likely process his or her visa application through the US Embassy in Bangkok by way of the National Visa Center. Chinese spouses may process through one of the many US Consulates in China or the US Embassy in Beijing. The same can be said for India as the US Missions in both countries have dramatically changes Consular Processing procedures to provide more convenient options to American visa seekers after NVC processing.
The issue of judicial review in matters pertaining to United States immigration is a complicated one. Therefore, differing aspects of the US visa process may be subject to varying levels of judicial review depending upon the circumstances of a given case. For this reason some bi-national couples opt to retain attorney assistance in processing visa petitions and applications as a licensed professional can provide significant insight into overall processing procedures and provide strategies for streamlining the visa process.

In recent postings on this blog, the administration has noted that the United States Citizenship and Immigration Service (USCIS) is poised to raise some of the costs and fees associated with American Immigration. To quote directly from the official website of USCIS:
WASHINGTON - U.S. Citizenship and Immigration Services (USCIS) reminds customers that its new fee schedule goes into effect Nov. 23, 2010. Applications or petitions postmarked or otherwise filed on or after this date must include the new fee, or they will be rejected.
USCIS published the new fee schedule in the Federal Register on Sept. 24, following a comprehensive review of public comments received after publication of the proposed rule this summer.
The new fee schedule increases application and petition fees by an average of about 10 percent but does not increase the naturalization application fee.
Although no one likes to see fee increases, there are some who argue that an increase in processing fees is a necessary consequence of both inflation and the rising cost of the services sought. It should be noted that USCIS recently posted a shortfall and the recent fee increase would seem to be one response to this issue.
The new policy will also usher in new fees that have not previously existed. As they did not exist before it is not really correct to call the new fees “increases,” but as they result in new overall costs, the term increase could be used since the fee was technically increased from nothing to the new fee. To quote from another page of USCIS’s website:
The final fee rule establishes three new fees, including a fee for regional center designations under the Immigrant Investor (EB-5) Pilot Program, a fee for individuals seeking civil surgeon designation, and a fee to recover USCIS costs to process immigrant visas granted by the Department of State. Additionally, the final rule reduces and eliminates several fees, including some for servicemembers and certain veterans of the U.S. armed forces who are seeking citizenship-related benefits. The final rule also expands the availability of fee waivers to additional categories.
It is interesting to note that one of the newly instituted fees involves the EB-5 visa (also referred to as an investor visa). There are those who posit that the EB-5 visa might become increasingly popular in the upcoming months as the American dollar remains somewhat low compared to other currencies. Therefore, some foreign nationals could invest in EB-5 programs at comparatively cheaper rates due to the current exchange rate with the dollar. This is a net benefit to the United States as influxes of foreign capital would likely prove beneficial in a monetary sense while the infusion of foreign investors with a stake in the American economy could prove to be a catalyst for future innovation, economic activity, and overall growth.
As noted in a previous posting, the USCIS fee associated with the K-1 visa is expected to decrease when the final rule in promulgated. Although, Department of State fees associated with the K1 visa interview have recently been increased.

USCIS Proposes an Adjustment of Immigration Fees and Costs

In previous posts on this blog, this author has discussed proposed fee increases of the United States Citizenship and Immigration Service (USCIS). In a recent announcement from USCIS, this matter again came to this author’s attention as USCIS announced a final rule on the issue. To quote directly from the actual announcement as distributed by the American Immigration Lawyers Association (AILA):
U.S. Citizenship and Immigration Services (USCIS) today announced a final rule adjusting fees for immigration applications and petitions. The final rule follows a period of public comment on a proposed rule, which USCIS published in the Federal Register on June 11, 2010. After encouraging stakeholders to share their input, USCIS considered all 225 comments received. The final rule will increase overall fees by a weighted average of about 10 percent but will not increase the fee for the naturalization application. The final rule will be published in the Federal Register tomorrow,September 24, and the adjusted fees will go into effect on November 23, 2010.
“USCIS is grateful for the valuable public input that we received as we prepared the final fee rule,” said USCIS Director Alejandro Mayorkas. “We remain mindful of the effect of fee increases on the communities we serve, and we will continue to work to enhance the services we provide.”
The final fee rule establishes three new fees, including a fee for regional center designations under the Immigrant Investor (EB-5) Pilot Program, a fee for individuals seeking civil surgeon designation, and a fee to recover USCIS costs to process immigrant visas granted by the Department of State. Additionally, the final rule reduces and eliminates several fees, including some for servicemembers and certain veterans of the U.S. armed forces who are seeking citizenship-related benefits. The final rule also expands the availability of fee waivers to additional categories.
USCIS is a primarily fee-based organization, with about 90 percent of its budget coming from fees paid by applicants and petitioners for immigration benefits. The law requires USCIS to conduct fee reviews every two years to determine the funding levels necessary to administer the nation’s immigration laws, process immigration benefit requests and provide the infrastructure needed to support those activities. The final fee rule announced today concludes a comprehensive review begun in 2009.
USCIS’s fee revenue in fiscal years 2008 and 2009 was much lower than projected, and fee revenue in fiscal year 2010 remains low. While USCIS received appropriations from Congress and made budget cuts of approximately $160 million, this has not bridged the remaining gap between costs and anticipated revenue. A fee adjustment, as detailed in the final rule announced today, is necessary to ensure USCIS recovers the costs of its operations while also meeting the application processing goals identified in the 2007 fee rule.
Those with foreign fiances may take note of the fact that within this same announcement it was noted that the petition fees for the fiance visa will be reduced from 455 United States dollars to 340 United States dollars. On the whole, there are some who may not particularly welcome this announcement, but it would appear that the costs associated with providing Immigration services have reached the point that a fee adjustment is in order.
It should be noted that the fees noted above may not be the only costs that arise during the processing of a United States visa. This is due to the fact that the US visa process is somewhat bifurcated as USCIS is tasked with adjudicating the initial immigration petition while a US Embassy or US Consulate with appropriate jurisdiction is responsible for processing visa applications for travel documents sought outside of the United States of America. Recently, the US Department of State announced an increase in fees associated with adjudication of K1 visa applications abroad. That said, other fees were reduced. These fee adjustments seem to correlate to the underlying costs and fees associated with the adjudication of these applications.

Department of State Seeks Comments Regarding the Form DS-156K

Those who read this blog on a regular basis may have noted that recently less attention has been paid to the K1 visa than in the past. This development is partly due to the fact that there has been little to report regarding the US fiance visa as there have been few dramatic changes to the K1 visa process since the beginning of the year 2010. That said, with Comprehensive Immigration Reform possibly on the horizon, there are those who believe that many changes will be made to current US Immigration protocols. In a recent announcement, the American State Department sought comments regarding the DS-156K. This form is specifically used for Consular Processing of the K1 fiance visa. To directly quote an excerpt from the announcement as distributed by the American Immigration Lawyers Association (AILA):
We are soliciting public comments to permit the Department to: Evaluate whether the proposed information collection is necessary to properly perform our functions. Evaluate the accuracy of our estimate of the burden of the proposed collection, including the validity of the methodology and assumptions used. Enhance the quality, utility, and clarity of the information to be collected. Minimize the reporting burden on those who are to respond, Abstract of proposed collection: Form DS-156K is used by consular officers to determine the eligibility of an alien applicant for a non- immigrant fiancee visa. Methodology: The DS-156K is submitted to consular posts abroad.
In the past, the DS-156K might have also been utilized in a K3 Visa application pending before a US Consulate or US Embassy. However, the National Visa Center announced this year that many of the K3 visa applications will be “administratively closed” in cases where the underlying I-130 petition (used for spouse visas such as the CR1 Visa and the IR1 Visa) arrives at NVC simultaneously or prior to the arrival of the I-129f petition for a K3 visa.
In the context of the K1 visa, this request for comments would appear to be an attempt by the State Department to assess the utility of the DS-156K in an effort to streamline the processing of future K visa applications. How the comments will ultimately be used remains to be seen, but any attempt to make the visa process more efficient should be greeted positively by this author as the visa process can sometimes prove to be confusing and cumbersome those American Citizens wishing to bring a loved one to the United States.

National Visa Center To Begin An Electronic Processing Pilot Program

Those with pending visa petitions and applications may have only had a passing experience dealing with the National Visa Center. For example, the National Visa Center plays a rather small role in the K1 visa process. Meanwhile those seeking a CR1 Visa or an IR1 Visa have probably had extensive dealings with the National Visa Center (NVC). In recent weeks, the NVC changed some of their processing policies for certain US Marriage Visas. Therefore, many of those seeking K3 Visa benefits have seen their application “administratively closed” by the NVC where the underlying I-130 arrived prior to, or contemporaneously with, the I-129f petition. In a recent announcement from the American State Department it was announced that NVC has begun a pilot program that many hope will eventually lead to simplification of the NVC document compilation process. To quote directly from the State Department’s announcement, as distributed through AILA:
The Immigrant Visa Electronic Processing Program is a pilot project which uses electronic communication and documentation methods to simplify and accelerate the immigrant visa application process. This program uses e-mail for communication and submission of all forms and documents to the NVC using the Portable Document Format (PDF). Under the Electronic Processing Program all forms will be downloaded, completed, signed (if required), scanned, saved as PDF files, and e-mailed to the NVC. Required civil documents and supporting documents must be converted to PDF files by scanning and e-mailed to the NVC. After the NVC has completed processing the applicant’s petition, the applicant will need to present the original physical documents to the US Embassy/Consulate at the time of the applicant’s visa interview. Failure to do so may cause a delay or denial of the visa being sought.
It is this author’s opinion that this policy change will have a tremendous impact upon the US visa process and will likely lead to faster visa processing in general. It will be interesting to see how this new program will impact US Consular Processing abroad. As noted in the announcement, original documentation will not be required by the NVC in some cases. Those who did not remit original documentation to the NVC may need to do so at the visa interview which usually occurs at a US Embassy or US Consulate with appropriate jurisdiction. Those who fail to remit such documentation may be subjected to a 221g refusal. In some cases, issuance of a 221g can delay a case by weeks, or in a limited number of cases the case could be delayed by months.
That said, those seeking visas to the United States are still well advised to seek the assistance of a competent licensed American attorney from the USA. Regardless of increased processing efficiency, there are many factors which can affect a visa application and competent advice and counsel can forestall unforeseen problems.

This author has recently been informed that the United States Citizenship and Immigration Service (USCIS) is poised to conduct a thorough policy review which will delve into USCIS’s customer service procedures and look for ways to improve the US immigration system. As a first step, USCIS announced that a public survey would be conducted. Below are excerpts from a USCIS press release (distributed by the American Immigration Lawyers Association [AILA]), which outlines the purpose of the policy review and provides guidance regarding further methods of information gathering in an effort to improve USCIS customer service policies:
WASHINGTON— U.S. Citizenship and Immigration Services (USCIS) has announced the results of a public survey that launched the USCIS Policy Review, an unprecedented, top-to-bottom examination of the agency’s adjudication and customer-service policies. The survey results helped USCIS select the first 10 issue areas to address in the agency-wide review.
Informed by the survey responses, the agency’s needs, and input from the workforce, the USCIS Policy Review will begin by examining policies in the following issue areas: National Customer Service Center; Nonimmigrant H-1B; Naturalization and Citizenship; Employment-based Adjustment of Status; Family-based Adjustment of Status; Employment-Based Preference Categories 1, 2 and 3; Refugee and Asylum Adjustment of Status; Form I-601; General Humanitarian; and Employment
Authorization and Travel Documents.
“As an agency, we must achieve consistency in the policies that guide us and in how we implement them for the public benefit,” said USCIS Director Alejandro Mayorkas. “To achieve that critical goal, we are partnering with the public in this major undertaking to review our adjudication and customer-service policies. We will work collaboratively toward the shared objectives of consistency, integrity, transparency and efficiency.”
In April 2010, USCIS issued a survey that asked any interested member of the public, as well as its own workforce, to help identify the issue areas that the agency should examine first. USCIS received approximately 5,600 survey responses from diverse stakeholders. Those results are now available, along with a summary developed by USCIS’s new Office of Performance and Quality.
Some have questioned the need for such a survey as there are those who feel that USCIS’s current policies do not need improvement. Clearly, this is not the official view of USCIS as can be evidenced by the following statement:
On April 15, 2010, U.S. Citizenship and Immigration Services (USCIS) launched the USCIS Policy Review, an unprecedented, top-to-bottom examination the agency’s adjudication and customer service policies with the engaged participation of the USCIS workforce and the public. USCIS issued a survey that asked any interested member of the public, as well as its own workforce, to help identify the issue areas that the agency should examine first. Nearly 5,600 stakeholders responded to the survey, representing current immigrant and non-immigrant visa holders, employers, immigration attorneys and advocates, among others, in addition to responses from approximately 2,400 members of the USCIS workforce. Those responses helped USCIS select the first 10 issue areas to address in the agency-wide review. USCIS is now convening working groups to review the first 10 issue areas.
The press release went further than merely providing information regarding this important policy review. In an effort to provide the public with relevant information, the United States Citizenship and Immigration Service (USCIS) also provided a “Q & A” component to the recent press release. The following are questions and answers arising in connection with USCIS’s policy review initiative:
Questions and Answers
Q. What is the USCIS Policy Review?
A. The USCIS Policy Review is a comprehensive review of policy, guidance, and procedures related to our adjudications and customer service. The Policy Review is divided into four stages: (1) assembling and categorizing existing policy documents; (2) deciding which issue areas to review first, with input from surveys of the workforce and external stakeholders; (3) completing a review of policies in each identified issue area; and (4) consolidating and publishing updated policy documents (as appropriate), once approved.
Q. How does the Policy Review advance major goals already established for USCIS and the Department of Homeland Security (DHS)?
A. In the 2010 Quadrennial Homeland Security Review (QHSR), DHS identified the effective administration of the immigration system as a key priority. In particular, the QHSR emphasized the importance of a system that produces fair, consistent and prompt decisions for the public it serves. The Policy Review is designed to ensure that USCIS meets that standard in its work.
Q. How does the Policy Review relate to USCIS’s responsibilities and authority under federal law?
A. By law, USCIS is charged with setting policies and priorities for the administration of immigration services. USCIS will be reviewing those policies in our current effort. If the Policy Review identifies the need for proposed regulatory changes, we will fully engage in the federal rulemaking process. The purpose of the Policy Review is not to develop proposed changes to the immigration statutes established by Congress.Q. Will the Policy Review change USCIS policy?
A. In many cases, yes. Working groups will evaluate policy based on USCIS goals, legal requirements and stakeholder concerns. These working groups will draft updated policy documents and proceed through USCIS’s policy-approval process. If the Policy Review identifies the need for proposed regulatory changes, USCIS will fully engage in the federal rulemaking process.
Q. What happens to existing policies during the course of the Policy Review?
A. While the Policy Review is underway, all policies already in place remain in full force and will be honored. From time to time in the course of the agency’s operations, policy issues may arise that require immediate attention outside the course of the formal Policy Review. Q: What prompted the Policy Review?
A. USCIS is committed to ensuring that our policies are consistent and up to date. To that end, the agency has launched the USCIS Policy Review to examine our policies with input from the public it serves and from its workforce.

A: No. The effort to undertake a top-to-bottom review of our adjudication and customer service policies is an unprecedented initiative for USCIS.

The Policy Review is a multi-year effort designed to work thoughtfully through thousands of policy documents, many of which overlap or complement each other, in collaboration with the USCIS workforce and external stakeholders. New policy documents, once drafted, will be submitted through the USCIS clearance process, with many posted on the USCIS website for public comment.
At the time of this writing, there have been relatively few changes in the law regarding US Family Visas. Although administrative and regulatory changes have had a significant impact upon processing of the US Marriage Visa and the US fiance visa. That said, the recent fee increase for Consular Processing of the K1 visa (fiance visa) and the administrative closure of K3 Visa applications by the National Visa Center were promulgated by the Department of State (DOS) as there has been little recent change in the fee structure and administration of USCIS’s adjudication of family based visa petitions.
This author is of the opinion that this unprecedented policy review should be welcomed as it may herald further improvements to the American Immigration system and provide immigrants and Americans with better overall service. One must applaud USCIS for taking the initiative and promoting positive change.

K Visas vs. Immigrant Visas: Increased Fees May Lead to New Strategies

With the recently announced fee increases associated with K visa applications filed overseas, there are many who feel that serious thought should be given to the type of visa a couple should petition to obtain. In the past, many couples who were thinking of marriage opted to apply for a US fiance visa, also referred to as a K1 visa. That being said, it was recently announced that the application fee for all K visas sought overseas would be increased from $131 to $350. Apparently, the resources accrued are to be used in furtherance of fraud prevention measures as well as implementation of measures meant to streamline the overall visa process. As the fee increase was only recently announced, it remains to be seen how newly acquired fees will be used on the Consular level. With that in mind, it has also been recently announced that USCIS may be raising fees for Immigrant visa petitions. For those who are unfamiliar with this blog, it should be noted that for purposes of traveling to the USA, the K1 visa and the K3 Visa are considered to be immigrant visas even though they do not automatically confer lawful permanent residence to the bearer upon entry in the USA.
Those seeking a US visa would be prudent to seriously consider their options because the costs associated with the process of applying for and obtaining a CR1 visa or an IR1 visa may be lower in some cases when compared to the costs associated with the K1 visa process. When viewed from a long term perspective the CR1 visa, although more time consuming to obtain, confers lawful permanent residence to the bearer upon entry and thereby negates the necessity of adjustment of status which is necessary for those who travel to the US on a K1 visa with the intent to marry the Petitioner and remain in the USA permanently.
In most cases, those wishing to bring a spouse to the USA are wise to bear in mind the fact that K3 visa applications, once a popular travel document for bi-national married couples, are now being administratively closed by the National Visa Center if the underlying I-130 is approved prior to, or at the same time as, the I-129f application. This has lead to many instances of spouses being required by circumstance to process a CR1 or IR1 visa rather than a K3 visa because the NVC simply will not process the K3 application.

USCIS Issues New Employment Authorization Document (EAD)

For those who bring a foreign fiance or fiancee to the United States of America, an often asked question is: “What if my fiancee wants to work in the USA prior to her adjustment of status?” The answer to this question is somewhat complicated. When a foreign fiancee or spouse enters the United States on a non-immigrant K1 visa or K3 Visa, the entrant is generally not authorized to take up employment in the USA until that alien either adjusts status to permanent residence (Green Card) or obtains employment authorization. Recently, the United States Citizenship and Immigration Service (USCIS) announced that, in an effort to decrease immigration fraud, new Employment Authorization Documents are to be issued. The following is a direct quote from USCIS’s official statement:
U.S. Citizenship and Immigration Services (USCIS) today announced that it has revised the Employment Authorization Document (EAD), or Form I-766, to incorporate the addition of a machine-readable zone on the back of the card.. This update to the EAD is part of USCIS’s ongoing efforts to deter immigration fraud. Starting May 11, USCIS began issuing the revised EAD cards. The machine-readable zone is compliant with International Civil Aviation Organization standards. USCIS also removed the two-dimensional bar code on the backside of the card and moved the informational box of text to just beneath the magnetic stripe on the card. The revised card retains all of its existing security features.
In most cases, foreign fiancees or spouses of US Citizens opt to wait for permanent residence before taking up employment. However, in some instances this is not the case as there are increasing numbers of foreign fiancees and spouses who work for multi-national companies. These international businesses sometimes wish to have their non-US Citizen employee start work in the USA as soon as they can. Therefore, there are situations in which speedy employment authorization is a necessity.
In the past, K3 Visa holders could seek employment authorization at the port of entry when they entered the USA. As the K-3 Visa is being increasingly phased out, this method of receiving employment authorization is being employed less frequently. Another issue that often arises in the context of Employment Authorization is that of advance parole. Holders of a US fiance visa cannot leave the United States prior to adjustment of status and simultaneously maintain their lawful K1 status unless they apply for, and receive, an advance parole travel document. In some cases, couples making an application for advance parole will also make an application for an EAD in order to work in the USA.

US Embassy to Resume Operations on Tuesday May 25, 2010

Updated Warden Message: Curfew Extended, Embassy to Reopen on May 25
(May 23, 2010) This warden message alerts U.S. citizens traveling to and residing in Thailand that the Royal Thai Government through the Center for the Resolution of the Emergency Situation (CRES) has announced that it will impose a shortened curfew for at least one more day and will evaluate the need to extend the curfew on a day-to-day basis. To find out if the Royal Thai Government has extended the curfew, please refer to local media and our website. We will not send out another email warden message solely regarding the curfew, but will update this message on our website.
The curfew is in place tonight, Sunday, May 23 from 11:00pm to 5:00am. This curfew applies to the Bangkok metropolitan area and to the Thai provinces listed below. Royal Thai Government officials may change this list after this Warden Message is sent out, so please refer to media or local officials for the latest information. American citizens should maintain a low profile and refrain from nighttime outside activity until the situation improves.
If you will be flying out of Bangkok in the next several days, we recommend that you leave for the airport well in advance of the curfew hours. If you are arriving at a Bangkok airport during curfew hours, we recommend that you stay at the airport until after curfew hours. Reports indicate that Airports of Thailand (AOT) may coordinate transportation for passengers from Suvarnabhumi Airport to a few central locations in Bangkok during curfew hours. However, they are evaluating providing this service on a day-to-day basis. Passengers may not be able to find any transportation from Suvarnabhumi Airport to Bangkok during curfew hours and may need to wait until after curfew hours to go to Bangkok.
The U.S. Embassy, including visa operations, will be closed Monday, May 24. We will reopen all operations, including all consular services, on Tuesday, May 25. U.S. citizens are reminded that even demonstrations intended to be peaceful can turn confrontational and escalate into violence with little or no warning. U.S. citizens are urged to avoid the areas that may be targeted for demonstrations and to exercise caution in their movements around Bangkok.

Please note that the Embassy is scheduled to resume normal operations on Tuesday May 25th. That being said, routine follow-up matters for the Immigrant Visa Unit can only be dealt with on Monday and Wednesday afternoons. Therefore, document remittances in response to 221g refusals for travel documents such as the K1 visa or the CR1 Visa will likely only be accepted on Wednesday May 26, 2010.

U.S. Embassy Visa Services Closed May 24, 2010
Due to continuing security concerns in the area and access issues on Wireless Road, the U.S. Embassy is currently operating under emergency personnel staffing only. The Non-immigrant and Immigrant Visa sections will be closed May 24, 2010. If you have a non-immigrant visa interview appointment scheduled for May 24, 2010, your appointment will be rescheduled. As soon as the U.S. Embassy has determined the situation to be safe for Embassy Consular staff to return to work and for visa applicants to travel to the Embassy for visa appointments, we will advise those impacted through e-mail or phone with details on new appointment dates. Please Note: As a large number of people have been affected by these events, and the volume of appointments that have been scheduled for the upcoming weeks, it will not be possible to consider expedited appointments. We apologize in advance for any inconvenience this has caused.

How can I reschedule my appointment?
At present, we must ask applicants with visa appointments scheduled for the period of May 14 through May 24 to wait until the Embassy has determined when that it is safe to conduct visa appointments. All those impacted by this unexpected closure will be notified through the e-mail address or phone number provided during the visa interview appointment process.
I had a visa appointment scheduled during the period of May 14 – May 24. I have urgent travel to the United States, what can I do?
Unfortunately, due to the current security situation, the U.S. Embassy Visa Services is currently closed. We are unable to reschedule any visa appointments for applicants who had appointments made for the period of May 14 – May 24 and will be unable to accommodate expedited appointments. We suggest that you make alternate travel plans.
I had a visa appointment scheduled during the period of May 14 – May 24. Can I reschedule my appointment at another U.S. Embassy in a neighboring country?
Each U.S. Embassy has its own scheduling system and requirements for visa applicants. Fees paid in Thailand for the visa interview cannot be used abroad.
I had a visa appointment scheduled during the period of May 14 – May 24. Can I reschedule my appointment for the U.S. Consulate General in Chiang Mai?

If you had/have an immigrant visa appointment for the period of May 14 – May 24, it will be rescheduled. You will be contacted with a new date and time once the Embassy reopens. If you have been told to bring in documents on Mondays or Wednesdays, or to come in to pick up your visa, please do not come in until the Embassy reopens.
