<p>It recently came to this blogger’s attention that the Center for Disease Control and the United States Department of State are likely to begin imposing more stringent regulations upon visa applicants, especially immigrant visa applicants, seeking a travel document for lawful admission to the United States of America. According to research conducted by the administration of this blog as well as credible anecdotal evidence it would appear that those with tuberculosis or those who have previously had tuberculosis are likely to be required to undergo intense screening in order to ascertain whether the applicant has fully recovered from the disease and poses no threat of future contagion.</p>
<p>In the past, tuberculosis has been a significant issue for those within the consular jurisdiction of the <a title="US Embassy Thailand" href="http://integrity-legal.com/legal-blog/us-embassy-bangkok/credit-where-credit-is-due-regarding-the-us-embassy-in-bangkok/" target="_blank">US Embassy Thailand</a> as the applicants applying for visas at the <a title="US Embassy in Bangkok" href="http://www.integrity-legal.com/us-visa/k3-visa-process.html" target="_blank">US Embassy in Bangkok</a> and the <a title="US Consulate Chiang Mai" href="http://integrity-legal.com/legal-blog/us-visa-immigration/department-of-state-discusses-fee-increases-for-consular-services/" target="_blank">US Consulate Chiang Mai</a> are sometimes found to either have tuberculosis or to have had it previously. The major issue associated with Consular Processing is timing. Even for those who no longer have TB, it could take a matter of weeks or even months to undergo testing necessary to prove that the disease has been treated to such a degree that contagion is no longer an issue.</p>
<p>Meanwhile, there are likely to be rule changes regarding X-rays as well. For example, in the past it was possible to have the required chest X-ray waived for pregnant women. It has come to this blogger’s attention that such waivers are unlikely to continue to be granted. Therefore, those pregnant spouses and fiancees of American Citizens or Lawful Permanent Residents seeking visas such as the <a title="K-1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-hong-kong.html" target="_blank">K-1 visa</a>, the <a title="K-3 visa" href="http://www.integrity-legal.com/us-visa/k3-marriage-visa.html" target="_blank">K-3 visa</a>, the <a title="CR-1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-south-korea.html" target="_blank">CR-1 visa</a>, or the <a title="IR-1 visa" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html" target="_blank">IR-1 visa</a> are likely to be required to either undergo an X-ray while using a lead screen to shield the fetus or await the birth of the child and then see that the mother undergoes an X-ray post-pregnancy. As to children, it would appear as though child seekers of visas such as the <a title="K-2 visa" href="http://integrity-legal.com/legal-blog/us-visa-immigration/the-k-2-visa-age-out-issue-still-being-clarified-by-us-courts/" target="_blank">K-2 visa</a>, K-4 visa, or the IR-2 visa may be required to have skin tests to check for illnesses. It may also prove necessary for children to be X-rayed in connection with diseases such as tuberculosis.</p>
<p>Notwithstanding upcoming changes some recent changes to the rules regarding disease and admission to the United States have resulted in more lax requirements for visa applicants. For example, only relatively recently have visa applicants seen the restrictions imposed on those with HIV lifted. Bearing this in mind, the reader should note that the removal of the imposition of inadmissibility upon HIV infected immigrants does not mean that it is necessarily easy to gain admission to the United States for those with HIV as such visa applications are generally subjected to intense scrutiny to ascertain whether the intending immigrant has adequate medical coverage for the duration of their lawful status in the United States. In the past, those infected with HIV needed an I-601 waiver in order to overcome the legal grounds of inadmissibility. As HIV infection is no longer a legal grounds of inadmissibility an <a title="I-601 waiver" href="http://integrity-legal.com/legal-blog/i-601-waiver/i-601-waivers-why-do-it-yourself-diy-may-not-be-the-best-approach/" target="_blank">I-601 waiver</a> is no longer required under such circumstances.</p>

			<content:encoded><![CDATA[<p>It recently came to this blogger&#8217;s attention that the United States Citizenship and Immigration Service (<a title="USCIS" href="http://integrity-legal.com/legal-blog/us-visa-immigration/how-would-a-government-shutdown-impact-the-us-immigration-process/" target="_blank">USCIS</a>) may be changing some of the procedures associated with the processing of immigration petitions pertaining to the application for issuance of the <a title="CR-1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-south-korea.html" target="_blank">CR-1 visa</a>, <a title="IR-1 visa" href="http://www.integrity-legal.com/us-visa/immigrant-visa-process.html" target="_blank">IR-1 visa</a>, <a title="K-1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-hong-kong.html" target="_blank">K-1 visa</a>, and <a title="K-3 visa" href="http://www.integrity-legal.com/us-visa/k3-visa-process.html" target="_blank">K-3 visa</a> filed by United States Citizens and Lawful Permanent Residents. To <a title="quote directly" href="http://www.google.com/url?sa=t&amp;source=web&amp;cd=1&amp;ved=0CBcQFjAA&amp;url=http%3A%2F%2Fwww.ilw.com%2Fimmigrationdaily%2Fnews%2F2011%2C0324-walsh.pdf&amp;rct=j&amp;q=USCIS%20Interim%20Memo%20on%20Adjudication%20of%20Adam%20Walsh%20Act%20Related%20Petitions&amp;ei=ch-MTfrUCsPXrQf3jfHYDQ&amp;usg=AFQjCNHJy38odjHjnqjTjFFvVJxHx7fbrw&amp;cad=rja" target="_blank">quote directly</a> from a recent USCIS Memo posted on <a title="ILW.com" href="http://www.ilw.com/" target="_blank">ILW.com</a>:</p>
<blockquote><p><strong><em>This memorandum provides guidance to USCIS service centers regarding changes in the handling of all stand-alone I-130 and I-129F petitions filed by petitioners who have been convicted of any “specified offense against a minor” under the Adam Walsh Child Protection and Safety Act of 2006 (“Adam Walsh Act” or “AWA”) and related issues.1 This memorandum applies only to petitions that are adjudicated at the service centers and not to petitions adjudicated at USCIS field offices.</em></strong></p></blockquote>
<p>Generally I-130 petitions (the categorical designation used to refer to the petition for a CR-1 visa or an IR-1 visa) are processed by the USCIS Service Center designated by the lockbox upon receipt. In some cases, it may be possible to process an I-130 petition at one of the various USCIS field offices located abroad, such as the <a title="USCIS office in Bangkok" href="http://integrity-legal.com/legal-blog/us-visa-immigration/the-ir1-visa-from-thailand-in-2010/" target="_blank">USCIS office in Bangkok</a>. The I-129f petition (categorical designation used to denote the <a title="US fiance visa" href="http://www.integrity-legal.com/us-visa/k1-visa-singapore.html" target="_blank">US fiance visa</a> or <a title="K1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-india.html" target="_blank">K1 visa</a>) can only be processed at a USCIS Service Center in the USA as the field offices overseas do not process such petitions as of the time of this writing. To quote further from the previously mentioned memorandum:</p>
<blockquote><p><strong><em>USCIS will centralize at VSC all files currently at service centers if the service center adjudicator has made a preliminary determination that the petition warrants review as an AWA-related case. The VSC will serve as a central clearinghouse for inquiries from Federal, State, and local agencies regarding AWA-related cases that are pending or were recently adjudicated at one of the four service centers [hereafter referred to as “originating service center” or “sending service center”]. While AWA-related cases require special handling, the decision to centralize AWA-related adjudications at the VSC will affect caseloads at other service centers only minimally.</em></strong></p></blockquote>
<p>Clearly, the <a title="United States Citizenship and Immigration Service" href="http://integrity-legal.com/legal-blog/fiance-visa-thailand/uscis-proposes-an-adjustment-of-immigration-fees-and-costs/" target="_blank">United States Citizenship and Immigration Service</a> (USCIS) is making policy changes in an effort to take steps to more efficiently process cases requiring further scrutiny pursuant to the Adam Walsh Act (AWA). In a way, the Vermont Service Center&#8217;s role in AWA-related cases is somewhat similar to the role of the <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/united-states-8th-circuit-federal-court-upholds-judicial-review-of-i-130-petition-denials/" target="_blank">National Visa Center</a> in the overall US visa process as that agency is tasked with acting as a sort of clearinghouse for visa applications arriving from USCIS and being processed out to a <a title="US Embassy" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html" target="_blank">US Embassy</a> or <a title="US Consulate" href="http://integrity-legal.com/legal-blog/us-embassy-uzbekistan/us-embassy-taskent-uzbekistan-holiday-closing-schedule-2011/" target="_blank">US Consulate</a> abroad. 			<content:encoded><![CDATA[<p>In recent weeks it has come to this blogger&#8217;s attention, via organizations such as the <a title="American Immigration Lawyers Association" href="http://www.aila.org/" target="_blank">American Immigration Lawyers Association</a> (AILA) and through the website of the United States Citizenship and Immigration Service (USCIS), that the USCIS has made decisions which has lead to a delay in processing a relatively significant number of I-130 petitions for Immediate relative immigration benefits. To <a title="quote directly" href="http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextchannel=e7801c2c9be44210VgnVCM100000082ca60aRCRD&amp;vgnextoid=d06835e66570e210VgnVCM100000082ca60aRCRD" target="_blank">quote directly</a> from the official website of the United States Citizenship and Immigration Service (<a title="USCIS" href="http://integrity-legal.com/legal-blog/i-601-waiver/i-601-waivers-why-do-it-yourself-diy-may-not-be-the-best-approach/" target="_blank">USCIS</a>):</p>
<blockquote><p><strong><em>In November 2010, USCIS transferred approximately 36,000 Immediate  Relative petitions from our California Service Center to our Texas  Service Center. We anticipated that this redistribution of work would  result in more timely adjudication of these petitions. Due to a number  of unforeseen circumstances at our Texas Service Center, many of these  cases have not been processed and are beyond our estimated processing  times. We sincerely regret any inconvenience this may have caused you  and we are making every effort to remedy this situation as soon as  possible.</em></strong></p></blockquote>
<p>It is easy to lay blame upon people and organizations. Those reading this piece should note that mistakes occur in life. Businesses, individuals, organizations, and governments do make mistakes and playing the &#8220;blame game&#8221; often yields little in terms of practical solutions. That said, the USCIS is a government entity and should be accountable for their mistakes. Clearly, the USCIS has taken responsibility for this error and has taken measures to rectify the situation. To quote further from the official website of the USCIS:</p>
<blockquote><p><strong><em>On Feb. 7, 2011, we implemented a rapid response plan to  expedite the adjudication of these petitions. We have transferred a  large number of these Immediate Relative petitions back to our  California Service Center to take advantage of resources currently  available to immediately process these cases. Petitioners will see an  action such as an approval, denial or a Request for Evidence (RFE) on  their case from our California or Texas Service Centers by the end of  February. Additionally, we have briefed the Department of State’s  National Visa Center about these cases.</em></strong></p></blockquote>
<p>USCIS&#8217;s efforts to solve this problem should not be overlooked. For those seeking an Immigrant visa for a foreign spouse, the <a title="K-3 visa" href="http://www.integrity-legal.com/us-visa/k3-marriage-visa.html" target="_blank">K-3 visa</a> has been used in the past to obtain an expedited travel document when the United States Citizenship and Immigration Service has a backlog of cases. In recent months, the United States <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-estimated-processing-times-k-1-k-3-cr-1-ir-1-l-1-eb-5-and-advance-parole/" target="_blank">National Visa Center</a>piece  has had an &#8220;administrative closure&#8221; policy regarding those K-3 visa applications that arrive at the NVC with, or after, their I-130 counterparts. There are some who speculate that there might be more K-3 visas issued as a result of the backlog created from the situation note above. At the time of this writing, it remains unclear as to exactly how American Immigration officials will opt to deal with this matter.</p>

			<content:encoded><![CDATA[<p>It recently came to this blogger&#8217;s attention that the <a title="Department of Homeland Security" href="http://integrity-legal.com/legal-blog/i-601-waiver/dhs-secretary-coordinates-with-local-law-enforcement-along-southwestern-border/" target="_blank">Department of Homeland Security</a>&#8216;s United States Citizenship and Immigration Service (<a title="USCIS" href="http://integrity-legal.com/legal-blog/k1-visa-thailand/uscis-website-discusses-licensure-of-american-attorneys-in-immigration-matters/" target="_blank">USCIS</a>) has implemented a program to issue <a title="advance parole" href="http://integrity-legal.com/legal-blog/us-visa-immigration/changes-in-filing-procedure-for-i-131-advance-parole-travel-documents/" target="_blank">advance parole</a> authorization on the same document as that of <a title="employment authorization" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-issues-new-employment-authorization-document-ead/" target="_blank">employment authorization</a>. To quote directly from the official website of the United States Citizenship and Immigration Service (USCIS):</p>
<blockquote><p><strong><em>WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) today  announced that it is now issuing employment and travel authorization on a  single card for certain applicants filing an Application to Register Permanent Residence or Adjust Status,  Form I-485. This new card represents a significant improvement from the  current practice of issuing paper Advance Parole documents.</em></strong></p>
<p><strong><em>The  card looks similar to the current Employment Authorization Document  (EAD) but will include text that reads, “Serves as I-512 Advance  Parole.” A card with this text will serve as both an employment  authorization and Advance Parole document. The new card is also more  secure and more durable than the current paper Advance Parole document.</em></strong></p></blockquote>
<p>For those who are unfamiliar with the <a title="K-1 visa process" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html" target="_blank">K-1 visa process</a>, the <a title="adjustment of status" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-takes-measures-to-ensure-green-cards-are-received/" target="_blank">adjustment of status</a> occurs after a foreign fiancee arrives in America, marries the American petitioner, and files to have their status regularized to that of Lawful Permanent Resident. The card that is given to the foreign spouse is often colloquially referred to as a &#8220;Green Card&#8221;. Prior to adjustment of status, if a foreign fiancee leaves the USA, then they will need to obtain an advance parole travel document in order to keep their visa status alive and thereby permit reentry to the USA. Failure to obtain advance parole could result in a foreign fiancee losing his or her visa upon departure from the USA and thereby compelling them to go through the whole process anew.</p>
<p>An employment authorization document permits foreign fiancees in the United States on a <a title="K-1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-hong-kong.html" target="_blank">K-1 visa</a> to work prior to being approved for Green Card status. In many instances, couples opt not to apply for employment authorization and simply await the foreign fiance&#8217;s adjustment to Lawful Permanent Residence.</p>
<p>Once a foreign fiance is adjusted to lawful permanent residence, he or she may still be required to eventually apply for a <a title="lift of conditions" href="http://integrity-legal.com/legal-blog/us-visa-immigration/determining-conditionality-of-us-lawful-permanent-residence/" target="_blank">lift of conditions</a>. Those in the USA as a lawful permanent resident based upon marriage are placed in conditional status for the first two years of their presence in the USA if the couple was married less than 2 years at the time they acquired lawful permanent residence.</p>
<p>The above analysis could be utilized for <a title="K3 visa" href="http://www.integrity-legal.com/us-visa/us-visa-singapore.html" target="_blank">K3 visa</a> purposes as well. However, as the K-3 visa is currently being issued in very rare instances due to <a title="administrative closure" href="http://integrity-legal.com/legal-blog/us-visa-immigration/k3-visa-india-administrative-closing-and-immigrant-visas-cr-1-ir-1/" target="_blank">administrative closure</a> policies at the National Visa Center, this blogger only mentions this issue as an aside.</p>

			<content:encoded><![CDATA[<p>In a few previous posts of this blog we discussed the current posture of the <a title="K3 visa process" href="http://www.integrity-legal.com/us-visa/k3-marriage-visa.html" target="_blank">K3 visa process</a>. At present, K3 visa processing is becoming increasingly erratic as the National Visa Center will no longer process I-129f petitions for K3 visas if the underlying I-130 application arrives before, or at the same time as, the I-129f. It is a credit to the United States Citizenship and Immigration Service&#8217;s (<a title="USCIS" href="http://integrity-legal.com/legal-blog/us-visa-immigration/court-finds-uscis-overstepped-authority/" target="_blank">USCIS</a>) diligence that they are processing I-129f applications as well as I-130 applications in a quick and efficient manner. However, for those looking for expedited marriage visa benefits this efficiency could end up creating an unwanted situation.</p>
<p>The <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/k3-visa-thailand-does-new-nvc-policy-mark-the-end-of-k3-visas/" target="_blank">National Visa Center</a> has stated that they will &#8220;administratively close&#8221; aforementioned I-129f applications. This could lead to a difficult situation for those couples who specifically got married in a jurisdiction in order to process the foreign spouse&#8217;s visa application in that jurisdiction&#8217;s US Embassy. Under the provisions of the statute creating the <a title="K3 Visa" href="http://www.integrity-legal.com/us-visa/k3-visa-process.html" target="_blank">K3 Visa</a>, the visa must be processed by the Embassy in the country where the marriage took place. This allowed many couples to &#8220;Forum Shop&#8221; for the country where they wished the process their visa. For example, if a couple wished to process a visa application in Italy, they could ensure that the K3 visa application would be processed in Italy simply by getting married in Italy.</p>
<p>Now, because the future of the K3 Visa remains uncertain, there is a distinct possibility that visa interview &#8220;forum shopping&#8221; will become a thing of the past. That being said, Immigrant visa applications for documents such as the <a title="CR1 visa" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html" target="_blank">CR1 visa</a> and the <a title="IR1 visa" href="http://www.integrity-legal.com/us-visa/immigrant-visa-process.html" target="_blank">IR1 visa</a> could be sent to the foreign spouse&#8217;s country of Nationality as Embassies and Consulates only process third country nationals as a courtesy and if inconvenient will send the application to the Post that must process the application.</p>
<p>Hopefully, these recent changes will not result in problems, but it remains to be seen if this will be the case. That being said, so long as the United States Citizenship and Immigration Service continues to process the I-130 in such a quick manner, it remains likely that the National Visa Center will continue closing K3 cases and thereby forestalling the aforementioned practice of forum shopping. For those foreign fiancees in countries such as Burma (Myanmar) or Cambodia this change in policy could cause hardships as both of these countries&#8217; bureaucracies can make it extremely difficult for a native born woman to marry an American man.</p>

			<content:encoded><![CDATA[<p style="text-align: left;">The <a title="K3 Visa" href="http://www.integrity-legal.com/us-visa/k3-visa-process.html" target="_blank">K3 Visa</a> was designed as an expedited alternative to Immigrant Marriage visas such as the <a title="IR1 Visa" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html" target="_blank">IR1 Visa</a> and the <a title="CR1 Visa" href="http://www.integrity-legal.com/us-visa/immigrant-visa-process.html" target="_blank">CR1 Visa</a>. At one time, it could take as long as 3 years to process a marriage visa petition, which is why Congress created the <a title="K-3 visa" href="http://www.integrity-legal.com/us-visa/k3-marriage-visa.html" target="_blank">K-3 visa</a> category. However, in recent years the need for the K-3 visa has been less acute when compared to the past as the current processing times for the aforementioned Immigrant marriage visas is about 11-12 months. When comparing this to the <a title="K3 visa processing time" href="http://integrity-legal.com/legal-blog/tag/k-3-visa-processing-time/" target="_blank">K3 visa processing time</a> one can see that the K-3 visa is becoming less of a necessity.</p>
<p style="text-align: left;">With that in mind, the United States Department of State&#8217;s <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/k1-visas-from-thailand-in-2010/" target="_blank">National Visa Center</a> (NVC) recently made an important announcement with regard to K-3 visas, the following <a title="quote" href="http://www.aila.org/content/default.aspx?docid=31340" target="_blank">quote</a> is from a State Department publication promulgated by the <a title="American Immigration Lawyers Association" href="http://integrity-legal.com/legal-blog/us-visa-immigration/comprehensive-immigration-reform-and-family-immigration/" target="_blank">American Immigration Lawyers Association</a> (AILA):</p>
<p style="text-align: center;"><strong>&#8220;Important Notice: Effective February 1st, 2010, when both the I-129F petition for a nonimmigrant K visa and the I-130 petition for an IR-1 (or CR-1) spouse of a U.S. citizen visa have been approved by USCIS and sent to the National Visa Center (NVC), the availability as well as the need for a nonimmigrant K-3 visa ends. If the NVC receives both petitions:</strong></p>
<p style="text-align: center;"><strong><br />
The nonimmigrant K visa will be administratively closed.<br />
The application process explained below will not be applicable and cannot be used.</strong></p>
<p style="text-align: center;"><strong><br />
The NVC will contact the petitioner and you with instructions for processing your IR-1 (or CR-1) immigrant visa. For more information on the immigrant visa process review the Immigrant Visa for a Spouse webpage. If the NVC does not receive your I-130 petition and I-129F at the same time, the NVC will process your I-129F petition. Then NVC will send the petition to the embassy or consulate in the country where the marriage took place. If your marriage took place in the U.S., the NVC will send the petition to the embassy or consulate that issues visas in your country of nationality. If your marriage took place in a country that does not have an American embassy, or the embassy does not issue visas, the NVC will send your petition to the embassy or consulate that normally processes visas for citizens of that country. For example, if your marriage took place in Iran where the U.S. does not have an embassy your petition would be sent to Turkey.&#8221;</strong></p>
<p style="text-align: left;">There are some who are likely asking themselves: What does this all mean? USCIS adjudicates all visa petitions and, upon approval, forwards them to the National Visa Center (NVC). NVC processes all K3 visa applications before they go to the Consulate or Embassy abroad (for those applications which are to be processed in Thailand, the NVC handles the application prior to receipt by the <a title="US Embassy Bangkok" href="http://www.integrity-legal.com/us-visa/us-consular-services.html" target="_blank">US Embassy Bangkok</a>).</p>
<p style="text-align: left;">In essence, the NVC will no longer process K-3 visa applications if an Immigrant visa application is received by the NVC prior to, or at the same time as, a K3 application. As a practical matter, all K-3 petitions have an Immigrant visa counterpart. It is believed that, most of the time, the NVC receives these applications either in tandem or nearly simultaneously. There may be a few instances where a K-3 application will make it to NVC prior to the Immigrant visa application, but for the most part this is not the case. As a result, it is highly likely that the K-3 visa will no longer be available to those seeking marriage visa benefits because the Immigrant visa application will reach the NVC prior to, or at the same time as, the K-3 application.</p>

Below are the updated processing times for the two USCIS service centers which handle the vast majority of United States family-based visa petitions. The information below was updated by <a title="USCIS" href="http://integrity-legal.com/legal-blog/us-visa-immigration/recently-promulgated-uscis-memos-receiving-criticism/" target="_blank">USCIS</a> on February 17, 2010.</p>
<p>For those who are unfamiliar with the visa process, the I-129f petition is used when filing for <a title="K1 visa" href="http://www.integrity-legal.com/us-visa/k1-visa-thailand.html" target="_blank">K1 visa</a> on behalf of a foreign fiancee. This petition can be used by those seeking <a title="K3 Visa" href="http://www.integrity-legal.com/us-visa/k3-visa-process.html" target="_blank">K3 Visa</a> benefits as well. The I-130 petition is also utilized by those seeking family visa benefits, but the I-130 is used to petition for <a title="Immigrant visa" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html" target="_blank">Immigrant visa</a> benefits.</p>

			<content:encoded><![CDATA[<p>For those who have gone through the United States Immigration process or those who are thinking of doing so, the acronym USCIS will become familiar if it is not already. USCIS stands for the United States Citizenship and Immigration Service. This organization adjudicates many Immigrant visa petitions before they are sent to the the Department of State. In many ways <a title="USCIS" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-reissues-erroneous-advance-parole-travel-documents/" target="_blank">USCIS</a> carries out their duties in an effective and efficient manner. However, there are some situations in which some individuals feel that USCIS oversteps their authority.</p>
<p>In a recent <a title="blog posting" href="http://ailaleadership.blogspot.com/2010/01/what-happens-when-uscis-breaks-law.html" target="_blank">blog posting</a>, the past president of the American Immigration Lawyers Association wrote about the issues surrounding USCIS and dereliction of what some perceive as the proper interpretation of Federal law:</p>
<p style="text-align: center;"><strong>&#8220;[T]wice in the last two months the USCIS has issued &#8220;memos&#8221; that so dramatically change the framework under which these key programs operate, that it has clearly violated the APA [<a title="Administrative Procedure Act" href="http://en.wikipedia.org/wiki/Administrative_Procedure_Act" target="_blank">Administrative Procedure Act</a>].&#8221;</strong></p>
<p style="text-align: left;">The posting went into further detail below:</p>
<p style="text-align: center;"><strong>&#8220;USCIS has taken ignoring Federal Law to a new level with its recent actions. Of course we all know that the USCIS has been illegally changing the rules as they apply to individual cases for the last several years by engaging in &#8220;rulemaking by RFE;&#8221; making ridiculous requests for evidence, not based on any legal requirement, but rather, based upon someone&#8217;s bizarre notion of what they think the law should be, not what it really is. Now, however, with the two newest &#8220;Neufeld Memos&#8221; the USCIS has simply gone too far&#8230;The <a href="http://www.uscis.gov/USCIS/Laws/Memoranda/Static%20Files%20Memoranda/Adjudicating%20of%20EB-5_121109.pdf">Neufeld memo on the EB-5 program</a>, essentially makes that job creation program unworkable, and the <a href="http://www.uscis.gov/USCIS/Laws/Memoranda/2010/H1B%20Employer-Employee%20Memo010810.pdf">Neufeld Memo on the H-1B program</a>, literally changes decades of established policy on the most important visa allowing U.S. companies to hire foreign nationals.&#8221;</strong></p>
<p>With regard to the employment visa issues noted above, the details of the memos in question have yet to be resolved. However, based upon anecdotal evidence from some practitioners, there does appear to be something of a rise in the number of Requests for Evidence (RFE) being promulgated by USCIS. This author can neither confirm nor deny that RFEs are on the rise, but it leads to the issue of <a title="RFE" href="http://integrity-legal.com/legal-blog/us-visa-immigration/what-is-a-request-for-evidence-rfe-from-uscis/" target="_blank">RFE</a> avoidance.
