			<content:encoded><![CDATA[<p>This posting discusses the issues associated with retaining an American attorney to assist with the <a title="K-1 visa process" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html">K-1 visa process</a>. Those thinking about retaining assistance in the K-1 visa process are well advised to conduct thorough research prior to making any irrevocable decisions.</p>
<p>The K-1 visa is a non-immigrant <a title="US fiance visa" href="http://www.integrity-legal.com/us-visa/k1-visa-singapore.html">US fiance visa</a> which was intended to be used solely by the foreign fiances of American Citizens. The K-1 visa allows the foreign fiancee of an American Citizen to enter the United States for a period of 90 days of the purpose of marriage. Those who do not marry their American fiance after 90 days in the USA will be required to depart from the USA. Readers should bear in mind that the entrant to the United States on a <a title="K-1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-hong-kong.html">K-1 visa</a> who marries their loved one must undergo the <a title="adjustment of status" href="http://www.integrity-legal.com/us-visa/adjustment-status.html">adjustment of status</a> process in order to gain <a title="lawful permanent residence" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html">lawful permanent residence</a> in the U.S.A.</p>
<p>The purpose of this article is to provide insight to Americans about the perils of dealing with non-licensed individuals who purport to be qualified to practice United States Immigration law (or any American law, for that matter) . Pursuant to 8 CFR 292.1 only a qualified <a title="lawyer" href="http://www.integrity-legal.com/bangkok-lawyer.html">lawyer</a> licensed to practice law in at least one U.S. State or Federal jurisdiction is entitled to engage in the receiving of client fees in connection with the practice of United States immigration law. Therefore, those not so qualified must either fit within a narrow exception to the aforementioned rule lest their behavior be deemed to be illegal. It should be noted that attorney-client confidentiality is a significant issue which should be considered when ascertaining the credentials of those claiming qualification in United States immigration matters abroad as there are many so-called “<a title="visa agents" href="http://integrity-legal.com/legal-blog/us-visa-immigration/new-york-state-takes-tough-stand-against-visa-agencies/">visa agents</a>” or “<a title="immigration consultants" href="http://integrity-legal.com/legal-blog/us-visa-immigration/american-immigration-lawyers-association-aila-launches-website-to-help-fight-fraudulent-us-immigration-consultants/">immigration consultants</a>” claiming qualification to provide services in connection with U.S. immigration. Attorney-client privilege is not extended to those not qualified as an <a title="American attorney" href="http://www.integrity-legal.com/licensed-lawyers.html">American attorney</a> and therefore discussions with unqualified individuals are likely not privileged communications. Meanwhile, some individuals brazenly, albeit falsely, portray themselves as American attorneys when, in fact, this is simply not the case.</p>
<p>For all of the reasons outlined above it should be noted that only a competent licensed attorney from the United States should be retained to assist prospective clients. 			<content:encoded><![CDATA[<p>Routinely, the administration of this blog posts the estimated processing times of the United States Citizenship and Immigration Service (<a title="USCIS" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-service-center-estimated-processing-times-as-of-september-2010/" target="_blank">USCIS</a>) Centers in an effort to provide clarity and information to those interested in the US Immigration process. It should be noted that for visa petitioners seeking a <a title="K-1 visa" href="http://www.integrity-legal.com/us-visa/k1-visa-singapore.html" target="_blank">K-1 visa</a> or an Immigrant visa such as a <a title="CR-1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-hong-kong.html" target="_blank">CR-1 visa</a>, these estimated processing times do not take into account the need to process many visa applications through the <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/k3-visa-china-administrative-closure-and-us-immigration-for-chinese-spouses/" target="_blank">National Visa Center</a> (NVC) and possibly a <a title="US Embassy" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html" target="_blank">US Embassy</a> or <a title="US Consulate" href="http://integrity-legal.com/legal-blog/us-visa-immigration/immigrant-visa-processing-changes-at-the-us-embassy-in-manila-philippines/" target="_blank">US Consulate</a> abroad. Although the term &#8220;K-3 visa&#8221; has become a common buzzword used as a colloquial synonym for <a title="US Marriage Visa" href="http://www.integrity-legal.com/marriage-in-thailand.html" target="_blank">US Marriage Visa</a> on the World Wide Web, the K-3 category was not always the widely utilized travel document for Indian-American couples reuniting in the United States as the Immigrant visa categories often referred to as CR-1 and/or IR-1 visas were once the only travel documents available to the spouses of American Citizens wishing to take up residence in the USA (note: the IR-1 visa category predates the CR-1 visa category as conditional lawful permanent residence status has not always been imposed upon foreign spouses of US Citizens married less than 2 years).</p>
<p>There was a rather significant backlog of Immigrant visa petitions at the agency now commonly referred to as the United States Citizenship and Immigration Service (USCIS) when the <a title="K3 visa" href="http://www.integrity-legal.com/us-visa/visa-denial.html" target="_blank">K3 visa</a> category was created by Congressional legislation sometimes called the &#8220;Life Act&#8221; which was signed and executed by President William Jefferson Clinton prior to leaving office toward the end of his term (the K-4 visa, similar to the K2 derivative visa attached to the <a title="K1 visa" href="http://www.integrity-legal.com/us-visa/k1-visa-thailand.html" target="_blank">K1 visa</a>, was a derivative visa category also created by the &#8220;Life Act&#8221; to be utilized by the children of an Indian K-3 spouse).</p>
<p>Currently, the United States Citizenship and Immigration Service does not have the backlog that it once had of Immigrant spousal visa petitions. As a result, the K-3&#8242;s utility has been increasingly marginalized as the estimated <a title="processing time" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-processing-times-california-service-center-nebraska-service-center-vermont-service-center-texas-service-center/" target="_blank">processing time</a> for <a title="CR-1 visa" href="http://www.integrity-legal.com/us-visa/immigrant-visa-process.html" target="_blank">CR-1 visa</a> petitions and <a title="IR-1 visa" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html" target="_blank">IR-1 visa</a> petitions has decreased. Relatively recently, the American State Department&#8217;s <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/us-visa-process-uscis-service-center-estimated-processing-times/" target="_blank">National Visa Center</a> (NVC) promulgated the policy that K-3 visa applications would be administratively closed if and/or when the adjudicated immigrant visa petition arrives at NVC before or with the supplemental K-3 visa petition. This policy has likely lead to some Indian-American married couples to seek Immigrant visa benefits rather than K-3 visa benefits as &#8220;administrative closure&#8221; precluded further processing of the K-3 visa petition and application.</p>

			<content:encoded><![CDATA[<p>A common question on the lips of many American Citizens with a Burmese husband or wife is: &#8220;Can I get my Burmese husband (or wife) a US K3 marriage visa?&#8221; In the past, this question would likely have received an unqualified: yes. However, recent changes to the K3 visa process have resulted in the effective end of broad K-3 marriage visa issuance due to the American State Department&#8217;s National Visa Center and their policy of &#8220;administrative closure&#8221; for many <a title="K3 visa" href="http://www.integrity-legal.com/us-visa/visa-denial.html" target="_blank">K3 visa</a> applications.</p>
<p>To understand the <a title="K3 visa process" href="http://www.integrity-legal.com/us-visa/k3-visa-process.html" target="_blank">K3 visa process</a> one must first understand why the K3 visa was invented. It was designed to act as a sort of expedited travel document for spouses of American Citizens at a time when the backlog for adjudication of classic Immigrant spouse visa petitions at the <a title="United States Citizenship and Immigration Service" href="http://integrity-legal.com/legal-blog/us-visa-immigration/k3-visa-indonesia-how-does-administrative-closure-impact-the-k3-visa-process/" target="_blank">United States Citizenship and Immigration Service</a> (USCIS) was running quite high. In fact, there was a time when bi-national Burmese-American couples could wait as long as 3 years just to see their I-130 petition adjudicated (this does not take into account <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/k3-visa-vietnam-how-administrative-closure-can-impact-a-k3-visa-application/" target="_blank">National Visa Center</a> processing and Consular Processing of pending visa applications). Due to the aforementioned backlog, Congress and the US President enacted the so-called &#8220;Life Act&#8221; which, among other things, created the K-3 visa category. The K3 visa petition sort of &#8220;piggybacks&#8221; onto an underlying spouse visa petition and can only be filed after an initial Immigrant visa petition is filed.</p>
<p>In 2010, the National Visa Center announced that they would &#8220;administratively close&#8221; K3 visa applications when the underlying Immigrant visa petition arrived before, or at the same time as, the K-3 petition. It would seem that this policy is based upon the premise that the K-3&#8242;s utility is negated when USCIS has already adjudicated the Immigrant visa petition. Bearing this in mind, it should be noted that the Immigrant spouse visas (also known as the <a title="CR1 Visa" href="http://www.integrity-legal.com/us-visa/immigrant-visa-process.html" target="_blank">CR1 Visa</a> or the <a title="IR1 Visa" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html" target="_blank">IR1 Visa</a>, depending upon the circumstances of the couple seeking the visa benefits) confer Lawful Permanent Residence upon the visa holder when admitted to the USA at a port of entry. A K3 visa holder is admitted as a non-immigrant, but the entrant retains the option of either <a title="adjusting status" href="http://www.integrity-legal.com/us-visa/adjustment-status.html" target="_blank">adjusting status</a> in the USA or applying for their immigrant visa at a <a title="US Embassy" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html" target="_blank">US Embassy</a> or <a title="US Consulate" href="http://integrity-legal.com/legal-blog/us-visa-immigration/the-diversity-visa-lottery-program-in-2010/" target="_blank">US Consulate</a> abroad. In any case, the K-3 visa, although slightly faster from an initial processing standpoint, does not grant superior benefits to the foreign spouse upon entry compared to the Immigrant visa categories. Therefore, those currently researching American spousal immigration are wise to delve into information regarding the CR1 or IR1 visas.</p>

			<content:encoded><![CDATA[<p>Those with pending visa petitions and applications may have only had a passing experience dealing with the National Visa Center. For example, the <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-estimated-service-center-processing-times-k1-cr1-ir1-k3-l1-e1-e2-k4-k2-ir2/" target="_blank">National Visa Center</a> plays a rather small role in the <a title="K1 visa" href="http://www.integrity-legal.com" target="_blank">K1 visa</a> process. Meanwhile those seeking a <a title="CR1 Visa" href="http://www.integrity-legal.com/us-visa/immigrant-visa-process.html" target="_blank">CR1 Visa</a> or an <a title="IR1 Visa" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html" target="_blank">IR1 Visa</a> have probably had extensive dealings with the National Visa Center (NVC). In recent weeks, the NVC changed some of their processing policies for certain US Marriage Visas. Therefore, many of those seeking <a title="K3 Visa" href="http://www.integrity-legal.com/us-visa/k3-visa-process.html" target="_blank">K3 Visa</a> benefits have seen their application &#8220;<a title="administratively closed" href="http://integrity-legal.com/legal-blog/us-visa-immigration/k3-visa-thailand-administrative-closure-leads-to-less-forum-shopping/" target="_blank">administratively closed</a>&#8221; by the NVC where the underlying I-130 arrived prior to, or contemporaneously with, the I-129f petition. In a recent announcement from the American State Department it was announced that NVC has begun a pilot program that many hope will eventually lead to simplification of the NVC document compilation process. To quote directly from the State Department&#8217;s announcement, as distributed through AILA:</p>
<blockquote><p><strong><em>The Immigrant Visa Electronic Processing Program is a pilot project which uses electronic communication and documentation methods to simplify and accelerate the immigrant visa application process. This program uses e-mail for communication and submission of all forms and documents to the NVC using the Portable Document Format (PDF). Under the Electronic Processing Program all forms will be downloaded, completed, signed (if required), scanned, saved as PDF files, and e-mailed to the NVC. Required civil documents and supporting documents must be converted to PDF files by scanning and e-mailed to the NVC. After the NVC has completed processing the applicant&#8217;s petition, the applicant will need to present the original physical documents to the US Embassy/Consulate at the time of the applicant&#8217;s visa interview. Failure to do so may cause a delay or denial of the visa being sought.</em></strong></p></blockquote>
<p>It is this author&#8217;s opinion that this policy change will have a tremendous impact upon the US visa process and will likely lead to faster visa processing in general. It will be interesting to see how this new program will impact US <a title="Consular Processing" href="http://www.integrity-legal.com/us-visa/us-consular-services.html" target="_blank">Consular Processing</a> abroad. As noted in the announcement, original documentation will not be required by the NVC in some cases. Those who did not remit original documentation to the NVC may need to do so at the visa interview which usually occurs at a <a title="US Embassy" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html" target="_blank">US Embassy</a> or <a title="US Consulate" href="http://integrity-legal.com/legal-blog/k1-visa/holiday-closing-schedule-for-the-us-embassy-fiji-kiribati-nauru-tonga-tuvalu/" target="_blank">US Consulate</a> with appropriate jurisdiction. Those who fail to remit such documentation may be subjected to a <a title="221g" href="http://www.integrity-legal.com/us-visa/visa-denial.html" target="_blank">221g</a> refusal. In some cases, issuance of a 221g can delay a case by weeks, or in a limited number of cases the case could be delayed by months.</p>
<p>That said, those seeking visas to the United States are still well advised to seek the assistance of a competent licensed American attorney from the USA. Regardless of increased processing efficiency, there are many factors which can affect a visa application and competent advice and counsel can forestall unforeseen problems.</p>

			<content:encoded><![CDATA[<p>The United States Citizenship and Immigration Service (<a title="USCIS" href="http://integrity-legal.com/legal-blog/us-visa-immigration/required-vaccinations-for-those-seeking-immigrant-visas-to-the-united-states/" target="_blank">USCIS</a>) is tasked with adjudicating Immigration applications such as the I-129f, I-130, and the <a title="I-601 waiver" href="http://integrity-legal.com/legal-blog/us-visa-immigration/department-of-homeland-security-suspends-removals-to-haiti/" target="_blank">I-601 waiver</a>. They have offices throughout the United States and around the world. In Bangkok, the USCIS office is the administrative hub for virtually all US Immigration matters arising in Southeastern Asia.</p>
<p>This author recently came across a press release from the United States Citizenship and Immigration Service (USCIS) in which Director Alejandro Mayorkas explained that USCIS will be undergoing some organizational changes. The author obtained this information through the <a href="http://www.aila.org">American Immigration Lawyers Association</a> website. To <a title="quote" href="http://www.aila.org/content/default.aspx?docid=30941" target="_blank">quote</a> directly from the press release:</p>
<p style="text-align: center;"><strong>“We at U.S. Citizenship and Immigration Services have realigned our organizational structure to achieve greater efficiency and to more ably accomplish our mission. The realignment reflects the prioritization of certain critical Agency responsibilities. The three most significant changes are:</strong></p>
<p style="text-align: center;"><strong>The creation of a Fraud Detection and National Security Directorate. This change reflects our prioritization of our anti-fraud and national security responsibilities and will bring greater focus to them.</strong></p>
<p style="text-align: center;"><strong>The creation of a new Customer Service Directorate. This change reflects our prioritization of customer service and recognizes the significant efforts that will be needed to ensure that we are at the cutting edge of service modeling.</strong></p>
<p style="text-align: center;"><strong>The division of the existing Domestic Operations Directorate into two separate directorates, Service Center Operations and Field Operations. This change will foster greater innovation and achieve greater efficiency in our delivery of immigration services.&#8221;</strong></p>
<p style="text-align: left;">Fraud prevention is a constant priority for USCIS as the <a title="US Immigration" href="http://www.integrity-legal.com" target="_blank">US Immigration</a> system is, at times, plagued by sham marriages, fraudulent petitions, and <a title="unlicensed operators" href="http://integrity-legal.com/legal-blog/us-visa-immigration/immigration-consultant-gets-41-months-in-united-states-prison/" target="_blank">unlicensed operators</a> claiming to be immigration attorneys. Further, the internal bifurcation of Service Center Operations and Field Operations will likely lead to greater efficiency in both areas as they require different types of administrative supervision.  In the case of K visas, there are two service centers that handle <a title="K1" href="http://www.integrity-legal.com/us-visa/k1-fiance-visa.html" target="_blank">K1</a> and <a title="K3 visa" href="http://www.integrity-legal.com/us-visa/k3-marriage-visa.html" target="_blank">K3 visa</a> petitions. Meanwhile, applications for <a title="Immigrant visas" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html" target="_blank">Immigrant visas</a> are received at the USCIS lockbox.</p>
<p style="text-align: left;">Finally, the creation of a Customer Service Directorate will be a boon to <a title="Immigration attorneys" href="http://www.integrity-legal.com/us-visa/inadmissibility-waiver.html" target="_blank">Immigration attorneys</a> and laymen alike as the confusing aspects of the Immigration process can be clarified by contacting a USCIS Customer Service Representation. This author is happy to see that USCIS is taking the time to internally reorganize in an effort to provide better service to both United States Citizens as well as foreign nationals.</p>

<p>The New Year has dawned and the <a title="K1 visa" href="http://integrity-legal.com/legal-blog/us-visa-immigration/comprehensive-immigration-reform-and-family-immigration/" target="_blank">K1 visa</a> still remains the most popular method employed by American Citizens when they wish to be reunited with their Thai fiance or fiancee in the USA. At the present time, the United States Citizenship and Immigration Service (USCIS) is estimating that the K1 visa processing time will be approximately 5 months. This estimate measures petition processing time from filing until final USCIS adjudication. For Thai fiancees seeking a K1 visa from the <a title="US Embassy in Bangkok" href="http://www.integrity-legal.com/us-visa/us-consular-services.html" target="_blank">US Embassy in Bangkok</a> this estimate does not take into account the processing time at the <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/embassy-fees-may-be-raised-for-non-immigrant-visas-k1-and-k3-as-well/" target="_blank">National Visa Center</a> (NVC) nor the processing time for a <a title="K1 visa application" href="http://www.integrity-legal.com/us-visa/k1-visa-thailand.html" target="_blank">K1 visa application</a> at the US Embassy.</p>
<p>Generally, NVC takes approximately 14 days to process a visa petition, conduct a security clearance, and forward the file to the US Embassy. At present, it has been this author&#8217;s opinion, based upon prior experience, that this is usually the amount of time that it takes for the NVC to process the case file.</p>
<p>Once the file arrives at the US Embassy in Bangkok the officers will send a notice to the applicant and/or the attorney of record informing those concerned that they can now begin compiling the visa application. Generally, it takes approximately 2 weeks to compile the necessary documentation to send to the Embassy so that the Embassy staff can schedule the <a title="visa interview" href="http://integrity-legal.com/legal-blog/us-visa-immigration/visa-interview-at-the-us-embassy-in-thailand-attorneys-role/" target="_blank">visa interview</a>. In 2009, the Embassy began notifying applicants of appointment scheduling via email. This greatly streamlined the process and cut days, or, in some cases, weeks off of the final phases of the <a title="K1 visa process" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html" target="_blank">K1 visa process</a>.</p>
<p>In those instances where a K1 visa applicant received a <a title="221g" href="http://www.integrity-legal.com/us-visa/visa-denial.html" target="_blank">221g</a> refusal and request for further documentation, the Consular Officers generally processed the application efficiently and diligently once the applicant (or their attorney of record) presented the requested follow up documentation. It seems unlikely that this diligence and efficiency will subside in 2010.</p>
<p style="text-align: center;"><strong>The K1 visa process in 2010</strong></p>
<p style="text-align: left;">At the time of this writing, it would appear that the K1 visa process will not be significantly changed in the near future and cases will continue to process through the system as before. However, with Comprehensive Immigration Reform on the horizon, there is good reason to believe that eventually the K1 visa process may change as a result of Congressional revision of the Immigration and Nationality Act (INA). How these revisions will effect the K1 visa process remains to be seen. With all of this in mind, this author believes that the year 2010 should be a dynamic year for United States Immigration.</p>
