Emergency American Citizen Services – New Temporary Location

The U.S. Embassy in Bangkok has set up a temporary location to provide emergency and very limited routine Consular Services to U.S. Citizens.  If you do not need your service right now, please wait until we reopen our Embassy facilities.

You must bring your original documents (when available).  If at all possible, please bring a photo copy of each of those documents as well.  Many of the forms are available on-line.  Please print out and complete your forms.  Bring the completed forms with you.  This will help us serve more people.

Beginning at 8:00am Wednesday, May 19, 2010, the services listed below will be available until further notice.  Newly issued Passports and Consular Report of Birth Abroad will not be available for pick up until the following work day.

Those who have appointments will be given priority and seen on the day of their appointment.  Those with appointments on Friday May, 15; Monday May 17; and Tuesday, May 18 will be given priority in the order of their original appointment.  Please bring a print-out or other proof of your appointment with you.

Appointments must be made on the Embassy website, http://bangkok.usembassy.gov.  Appointments cannot be made by phone.

Those without appointments will be seen on a first-come, first-served basis.  We will do our best to accommodate those without appointments if we have time between appointments, but we cannot guarantee that services will be available to those without appointments.

*CRBA APPLICANTS PLEASE NOTE:

Applicants for a Consular Report of Birth Abroad will only be seen with appointments; there will be no walk-in CRBA interviews.  Please come prepared with valid documentation; a detailed list is available on-line.  Failure to provide complete documentation may significantly delay the procession of your application.

As stated in the above announcement, one should refrain from traveling to the provisional American Citizen Services unless it is an emergency. The United States Embassy in Bangkok, Thailand is closed until after the 21st of May due to the unrest in the city.

Newspaper personnel for both the Bangkok Post and The Nation have been instructed to evacuate. It has been recently announced on both the website for the Bangkok Post as well as the website for the Nation Newspaper that their staffs have been instructed to evacuate and go home. The following is a direct quotation from the Nation’s website:

Nation Multimedia Group told its staff to leave the office at 3:15 pm following reports that angry protesters were heading to attack the office.

As has been previously noted on this website, the US Embassy Bangkok recently announced that their non-essential personnel have been evacuated and that their facilities will be closed for non-emergency matters until at least May 21, 2010.

Thai government offices in Bangkok are currently on holiday. However, this author has heard unconfirmed reports that Thai Immigration offices are still operating. That being said, this is mere anecdotal speculation as there is a great deal of confusion in the city at the time of this writing.

ในขณะนี้ สถานการณ์ในกรุงเทพมหานครยังคงตึงเครียด ที่มาจากเว็บไซต์หนังสือพิมพ์เดอะเนชั่น

At the time of this writing, the United States Embassy in Bangkok, Thailand is closed due to the political unrest in the urban areas surrounding the Embassy compound. That being said, the United States Citizenship and Immigration Service (USCIS) Centers in the United States are likely not impacted by this state of affairs. As a result, USCIS is processing petitions in much the same manner as usual. Below are the current USCIS processing time estimates for commonly filed US Family Immigration Petitions:

The US Embassy in Bangkok Thailand posted the following on their official website:

Announcement

Due to the ongoing security situation, the U.S. Embassy, including visa services, will remain closed on Tuesday, May 18.  American Citizen Services (ACS) will be available for emergencies only.

Individuals whose visa appointments have been impacted by the closure of the U.S. Embassy will be contacted through the email address(es) provided during the appointment registration process with information on rescheduling.

Individuals with ACS appointments, please go to the U.S. Embassy website to reschedule.  If you have problems rescheduling online, please email us at [email protected] or call us at 02-205-4049.  For individuals scheduling appointments for the first time, please go to the website to schedule your appointment.  Please note that we are unable to make first time appointments over the phone.

We sincerely apologize for the inconvenience, and thank you for your continued patience and understanding.

As the political situation in Thailand, and Bangkok particularly, remains precarious, it may be wise to avoid travel to the United States Embassy as it is physically located rather close to contested zone in Bangkok. To quote the website ThaiVisa.com:

The worsening violence has turned parts of the city into no-go zones as troops use live ammunition against anti-government demonstrators, who have blocked streets with burning tyres, and fought back with homemade weapons. A member of the official emergency medical centre in Bangkok said two more people had died overnight, including the first member of the military to be killed in the three days of running gunbattles on the city’s streets. He said 244 people had been wounded, including six foreigners. Guests at a luxury hotel in the city of 12 million people were forced to shelter in the basement after the building came under gunfire and was rattled by an explosion in the early hours of Monday morning. Fire gutted three commercial buildings in another area.

It seems to be increasingly self-evident that this most recent round of violence is to have a very detrimental impact upon the operations of businesses, government offices, and foreign legations in Bangkok. Those whose presence is not urgently required in Bangkok are urged to stay outside of the city and those in the city are being urged to stay clear of the protest sites or those areas which are contested. It should be noted that Monday May  17th, and Tuesday May 18th have been officially designated as holidays for Bangkok. To quote again from the website ThaiVisa.com, “The Centre for Resolution of Emergency Situation announced that the Cabinet made Monday and Tuesday special holidays for Bangkok. Deputy PM’s Secretary-General Panithan Watanayakorn said the special holidays are designed for the government to try to ease the situation.”

This author can only hope that this situation will come to a peaceful conclusion as soon as possible.

The following message was posted on the website of the United States Embassy in the Kingdom of Thailand:

Warden Message: Embassy Closed Friday, May 14; Update on Possible Outages in Bangkok

(May 13, 2010) This warden message alerts U.S. citizens traveling to and residing in Thailand that the Royal Thai Government through the Center for the Resolution of the Emergency Situation (CRES) has announced its plans to close off the demonstration area at the Ratchaprasong rally site in an attempt to disperse the protesters.  We understand that beginning today, May 13, at 6:00 p.m., authorities will take the following measures:

–limit transportation services, including the BTS Skytrain, MRTA, canal routes, and possibly bus routes.

–set up check points at all access routes to control and limit access to the rally site.  For details on what routes may be affected, please refer to local media.

–cut off electricity, water, and telephone to the rally site and possibly surrounding areas.  It is currently unclear how large an area will be affected.  It is also unclear how the UDD will respond.

The U.S. Embassy, including visa operations, will be closed tomorrow, Friday, May 14.   American Citizen Services (ACS) will be available for emergencies only.  If at all possible, the U.S. Embassy recommends against coming to this area on May 14.  If U.S. citizens currently have appointments with ACS for May 14, you may go online or call us at 02-205-4049 to reschedule.

U.S. citizens should avoid travel to and lodging in this area and the areas in and around all demonstrations, if possible.  If U.S. citizens must travel to these areas, they should exercise special caution and remain vigilant with regard to their personal security.  U.S. Embassy personnel who live around this area have been given the option to relocate to housing outside of the affected area until the situation is resolved.  U.S. citizens are reminded to exercise caution and vigilance at all times.

The United Front for Democracy against Dictatorship (aka UDD or “red-shirts”) continues to demonstrate in central Bangkok.  The UDD may change or expand their demonstration locations at any time.  Various other groups are engaging in pro-government or counter-demonstrations.  There have been several clashes between the security forces and the UDD and other demonstrators.  These clashes may escalate with no warning.  For areas currently affected by demonstrations, please refer to local media.  These demonstrations are expected to continue in Bangkok indefinitely.

U.S. citizens are reminded that even demonstrations intended to be peaceful can turn confrontational and escalate into violence with little or no warning.  U.S. citizens are urged to avoid the areas that may be targeted for demonstrations and to exercise caution in their movements around Bangkok.

Recently, the website ThaiVisa.com announced that the Thai Cabinet has drafted proposed legislation for the enactment of laws that would tackle the difficult legal issues surrounding surrogate parents and reproductive rights. The following is quoted from ThaiVisa.com:

BANGKOK: — The Cabinet yesterday approved draft legislation for children born through the use of Assisted Reproductive Technologies (ART), deputy government spokesman Bhumin Leeteeraprasert said.

This law permits two kinds of surrogate pregnancy: the one that uses the egg and sperm of a married couple; or one that uses the egg or sperm of either a husband or a wife, paired with the sperm or egg of another person.

According to the draft law, the Juvenile and Family Court would be given the authority of judging paternity cases for such children and a committee would be set up to protect the children. It also stipulates that the surrogate mother should be married, and her husband should consent to another man’s sperm being used. The draft law also authorises the Medical Council to set the criteria, methods and financial conditions for the care of surrogate mothers before, during and after the pregnancy.

The draft law also covers the criteria for the donation of eggs or sperm, their storage and the use of ART. It also prohibits the use of the egg or sperm of donors who have died without leaving written consent.

It also lists punishment for unethical doctors and makes transitory provision for endorsing medical professionals to be responsible and provide ART services according to the Medical Council’s regulations.

It also covers a transitory provision to endorse the rights of those born through the use of ART before this law goes in effect provided a request is filed with the authorised court to declare a surrogate child as a legitimate offspring of a couple that resorted to ART.

In the United States, many of these issues come up in court proceedings as many of these issues are, at their root, constitutional questions in the USA. In Thailand, as technology progresses at an increasingly dizzying rate, these issues must be dealt with or else those who wish to enjoy the benefits of technological progress will be left in something of a legal “limbo” if an unforeseen problem should arise. It is also interesting to note that the proposed law would address the issue of those would die and leave their genetic material in the care of those who can store such items. This author applauds the Thai Cabinet for choosing to prohibit the use of such genetic material unless the person to whom it belongs bequeaths it to another person prior to their death in an instrument such as a Thai Will.
