Same Sex Weddings Legalized in Vietnam (Marriage Itself Not Recognized)

It recently came to this blogger’s attention that Vietnam has legalized same sex wedding ceremonies performed in that Southeast Asian nation. Prior to this announcement it was illegal for same sex couples to have a marriage ceremony performed in Vietnam and also illegal for same sex couples to cohabit without fear of government reprisal. It should be noted that these recent measures only allow same sex couples to have a marriage ceremony, notwithstanding the fact that such ceremonies will have no legal recognition in Vietnam (or elsewhere). However, many LGBT rights activists believe that this is a significant step towards eventual marriage equality in Vietnam.
Meanwhile, in the Kingdom of Thailand the struggle still continues to see the full marriage equality. Unlike Vietnam, Thailand has allowed same sex marriage ceremonies within their jurisdiction for some time. It should also be noted that Thailand is one of the most tolerant nations in Southeast Asia when it comes to LGBT issues. However, the law in Thailand still stipulates that a legally recognized marriage is a union between one man and one woman. There are many activists in the Kingdom hoping to change these rules in order to allow same sex couples the right to get married. With recent political turmoil in the Kingdom and uncertainty surrounding upcoming elections it remains to be seen whether any change to the current law will speedily occur, but some believe that the tolerant attitude in Thailand will lead to changes in the law especially in light of the fact that recent proposals in the Thai parliament would, if adopted, allow same sex couples to legalize their marriages.
The issue of same sex marriage legalization is of concern to many same-sex bi-national couples since the Supreme Court’s 2013 decision granting federal recognition of same sex unions. One result of this decision was that same sex couples and spouses are now eligible to receive United States visa benefits in the same manner as different sex couples. Therefore, visas such as the CR-1 visa and IR-1 visa are now available to same sex couples who are already married. Although this may not be a highly sought after category in Southeast Asia at this time as no jurisdiction in the region currently recognizes same sex marriage, it could be of substantial importance in coming years as laws may be amended to equalize marriage laws for the LGBT community. Meanwhile, officials at the United States Citizenship and Immigration Service (USCIS) as well as the Department of State have noted that same sex couples, where one of the partners is American, who maintain a bona fide intention to marry in the USA may be eligible for the K-1 visa (more commonly referred to as a fiance visa). This type of visa allows the foreign fiance of an American citizen to travel to the United States for 90 days for the express purpose of getting married and filing for adjustment of status to Lawful Permanent Residence.

Government Shutdown Commences in Bangkok

During the early morning hours on Monday January 13th in Bangkok protestors calling for the resignation of the current Thai government commenced their “Operation: Bangkok Shutdown”. It appears from initial reports that 7 key intersections in Bangkok have been blocked including areas near government facilities. Protest leaders have noted their intention to continue the shutdown until the end of January. Should their demands be met, the shutdown may end sooner. The administration of this blog will not comment upon the politics behind these recent developments (leaving that task to news sites and political commentators). However, it is important to note that this situation will likely cause delays in government services, especially those sought in the Bangkok Metropolitan area.
The Thai government has taken measures to deal with the inconvenience this situation may cause. Most notable to foreign nationals in Bangkok was the recent announcement that provisional immigration offices have been established to deal with visa matters for foreign nationals unable to travel to the usual immigration offices located in facilities which are likely to be blocked by the protestors. The Office of the Royal Thai Immigration Police made the following announcement:

Ladprao Road, Wang Tong Lang, Bangkok.This temporary service will be started from January 13rd, 2014 until the better situation. We apologize for inconvenience.
Many foreign nationals remain in the Kingdom of Thailand on long term visas such as business visas, retirement visas, and marriage visas. Those present in the country for periods longer than 90 days are required to check in with immigration officials. Therefore, the current situation could adversely impact those wishing to travel to immigration offices for their quarterly “90 day check-in”. Furthermore, foreign business owners in Bangkok are likely to have issues not only in procuring government services, but also with logistics as a result of the demonstrations.
Hopefully, the situation in Bangkok will be resolved quickly and peacefully. In the meantime, it may be necessary to schedule extra time when traveling throughout the city and foreign nationals are encouraged to stay away from protest areas. The administration of this blog will continue to post updates regarding this situation as developments evolve.

Demonstrations To Continue As Thai Immigration Tightens Regulations

Notwithstanding the fact that demonstrations in Bangkok were briefly discontinued in order to observe His Majesty the King’s birthday, it appears that demonstrations are set to recommence as of Friday December 6th. It would appear that some anti-government demonstrators have remained in government office buildings as of the morning of the 6th as pro-government activists vow to undertake demonstrations at a later date.
The demonstrations in Bangkok have been a cause for concern especially for businesses which operate in the Thai tourism sector. However, officials in the Thai government appear willing to take measures to maintain tourism numbers in Thailand. The fact that a number of governments around the world have issued travel warnings to their citizenry has been a cause for worry amongst many in the tourism industry. It was recently announced that notwithstanding the recent demonstrations tourism numbers in Thailand are still holding strong, but should demonstrations continue and tensions escalate there are some who worry that the effects could be detrimental. Hopefully, leaders from both factions can come to an amicable solution and avert a prolonged stalemate, only time will tell.
Meanwhile, various news outlets throughout Thailand are reporting upon recent news about Thai Immigration officials taking a firmer stance regarding the issuance of Thai retirement visas. In the past it was possible to obtain a retirement visa based upon showing a balance of eight hundred thousand Thai baht in a Thai bank account. Furthermore, a retired married couple could both use this balance when making an application for a retirement visa. With the passage of a law amending the Thai immigration rules, officials with the Thai immigration police have announced that future Thai retirement visa applicants must now show that they independently maintain an eight hundred thousand baht bank balance. This means that it is no longer possible for a foreign retired married couple to both obtain retirement visas based upon showing only 800,000 baht. In fact, such a hypothetical couple would now need to show at least 1.6 million baht in a joint Thai bank account or in 800,000 increments in two separate accounts. Officials noted that those maintaining a statutorily defined minimum pension may be eligible to receive a retirement visa provided proof of said pension could be verified by Thai immigration authorities. Those married to Thai nationals could also be eligible to receive Thai marriage visas (sometimes referred to as an O visa) which requires a lower bank balance in order to prove financial ability to support one’s spouse.

Tourism A Top Concern Amidst Demonstrations

It was recently announced that the President of the Tourism Council of Thailand Piyaman Tejapaibul met with Prime Minister Yingluck Shinawatra at Government House on 12 November 2013 in order to discuss matters pertaining to tourism in the Kingdom of Thailand. This recent meeting was held as Bangkok and other areas of Thailand have seen demonstrations which seem to be causing concern for Thai officials. Although many in Thailand feel that the demonstrations should be monitored, they are unlikely to adversely impact the tourism sector so long as the demonstrations remain confined to specific relatively small geographic areas. Over 26 million tourists are expected to travel to Thailand in 2013 and are also expected to bring in revenue well over 1.5 trillion Thai baht to the local economy. This being the case, it is little wonder that officials in the Thai government as well as the industries which thrive upon tourism related activities are concerned about the possible negative consequences stemming from recent political demonstrations (regardless of affiliation).
The Thai government appears committed to a policy non-violence towards demonstrators as, so long as demonstration remain peaceful, they are not prohibited by law. Meanwhile it currently appears that these demonstrations are confined to only a few areas of the City of Bangkok, namely: Phan Fa Bridge, Makkhawan Bridge on Ratchadamnoen Avenue, and Democracy Monument. At present, increased security measures have been undertaken in these locations as a precautionary measure while traffic police in the city work in earnest to ensure that these activities do not interfere with normal traffic flow in Bangkok. That being stated, some roads and facilities near demonstration sites may be temporarily closed due to demonstrations occurring close by so travelers are advised to research their traffic route prior to traveling in certain parts of the city so as to forestall unnecessary delays.
As of the time of this writing, nearly 20 countries have issued travel warnings to their citizens urging them to try to avoid areas where demonstrations may be taking place. In the recent past, demonstrations have led to significant disruptions in Bangkok as parts of the city were, at one time, virtually impenetrable to ingress and egress. However, under the current circumstances it would appear that such a situation will be unlikely to come about in the near future.
Tourism is a substantial aspect of the Thai economy and it is rather impressive to see government officials as well as civil servants making efforts to see to it that tourism is not affected by recent political activities. Moreover, it would appear that demonstrators are making a conscious effort to keep demonstrations peaceful and confine their activities to certain areas.

ASEAN Integration, Chinese Trade, And Thailand’s Possible Bubble

In recent postings throughout the internet, speculation regarding the future of Southeast Asian economics abound. Meanwhile, further analysis of the Thai economy in particular is rife. In a recent article on Forbes’ official website evidence has been cited which would appear to point to the possibility that Thailand may experience an economic bubble burst akin to the crash of 1997. Various Thai government officials as well as Thai businesspersons were quoted as saying that certain aspects of the Thai economy are troubling. Notably, inflows of foreign capital specifically targeting the Thai property market as well as signs that Thai people are engaged in what could be described as conspicuous consumption are leading some experts to believe that Thailand could be headed for a new economic downturn.
Concurrently, the article went on to note that Thailand, ever susceptible to negative economic consequences arising from nations which maintain significant trade relationships with the Kingdom, may see problems in export sectors resulting from decreased demand in both China and the other nations which comprise the Association of Southeast Asian Nations (ASEAN). Should there be an economic problem in one of these countries then there could be a sort of negative ripple effect in the export sector in Thailand.
The points made in the article are compelling and certainly there may be cause for concern that the Thai economy may be placed in a difficult position in the future, especially if Thailand’s main export markets experience an economic downturn. However, the situation may not be as dire as some are predicting. Instead, this blogger would argue that Thailand’s economy may be simply in something of a state of flux due to changes in the ASEAN region and China. The dynamics of global economics are changing. American monetary policy along with economic problems in Europe have caused many to look toward Asia as a beacon of possible future growth.
In a recent article on the official website of Bloomberg it was noted that there appears to be a “boom” of sorts occurring in the Eastern province of Rayong and the region of Northeast Thailand known as Isan. As automobile manufacturing has increased in Rayong, so too has the purchasing power of residents of that province. Meanwhile, Isan is experiencing an upsurge economically as a result of increased domestic income and also concomitant demand for consumer goods from the local population. All of this news comes closely upon the heels of announcements that Thailand, Laos, and China will one day be connected via a high speed rail system. In fact, China has recently noted their commitment to that project and Thai officials have asked China to assist in the design of a rail system between Bangkok and Udon Thani (a city of 400,000 which sits close to the border and capital of Laos). There is an argument that should this rail system go into place the resulting economic boon to Thailand, particularly Northeast Thailand, could be tremendous as there could be a substantial increase in trade and tourism from China via this rail link. Moreover, Thailand could see itself becoming the entrepot for trade between South China and the rest of the ASEAN jurisdictions.
Presently, it is difficult to say whether Thailand will continue a trend of uninterrupted prosperity. However, there is strong evidence to suggest that increased economic integration with ASEAN as well as new, less logistically difficult, trade opportunities with China could usher in an era of prosperity and counter some of the negative factors currently worrying experts analyzing the current state of the Thai economy.

Thai-Chinese Relations Improving Within The ASEAN Framework

At a recent summit held to discuss relations between China and the Association of Southeast Asian Nations (ASEAN) the Prime Minister of Thailand stressed the importance of the ASEAN-China Strategic Partnership as a component necessary to bolster mutual prosperity in both China and the ASEAN region. Thai Prime Minister Yingluck Shinawatra noted that ASEAN approved of China’s efforts to improve the ASEAN-China Free Trade Area. Upgrading the free trade area would likely result in an increase in Sino-ASEAN trade.
Based upon information announced by the ASEAN Secretariat, in the year 2014 ASEAN appears poised to focus on quickly implementing targets for 2015. It also appears that ASEAN will be working towards unifying the community pillars of ASEAN, notably the ASEAN Economic Community (AEC), the ASEAN Socio-Cultural Community, as well as the ASEAN Political-Security Community. Post-2015, ASEAN may undertake initiatives to reinforce these efforts while also attempting to further engage other outside actors in the Asia Pacific and East Asia regions.
A recent joint statement from the visiting Chinese Premier and the Thai Prime Minister also noted that efforts are being made to improve relations between the Kingdom of Thailand and the Peoples’ Republic of China. The two leaders expressed their desire to see closer cooperation between their two nations in the form of investment in industry (with specific emphasis upon investment in the bio-plastics, green, and rubber industries).
Thailand and China renewed their commitment to promoting improved transportation infrastructure in the form of railway links between Thailand, Laos, and China. The two countries also discussed improved transportation channels in the form of roads, airports, and ports which could increase trade and tourism for both Thailand specifically and the region as a whole. The Chinese representatives reiterated their desire to assist in the building of a high speed railway system between Ban Phachi and Nong Khai, noting that payment for such endeavors may come, at least in part, in the form of agricultural goods.
The two countries also wish to strengthen cooperative efforts in the banking and financial spheres by promoting the use of the two nations’ currencies in matters involving Sino-Thai trade and investment. It also appears that the two countries are poised to discuss methods of improving RMB clearing services in matters pertaining to trade.
Most notably, at least for this blogger, was the announcement that China as well as Thailand are amenable to discussing, and possibly signing, a Memorandum of Understanding on exemption of visas. Apparently, a prospective Sino-Thai visa exemption scheme would allow holders of regular Thai and Chinese passports to enter each of these countries on a visa exemption stamp not unlike the current visa exemption stamps currently issued to travelers from many countries entering Thailand. The promulgation of a visa exemption scheme between China and Thailand could lead to increases in trade and tourism between the two nations.

Affidavit of Support: Issues Involving Federal Poverty Guidelines

A frequently asked question from those wishing to sponsor a foreign fiance or spouse for a US Fiance Visa or US Marriage Visa is: do I make enough income to act as a sponsor for my loved one? The answer to this question involves the affidavit of support which is a primary component of the visa application process. When a fiance or spouse visa application is adjudicated by a Consular Officer at a US Embassy or US Consulate overseas part of the application includes either and I-134 or I-864 affidavit of support. This document allows the adjudicating Consular officer to make a determination as to whether or not the US Citizen spouse or fiance has the income necessary to support their fiance or spouse in the United States. This affidavit also acts as a sort of third party beneficiary contract between the American spouse and the United States government in order to make certain that the American spouse pays the US government for any means tested benefits that the foreign spouse may acquire while in the USA.
When determining whether or not an American spouse or fiance can support a foreign spouse or fiance the adjudicating officer will first look to the American’s adjusted annual income on his or her income tax return. In order to meet the minimum eligibility requirements the American spouse or fiance must earn 125% of the federal poverty guidelines for a family of their size. The current federal poverty guidelines for the 48 contiguous States as well as Alaska and Hawaii can be found below (as quoted from the official website of Housing and Human Services):

Those wishing to ascertain whether they are eligible to sponsor their foreign fiance or spouse should use the above figures to determine 125% of the poverty guidelines for a family of their size (including the foreign family member(s)). It should be noted that active duty members of the United States Armed Forces must only meet 100% of the federal poverty guidelines in order to be eligible to sponsor a foreign fiance or spouse. Those unable to meet the 125% income level noted above may be able to use assets to offset the difference between their level of income and the 125% requirement. For affidavit of support purposes, a prospective sponsor of a Thai fiancee or wife can make up the difference in income between what is actually earned and what is legally required by providing evidence of assets which equal 5 times the difference between what a prospective sponsor earns and the level required by law. Thus, if a prospective sponsor fall short of the 125% level by 5,000 USD, then the prospective sponsor can show proof of assets in the amount of 25,000 USD in order to overcome the disparity.
It may also be possible to use the income and assets of a joint sponsor if the person petitioning for the foreign national’s visa is unable to overcome the income and asset requirements. It should be noted that only the I-864 affidavit of support (that used in cases involving the application for a CR-1 visa or an IR-1 visa) may utilize a joint sponsor. Those seeking a K-1 visa are not eligible to use a joint sponsor, therefore, only the American Citizen fiance’s income and assets will be adjudicated during the K1 visa application process. In the past, Consular Officers at the US Embassy in Bangkok were known to accept joint sponsors in K-1 visa application adjudications. However, as of the time of this writing that practice has ceased.

Chinese Premier Visits Thailand And Information Regarding Railway Links

China’s Premier, Li Keqiang is set to make an official trip to Thailand between the 11th and 13th of this month. The Premier will be present in the Kingdom of Thailand as a guest of the Royal Thai Government. This visit will be the first time the Premier of China has visited Thailand since taking up office. During his stay the Premier is slated to meet with Prime Minister Yingluck Shinawatra in an effort to seek methods of improving the Thailand-China Comprehensive Strategic Cooperative Partnership through mutually beneficial cooperative endeavors.
Apparently, the official representatives of the Peoples’ Republic of China and the Kingdom of Thailand are also poised to sign various agreements exclusively pertaining to the Sino-Thai relationship. These agreements will deal with matters such as investment between the two nations, development of infrastructure, technology, education, and energy to name just a few areas which will be covered. As of the time of this writing, Thailand is the coordinator for relations between the Peoples’ Republic of China and the Association of Southeast Asian Nations (ASEAN) and in that capacity it appears likely that the Thai PM and the Chinese Premier will discuss matters relating to the ASEAN-China Strategic Partnership.
Meanwhile, in related news Transport Minister Chadchart Sittipunt has recently made comments regarding the linkage of the Kingdom of Thailand, Laos, and China via high speed rail systems as well as other transportation initiatives under the aegis of the Thailand 2020 program. It would appear that plans are being implemented to construct a high speed railroad linking Bangkok to Nong Khai, the Northeastern Thai province bordering Viantiane, Laos. Construction of such a railway is expected to begin in the latter half of 2014. Upon completion of the project travelers will be able to make the trip between Bangkok and Nong Khai in approximately 3 hours. The system will then link up with Yunnan, China via Laos. Furthermore, enhanced roadworks are expected to be constructed, including new four-lane roadways, in order to streamline transportation both within Thailand as well as in Laos and China.
Clearly, these efforts are likely to fundamentally change the landscape of Northern Thailand both physically and economically. The linking of Northern Thailand, Laos, and Southern China will have a significant impact upon the economies of all three jurisdictions while simultaneously changing the way in which business is currently being conducted in this region. These developments are occurring as the ASEAN countries prepare for the coming integration of the ASEAN Economic Community (AEC) and it stands to reason that further cooperation between Thailand and China bilaterally and China and ASEAN multilaterally will see economic benefits not only for Thailand, but for the other ASEAN jurisdictions as well.
