It recently came to this blogger’s attention that new attention is apparently being directed toward the positive aspects of backpacking in Southeast Asia. In order to shed further light upon these developments it is necessary to quote directly from an article posted on the official website of the Sydney Morning Herald:

A memorandum of understanding (MoU) on tourism cooperation was signed by Aseantourism ministers and their counterpart during Asean Tourism Forum in Manado, North Sulawesi, on Thursday…

Tourism seems to have been a traditional source of revenue in the for both the Kingdom of Thailand and the Greater ASEAN region. Hopefully the signing of the memorandum noted above will provide economic benefits for both the ASEAN region as well as the Indian Sub-Continent. That stated, with the increasing velocity of economic expansion in Asia as a whole there is strong evidence to suggest that tourism may prove to be simply a gateway to further economic integration between all of the global economies. How these trends will play out in the future remains to be seen. However, the benefits of tourism could arguably be a true “win-win” situation for both the tourist as well as the host nation. ASEAN itself is a prime example of how tourism and increasing levels of tourists can lead to more robust levels of economic activity as a whole.

It recently came to this blogger’s attention that the Department of Homeland Security is to place Thailand on a sort of “risk list” pertaining to terrorism. In order to provide further details on this situation it is necessary to quote directly from the official website of The Nation, NationMultimedia.com:

A recent announcement by the US Department of Homeland Security said that Thailand will be on a new terrorism-risk list. The department has classified Thailand among countries that are known to “promote, produce or protect terrorist organisations or their members”. Spokeswoman for the department Gillian Christensen said in a written statement that countries “may have been included on the list because of the backgrounds of arrestees, not because of the country’s government itself”. Along with Thailand, three other US allies placed on the risk list are Egypt, Israel and the Philippines. In all there are 36 countries on this list of so-called Specially Designated Countries (SDCs) that “promote, produce, or protect terrorists”. Citizens from countries on this list who wish to travel to the US will be required to submit to a new “Third Agency Check”. In real terms, it could very well mean additional security check or possibly stricter rules for Thai citizens requesting visas to the US…

As noted in the aforementioned quotation, the ramifications of these developments could ultimately result in delayed processing of visas such as the K-1 visa, the CR-1 visa, and the IR-1 visa for fiancees and spouses of American Citizens. Meanwhile, those seeking employment or investment based visas such as the EB-5 visa or the L-1 visa may see further processing delays in matters where a visa is being sought through the US Embassy Thailand. Finally, it could be inferred that these developments will have an impact upon those seeking non-immigrant visas such as the B-1 visa, the B-2 visa, the F-1 visa, or the J-1 visa. Bearing all of this in mind, it remains to be seen how this announcement will actually effect the overall visa process.

In related news it was recently noted that the Royal Thai Immigration Police may be stringently enforcing immigration regulations with respect to the ED visa. The Deputy Director of the Thailand Ministry of Education recently summoned all language schools’ owners in Pattaya along with senior Chonburi Immigration Police Investigators to address this issue and notify the schools of the crackdown. “Now any school found to be selling the Education visa simply to allow the foreigner to stay in Thailand and not attending the school will be closed down and lose their license. All of the school’s students, whether attending or not, will have their visas cancelled,” the representative of the Ministry of Education stated…

There are many types of Thai visas including, but not limited to the Thai business visa and the Thai retirement visa. Although neither of these visa categories are of issue in the aforementioned quotation. Clearly, the events noted above could have implications for those who stay in Thailand on a Thai Education visa. That said, those actually utilizing an ED visa for educational pursuits are unlikely to be adversely impacted by this new policy. However, the overall impact of this new policy remains to be seen.

This blog routinely posts about issues related to Thailand visas and Thai Permanent Residence in an effort to provide some information on these issues to the general public. It would appear that there is some consternation among foreign nationals in Thailand who are awaiting the adjudication of Thai permanent residence applications at the Ministry of Interior.  To quote directly from a recent opinion piece on the website PhuketGazette.net:

PHUKET: It’s time for the Ministry of Interior (MoI) to set up a special task force to begin fast-tracking the processing of the huge backlog of permanent residency (PR) applications it is now sitting on in silence.

Such a move would have multiple benefits for all parties involved, including, especially, foreign investors (potential and extant) and Thailand’s all-important tourism industry.

For reasons that have apprently never been divulged by the MoI, the stacks of stale PR applications, submitted in good faith and at great expense by law-abiding, long resident “visitors” to Thailand, continue to gather dust at the ministry.[sic]

Clearly, this is a significant issue for foreign nationals in Thailand, especially those who have been in Thailand for a long enough duration so as to be eligible to apply for Thailand Permanent Resident status. Those holding permanent resident status in Thailand are permitted to be placed upon a Tabien Baan (also referred to as a house registration booklet). This should not be confused with a Yellow Tabien Baan or Foreign Tabien Baan which allows foreign nationals, without Permanent Residence status, to obtain a house booklet under certain circumstances.

Unlike the United States Permanent Resident process, the Thai PR process can be quite long and cumbersome. Many have noted that there currently exists a substantial backlog of Thailand Permanent Resident status applications as there have yet to be any new Permanent Residence booklets issued for many years.

Those wishing to obtain Thailand Permanent Residence should note that this status is highly coveted amongst foreign nationals while simultaneously being difficult to obtain. Those seeking permanent residence in Thailand are only eligible after remaining in Thailand on Thai visa extensions for a period not less than 3 years. Also, most permanent residence applicants must also have maintained a Thai work permit for a significant period of time at a salary level which comports with relevant Thai Ministry regulations.

There is a common misconception about Thailand regarding the country’s immigration procedures. Many from so-called “Western” countries do not understand that Thais take immigration issues quite seriously and make rules and regulations which could be described as stringent. This is especially true in matters pertaining to Thai permanent residence as Thai PR applications are capped by a nationality quota and subjected to intense scrutiny by the Royal Thai Immigration Police and the Thai Ministry of Interior. Therefore, those thinking of applying for Thai permanent residence are well advised to conduct research into the issue and, in some cases, retain qualified counsel to assist in such an undertaking.

It recently came to the attention of the administration of this blog that a new trade complex is to be erected in Bangkok for the purpose of facilitating the trade of Chinese goods in Thailand and Greater South East Asia. To quote directly from the Voice of America News website:

Chinese state media say work will begin this month on a massive trading complex in Bangkok where Chinese manufacturers will be able to re-export their goods.

The China Daily newspaper said Thursday that the China City Complex will cost $1.5 billion and sprawl over almost three-quarters of a square kilometer. Chinese manufacturers will be able to import goods to Thailand, taking advantage of a new free trade deal, and then ship to the United States and Europe under more advantageous quotas and tariffs.

It is interesting to note that China officially became the second largest economy in the world in 2010. This plan will likely result in an increasingly prosperous trade relationship between the Peoples’ Republic of China and the Kingdom of Thailand. The Voice of America News website went on:

China has been using trade and commercial projects to improve its diplomatic and strategic standing in Southeast Asia. Thailand’s deputy minister of commerce, Alongkorn Ponlaboot, is quoted by China Daily saying the China City Complex corroborates “a strategic business-partner relationship” between China and Thailand.

China’s free-trade agreement with the 10-member Association of Southeast Asian Nations was concluded last year.

Putting aside diplomatic and strategic matters, the ambitious project could result in economic benefits for many ASEAN countries (Association of South East Asian Nations) especially Thailand. The creation of a new commercial project such as the one proposed will likely come with the added benefit of new jobs for Thais near Bangkok, new business opportunities for Thai entrepreneurs, new trade opportunities for Thai, Chinese, and other foreign investors; and an overall increase in the flow of goods, capital, labor, and resources to the Kingdom of Thailand and the Greater ASEAN region.

Each year, foreign companies and individuals opt to pursue business ventures in the Kingdom of Thailand. In some cases, entrepreneurs incorporate a Thai Company in order to maintain limited liability while conducting business. Sometimes individuals opt to do business under a Thai sole proprietorship. Partnerships often prefer the added layer of limited liability that can be conferred upon certain members of a Limited Liability Partnership in Thailand. Large ventures conducting business in Thailand occasionally opt to take their enterprise public through the registration of a Thai public company. In any case, those wishing to conduct trade or business in the Kingdom of Thailand are well advised to contact a Law Firm in Thailand as advice and counsel regarding the unique aspects of Thai law can be highly advantageous for businesses making their first appearance in the Thai market. Those who read this blog may likely have noticed that the issue of Thai immigration is a frequent topic of discussion. Recently, this author came upon an interesting announcement regarding the issuance of Thai reentry permits at the Suvarnabhumi International Airport in Bangkok, Thailand. The following is quoted directly from the official website of Suvarnabhumi International Airport:

The Re-Entry Application Procedures and Requirements At Suvarnabhumi Airport
Date : 07 – 12 – 10
1. Aliens must submit the applicatoin by themselves.
2. The date of submitting application must be the date of departure.
3. Gather the required documents as below
- Passport or travel document (1 original plus 1 copy)
- One recent photograph (4X6 CM.)
- Fees – Single 1,000 Baht
- Multiple 3,800 Baht
4. Submit the application and required documents at Immigration Departure Division (East Zone), Suvarnabhumi Airport.
5. The service open daily from now on

In a previous posting on this blog, the administration pondered the prospect of Thai reentry permits and whether they would ever again be available at the airport as opposed to the Royal Thai Immigration Headquarters at Chaeng Wattana. It would appear that from this point onwards, Thai reentry permits will be available to departing foreign nationals at the airport.

For those who are unfamiliar with the protocols and rules associated with Thai immigration, anyone present in the Kingdom of Thailand on a Thai visa must obtain a reentry permit prior to leaving the Kingdom of Thailand. Those who fail to obtain a Thai reentry permit prior to departing Thailand may lose their Thai visa status upon departure. For this reason, reentry permits should be obtained by anyone in Thai visa status who wishes to return to Thailand. A frequently asked question in this vein is: do I need a reentry permit if I am present in the Kingdom on a visa exemption? The short answer: no. Those who enter the country on a Thailand visa exemption cannot obtain a reentry permit as they are not technically in possession of a valid Thai visa. Those present in the Kingdom of Thailand on a Thai visa extension are required to obtain a Thai reentry permit prior to departure lest the foreign national fall out of status entirely upon departing Thailand. The same can be said for those who are present in Thailand with lawful permanent residence. A Permanent Resident in Thailand must receive authorization to leave the country whilst simultaneously maintaining lawful status in the Kingdom or else face the prospect of falling entirely out of status upon departure.

Those who are present in the Kingdom of Thailand on a multiple entry one year Thai visa should not need to obtain a Thai reentry permit when departing the Kingdom, but those with a multiple entry visa are generally required to depart the Kingdom at least every 90 days in order to maintain lawful status.

In recent weeks there seems to have been some confusion related to the issue of overstaying one’s visa in Thailand. It would appear that there was a certain amount of consternation being created as a result of postings on the internet discussing Thai Immigration policies regarding overstay. Apparently, Thai Immigration authorities are heavily scrutinizing departing foreigners’ visas to ensure that those leaving the Kingdom of Thailand remained in lawful status for the duration of their stay and those not in lawful status at the time of departure must face legal consequences in the form of fines and possible incarceration. Penalties for overstay in Thailand have always been prescribed by relevant Thai Immigration law, but confusion seems to have arisen as a result of a posting on the internet stating that Thai Immigration procedures would be changing. However, the Phuket Gazette website phuketgazette.net subsequently reported that such speculation was incorrect. To quote directly from the Phuket Gazette:

Col Panuwat today told the Gazette, “I contacted the legal department at Immigration Bureau Headquarters on Soi Suan Plu in Bangkok, the Phuket Airport Immigration Superintendent and other authorities as well.”

“All have assured me that they are still following all the terms of the Immigration Act 1979, enacted on February 29 that year,” he said.

Under the Act, “any alien who stays in the Kingdom without permission, or with permission expired or revoked, shall be punished with imprisonment not exceeding two years, or a fine not exceeding 20,000 baht, or both.”

Penalties for Immigration violators can be rather severe, but in many cases individuals find that they have overstayed their visa by a matter of days. In a situation similar to this it is reasonable to believe that Immigration officers are unlikely to impose more than a fine on the offending party as they depart Thailand of their own accord. However, as the duration of one’s unlawful presence increases so too could one assume that the potential penalties might increase as well. Bearing that in mind, those pondering the overstay issue are wise to note that Royal Thai Immigration Officers have significant discretion in matters involving visas, admission to Thailand, and overstay in Thailand. As the aforementioned posting went on to note:

The Phuket Gazette notes that Immigration officers at checkpoints have always had complete discretion on what punitive measures to take with overstays, as specified above.

They can also deny entry to anyone arriving at a border checkpoint for any reason, even if the person arriving is in possession of a valid visa.

In the United States, Immigration matters are generally dealt with under Congressional plenary power and Immigration officers at the United States Customs and Border Protection Service (USCBP) are empowered with the authority to place prospective entrants into expedited removal proceedings or to simply deny a foreign national, even if said individual has a valid visa, admission to the USA. Thailand’s immigration rules are different from those of the United States, but one thing remains constant: Immigration Officers at any checkpoint throughout Thailand retain a great deal of discretion in matters pertaining to overstay under Thai law. Therefore, foreign nationals in Thailand should expect for overstay matters to be handled on a cases by case basis as each case is unique and no one has a right to remain in the Kingdom of Thailand without being in lawful status.

In a recent posting on the Chiang Mai Mail website, issues surrounding foreigners’ rights in Thailand were discussed. The issues came up in the context of a recent road show conducted by the Thai Ministry of the Interior. Foreigners residing in Thailand sometimes find it difficult to fully exercise their rights as the rules themselves can be somewhat vague. For example, the issue of alien registration on a Thai Tabien Baan can be confusing as few foreign nationals are fully aware of their right’s regarding registration. To quote the Chiang Mai Mail’s report about the recent Interior Ministry Roadshow:

Holders of Permanent residency can get a blue book (Tor Ror 14) and holders of temporary visas can get on the yellow book (Tor Ror 13) before they can apply for naturalization. The Provincial Administration reiterated an important point, that foreigners have the right to be listed on the census registration, “It is not well known even among officials. We have contacted registration officials that you have this right and you should insist on it.”

For many, registration on a Yellow Tabien Baan is beneficial because many Thai government offices view a Tabien Baan as definitive proof of lawful presence in Thailand and use the information in the Tabien Baan accordingly. Another issue that came up at the aforementioned roadshow was the issue of naturalization of those seeking Thai Citizenship. In the past, the language requirements for naturalization were rather stringent. During the recent roadshow the spokesperson for the Interior Ministry commented upon the revised linguistic requirements for naturalization to Thai Citizenship:

The requirements for naturalization were laid out, including the income requirements for both those married to Thais and those not married to Thais. The linguistics requirement has been reduced but the applicant must be able to sing the National and Royal anthems. Speaking and listening is mandatory but reading and writing is no longer required.

Finally, of particular interest to many foreign nationals in Thailand is that of the 90 day “check in” for foreigners present in the Kingdom on a “temporary” visa such as a Thai business visa or a Thai O visa. Regarding the Ministry of Interior’s stance on the issue, the Chiang Mai Mail was quoted as saying:

The next issue under discussion was Immigration and the right of habitation. Immigration officials discussed the various visas and how to obtain them as well as how to obtain Permanent Residency. The main issue of contention brought up by multiple Consul Generals, including Japanese Consul General Junko Yakata, was that of the 90 day reporting required of all foreigners on long stay visa extensions. Consul General Yakata told the officials that there are 3,000 Japanese nationals living in Northern Thailand. She requested a simplification of the process, perhaps by extending the length of time needed in between reports.

Chinese Consul General Zhu Weimin requested a change in the 90 day reporting procedure as well, citing the large numbers of Chinese students who attend Chiang Mai schools who cannot take time off from school to travel to Immigration to report. He suggested they open on the weekends for those who have jobs and classes.

The official justified the 90 day reporting by saying “it allows us the best possible protection. If someone goes missing then we have more recent information as to their whereabouts to give to the Embassy.”

90 day reporting is currently required of those foreigners remaining in Thailand on a Thai visa extension. Anyone in the Kingdom on an extension must report their address every 90 days. As can be gathered from the above quotation, some foreign nationals in Thailand feel that the 90 day reporting requirement is cumbersome. However, Thai authorities seem unwilling to change the rules as the current system would seem to provide the most efficient method of maintaining records as to the last known addresses of foreign nationals in Thailand. This is important as Thai authorities can use the data from 90 day reporting to apprise foreign governments of the location of their citizens for purposes of death or disappearance in Thailand. In this author’s opinion, the 90 day reporting scheme is rather cumbersome, but no one, as of yet, has provided a feasible alternative which would comport to the needs of all concerned.

Statement: Situation in Thailand

I would like to say that the United States deeply deplores the violence and loss of life that has resulted from clashes between security forces and protests from the United Front for Democracy Against Dictatorship (UDD).  We call on both sides to show restraint and to work to resolve differences through Thailand’s democratic institutions.

We are encouraged by the actions of the Red Shirt leaders who have surrendered to law enforcement agencies and support their call to supporters to return home peacefully.  However, we are deeply concerned that Red Shirt supporters have engaged in arson targeting the electricity infrastructure and media outlets and have attacked individual journalists.

We condemn such behavior and call on UDD leaders and affiliated opposition politicians to urge their supporters to stop such acts.  We remain very concerned about the situation in Thailand and we will continue to monitor those events closely.

At the time of this writing, the US Embassy in Bangkok is closed to those seeking routine services due to the unrest in the areas near the Embassy compound. In Bangkok, the situation seems to have stabilized. However, the city remains tense as most Bangkok residents seem to be hoping for an end to the unpleasantness and a return to relative normality.

On a related note, the Thai Tourism Industry is preparing for a major downturn moving forward. To quote the website ThaiVisa.com:

Thailand’s violent political turmoil has had a “disastrous” effect on the vital tourism sector, the country’s finance minister said Friday, stressing that the overall economy remained sound. “Tourism in value terms accounts for six percent of our GDP,” Finance Minister Korn Chatikavanij told a Tokyo conference, adding that the sector also accounts for “as much as 15 to 20 percent of the total employment.” “And clearly, with the events that took place over the past several weeks, and the pictures of these events flashing across TV screens across the world, it is going to have a very disastrous impact on tourism.” Thai security forces on Wednesday crushed a six-week protest by anti-government protesters in street battles that left 15 people dead and saw arsonists torch some 36 key buildings across the capital Bangkok. The stock exchange and the nation’s biggest shopping mall were among locations torched in the chaotic aftermath of the campaign to end the “Red Shirt” protesters’ occupation of Bangkok’s top retail district. Korn said that “we anticipate that the impact on the GDP of the protest so far is probably between 0.3 and 0.5 percent of GDP.” However, he stressed that the wider economic picture was sound in the kingdom, telling the conference that “we expect the formal Q1 (first quarter) figure to be in two digits” this year.

As we have previously discussed on this blog, the Thai Ministry of Foreign Affairs has waived fees for Thai Tourist Visas. However, the fees associated with applications for the Thai business visa and the Thai O visa remain the same.

In a recent posting on the popular website Thaivisa.com it was noted that the United States of America has honored an extradition request from Thai authorities that a suspect in a “drug gang” be extradited to the Kingdom of Thailand. The following is quoted from ThaiVisa.com:

BANGKOK: — Suwit “Cheng” Prasoprat, a member of the China-based “14K” drug gang, was handed over to Thai authorities on Sunday, nine years after a request for his extradition was filed, deputy attorney-general Thavorn Panichpan said yesterday.

Thavorn said members of the drug gang fled overseas after police investigators filed a case in February 2001 against Thaveewit Krairattanareuk, 46, plus Suwit and four others for having 3.6 tonnes of heroin destined for the US, and the attorney-general agreed to prosecute the gang.

Once it was discovered that Suwit was lying low in the US, Thai authorities filed an extradition request in March 2001, which was approved by an American court. However, Suwit appealed against the extradition in 2002, and though the Appeal Court upheld the lower court ruling, he appealed again to the Supreme Court. On April 19 this year, the US authorities notified Thailand that the extradition request had finally been approved and Suwit arrived in Bangkok on Sunday.

Lawyer Rewat Chanprasert said they previously extradited Boonsong Mekpongsathorn, 60, another suspect in the same case who also fled to the US.

Boonsong had been given the death sentence by the Thon Buri Criminal Court in January 2005, and the case was now with the Appeal Court. Thaveewit and another suspect, Komsak Kornjamrassakul, 50, were given life sentences in June 2001 and are now appealing their jail terms.

Narcotics Suppression Bureau chief Pol Lt-General Adithep Panjamanont said court permission would be sought to detain Suwit for a week pending further investigation, before the case was handed to prosecutors. He said the case stemmed from an arrest in 1998 over the possession of 126 kg of heroin on its way to the United States.

Police inquiries showed that Suwit, a Thai man with two nationalities and an address in the US, plus accomplices in China and Hong Kong known as the 14K gang, had carried out criminal activities in Thailand including arms deals, human trafficking and drug dealing.

Thai and US authorities worked together on the case until they had enough evidence for arrest warrants for Suwit and Boonsong in 2001, he said.

Adithep added that the police would extend the investigation to cover money-laundering and other criminal charges on Thai soil against Suwit, his accomplices and the 14K gang.

It was also reported that there are two other suspects in the same case – Suchat Rakraeng, who remains at large, and Kriengkrai Diewtrakul, who is in a Chiang Rai prison for another crime.

In an increasingly “globalized” world, cross-jurisdictional cooperation is becoming evermore commonplace. In the scenario described above, it is interesting to note that the subject is being extradited back to Thailand. There are some who speculate that as Thai authorities connect their computer systems to international warrant databases an increased number of foreign nationals residing in Thailand will be extradited to foreign jurisdictions as a result of increasing requests for extradition. Whether or not this will actually occur remains to be seen, but it is interesting to note the increasing trend of intergovernmental cooperation on an international level.

It should be noted that Royal Thai Immigration Police have begun integrating their system with warrant and criminal databases around the world. Therefore, there is reason to believe that this inter-connectivity could have a dramatic impact of Thai visa issuance and Immigration procedures in the future.

In a recent statement, the Director of the Terrorist Screening Center (TSC), Timothy J. Healy, discussed the overall methodology of the Center and how it has had a positive impact upon anti-terrorism initiatives of both the United States and the global community. The following in an excerpt from the statement, which has been distributed by AILA:

Established in 2003, the TSC is a multi-agency center that connects the law enforcement communities with the Intelligence Community by consolidating information about known and suspected terrorists into a single Terrorist Screening Database, which is commonly referred to as the “Terrorist Watchlist.” The TSC facilitates terrorist screening operations, helps coordinate the law enforcement responses to terrorist encounters developed during the screening process, and captures intelligence information resulting from screening.


Of paramount significance is the TSC’s success in making this critical information accessible to the people who need it most – the law enforcement officers who patrol our streets, the Customs and Border Protection Officers who protect our borders, and our other domestic or foreign partners who conduct terrorist screening every day. In the six years since we began operations, the Terrorist Watchlist has become the world’s most comprehensive and widely shared database of terrorist identities. The current terrorist watchlisting and screening enterprise is an excellent example of interagency information sharing whose success is due to the superb collaborative efforts between the TSC, the FBI, the Department of Homeland Security (DHS), the Department of State, the Department of Defense, the National Counterterrorism Center (NCTC) and other members of the Intelligence Community.

It is interesting to note the international character of this initiative. In a previous posting on this blog the author noted that Thai Immigration authorities have begun linking their database to international and American information databases in order to more accurately investigate individuals who may be a threat to security.

On a related note, it should be mentioned that due to the new synergy that has arisen as a result of international cross referencing of criminal record databases those Americans living or staying in a foreign country could have significant problems if they have an American warrant as having a US Criminal warrant could result is passport confiscation by a Consular Officer at an American Citizen Services section of a US Consulate overseas. This usually happens when Americans with such warrants need to obtain a new passport or add pages to their current passport. In order to forestall these types of problems, it is advisable to speak to an American attorney in order to assess one’s options with regard to dealing with the matter in the legally prescribed manner.
