Those who read this web log with any degree of frequency may have noticed that the administration routinely posts the closing schedules of the various US Missions in Asia in an effort to provide wide access to such information for Americans traveling abroad seeking Consular services. Hopefully, postings such as these will help to forestall fruitless trips to US Posts abroad made by Americans unaware of local holiday observance. Those seeking services such as issuance of a Consular Report of Birth Abroad, US Passport, or additional visa pages for a previously issued US Passport are well advised to contact an American Citizen Services Section of the nearest US Embassy or US Consulate with appropriate jurisdiction.

Those seeking temporary US visas such as the B-2 visa (US Tourist Visa), B-1 visa (US Business Visa), F-1 visa (US Student Visa), or J-1 visa (US Exchange Visitor Visa) are likely to have their visa applications processed through a Non-Immigrant Visa (NIV) Unit abroad. It should be noted that those applying for most non-immigrant visa categories are scrutinized pursuant to section 214(b) of the United States Immigration and Nationality Act.

Those who are seeking US family visa benefits in the form of travel documents such as the CR-1 visa or the IR-1 visa are generally required to process an immigration petition through the United States Citizenship and Immigration Service (USCIS) prior to applying for a US visa abroad. The K-1 visa, although technically a non-immigrant US fiance visa, is generally treated much the same way as an immigrant visa for application processing purposes. L-1 visa seekers and EB-5 visa seekers should take notice of the fact that applying for such a travel document may entail the processing of an immigration petition prior to visa application at a US Post abroad.

Those interested in conducting business in the region of Southeast Asia may be interested to note that the country of Laos (officially referred to as the Lao Peoples’ Democratic Republic) has recently announced the opening of a stock exchange. To quote directly from a recent article on the website of the BBC:

The Lao Securities Exchange opened for business on Tuesday with trading in just two companies.

The country, sandwiched between Vietnam and Thailand, is one of the world’s poorest nations.

It is hoped that the stock exchange will help raise $8bn (£5.1bn) in equity and bond sales to fund investment in the country.

The Laos exchange is initially offering shares in two state-owned companies, Electricite du Laos Generation company and Banque Pour Le Commerce Exterieur Lao.

The volume of the first day’s trading was thin, about 2.14bn kip ($265,000; £170,000).

Although the exchange itself is small in comparison to that of the United States, the United Kingdom, or even the Kingdom of Thailand it is likely that this move will lead to further business opportunities for foreign investors looking to conduct business in Laos. Hopefully, this announcement will also usher in an era in which Laos plays a more dynamic role in the region. As a landlocked country with a relatively small population and few capital resources it can be inferred that Laos’ best hope for creating jobs and improving the overall economic situation in the country will come through the accrual of foreign capital in the form investment and subsequent usage of that capital in ways that will be both constructive and profitable.

Laos is a member of the Association of Southeast Asian Nations (ASEAN). In recent months members states of ASEAN have seen a great deal of change in the economic realm as the United States dollar has weakened due, at least in part, to “quantitative easing” measures promulgated by the Federal Reserve. Meanwhile, the Chinese Yuan has been getting stronger as the Chinese economy continues to show strong growth. These factors, along with others, have resulted a great deal of uncertainty about the future complexion of business in Southeast Asia.

It should also be noted that Chinese News Services have recently reported that Bangkok will be home to a new $1.5 billion Chinese trade complex. This news comes on the heels of the announcement that China, Laos, and Thailand will eventually be connected via high-speed rail link. Hopefully, all of these factors, in conjunction with the additional capital generated by the Lao exchange, will coalesce into a highly favorable business climate for China, Thailand, Laos, and all of the other member nations of the ASEAN community.

Southeast Asia is a beautiful and  often visited part of the world. One of the lesser known, but highly enjoyable, destinations in Southeast Asia is the country of Laos. This small landlocked country north of the Kingdom of Thailand, the Kingdom of Cambodia, and South of the Peoples’ Republic of China has been a destination of choice for those seeking the adventure and natural beauty of tropical Asia. Some Americans who travel to Laos meet a special someone whom they wish to bring back to America. For these people, the first thing that comes to mind is: “Will my girlfriend (or boyfriend) need a US Visa?” In most cases, a visa will be necessary as the United states does not allow Laotians to come to America on the US Visa Waiver Program. Therefore, the next question for many is: “Can I get my Lao girlfriend (or boyfriend) a US Tourist Visa?” In most cases, the answer to this question is: no, but a deeper understanding of relevant immigration law may provide insight into the reason for possible denial.

Relatively few Americans are aware of a provision in the United States Immigration and Nationality Act called section 214(b). Under this section of the INA a Consular Officer adjudicating a non-immigrant visa application (like a B2 visa application, B2 is the official category for tourist visas) must presume that the applicant is an intending immigrant unless the applicant can provide strong evidence to the contrary. This creates a sort of “strong ties” vs. “weak ties” analysis whereby the Consular Officer will balance the applicant’s ties to the USA and Laos (or another country abroad). If the applicant can show strong ties to Laos and weak ties to the USA, then that applicant may be granted the tourist visa. However, in cases where a US Citizen is a significant other of the applicant such a relationship may have a negative impact upon the visa application as the relationship itself could be viewed as a “strong tie” to the USA. This should NOT be read as to imply that a relationship should not be disclosed as it is this author’s opinion that failure to disclose the existence of an American significant other could be construed as misrepresentation. That said, such a relationship could still have an adverse impact upon an applicant’s tourist visa application.

Those who wish to bring a Lao loved one back to the United states for the purposes of marriage and subsequent residence are well advised to seek either a US fiance visa (K1 visa) or a US Marriage Visa (CR1 Visa, IR1 Visa, or a K3 Visa although the K3 visa category has been effectively phased out by the National Visa Center in recent months).  That said, no one should ever enter into any type of relationship strictly as a pretext for obtaining a US Immigration benefit. Therefore, the relationship that acts as a basis for any visa application or petition ought to be bona fide and genuine.

The J1 visa can be an effective travel document for those seeking admission to the United States for cultural and educational exchange. It was recently announced that certain changes will be implemented which may have a significant impact upon J1 visa applicants. The American State Department has made rule changes which may effect J1 visa processing, to quote a recent press release distributed by the American Immigration Lawyers Association (AILA):

On June 19, 2007, the Department published an interim final rule amending its regulations regarding Trainees and Interns to, among other things, eliminate the distinction between “non-specialty occupations” and “specialty occupations,” establish a new internship program, and modify the selection criteria for participation in a training program.

This document confirms the Interim Final Rule as final and amends the requirements to permit the use of telephone interviews to screen potential participants for eligibility, to remove the requirement that sponsors secure a Dun & Bradstreet report profiling companies with whom a participant will be placed and also amends this provision to provide clarification regarding the verification of Worker’s Compensation coverage for participants and use of an Employer Identification Number to ascertain that a third-party host organization providing training is a viable entity, and to clarify that trainees and interns may repeat training and internship programs under certain conditions.

It would appear that the US State Department is making these changes in order to better enjoy the benefits of technological advances. The use of telephone interviews for eligibility screening purposes will likely decrease overall processing time. Furthermore, repealing the Dun & Bradstreet report requirement will likely save individuals as well as companies time and resources when they opt to file for J-1 visa benefits on behalf of a foreign national.

The J-1 visa is often utilized by those who travel to the USA as exchange visitors. Often, those applying for such a travel documents do so at a US Embassy or US Consulate abroad. As the J-1 visa is a non-immigrant visa, the Consular Officer adjudicating the application must ascertain whether the applicant should be granted the visa notwithstanding the provisions of section 214b of the United States Immigration and Nationality Act which requires that those seeking a non-immigrant visa show “strong ties” to their home country and “weak ties” to the United States. Some are under the mistaken impression that a J-1 visa is a “dual intent” travel document akin to the L1 visa. Due to the provisions of section 214b of the INA, the applicant for a J1 visa should not maintain an intention to remain in the USA indefinitely.

The EB-5 Visa: What Is It?

In recent months, this author has received a number of inquires regarding the American EB-5 visa. Many seem interested in this visa category because it accords the bearer with substantial benefits in the United States and also puts EB-5 visa holders on track to obtain United States Citizenship. In order to provide the reading public with relevant information, this post will provide a brief overview of the EB-5 visa and some information regarding the application process.

A well rounded layman’s definition of the EB-5 visa can be found at wikipedia.com. To briefly quote wikipedia’s entry regarding the EB-5 visa directly:

“The EB-5 visa for Immigrant Investors is a United States visa created by the Immigration Act of 1990. This visa provides a method of obtaining a green card for foreign nationals who invest money in the United States.[1] To obtain the visa, individuals must invest at least $1 million, creating at least 10 jobs.[2]

By investing in certain qualified investments or regional centers with high unemployment rates, the required investment amount is $500,000. The Immigrant Investor Pilot Program was created by Section 610 of Public Law 102-395 on October 6, 1992. This was in accordance to a Congressional mandate aimed at stimulating economic activity and job growth, while allowing eligible aliens the opportunity to become lawful permanent residents. This “Pilot Program” required only $500,000 of investment in exchange for permanent resident status. The investment could only be received by an economic unit defined as a Regional Center.”

Although the above definition provides superficial insight into the mechanics of the EB-5 visa, the official website of the United States Citizenship and Immigration Service (USCIS) may provide deeper elucidation into the eligibility requirements for an EB-5 visa:

Eligibility Criteria

New Business Enterprise

To qualify you must:

  1. Invest or be in the process of investing at least $1,000,000.  If your investment is in a designated targeted employment area (discussed further below) then the minimum investment requirement is $500,000.
  2. Benefit the U.S. economy by providing goods or services to U.S. markets.
  3. Create full-time employment for at least 10 U.S. workers.  This includes U.S. citizens, Green Card holders (lawful permanent residents) and other individuals lawfully authorized to work in the U.S. (however it does not include you (the immigrant), or your spouse, sons or daughters).
  4. Be involved in the day-to-day management of the new business or directly manage it through formulating business policy – for example as a corporate officer or board member.

Targeted Employment Area is defined by law as “a rural area or an area that has experienced high unemployment of at least 150 percent of the national average.”  For further detail click on the Laws section of this website and access section 203(b)(5)(B) of the Immigration Nationality Act (INA).

Troubled Business

To qualify you must:

  1. Invest in a business that has existed for at least two years.
  2. Invest in a business that has incurred a net loss, based on generally accepted accounting principles, for the 12 to 24 month period before you filed the Form I-526 Immigrant Petition by an Alien Entrepreneur.
  3. The loss for the 12 to 24 month period must be at least equal to 20 percent of the business’s net worth before the loss.
  4. Maintain the number of jobs at no less than the pre-investment level for a period of at least two years.
  5. Be involved in the day-to-day management of the troubled business or directly manage it through formulating business policy.  For example as a corporate officer or board member.
  6. The same investment requirements of the new commercial enterprise investment apply to a troubled business investment ($1,000,000 or $500,000 in a targeted employment area).

Regional Center Pilot Program

To qualify you must:

  1. Invest at least $1,000,000 or $500,000 in a regional center affiliated new commercial enterpriose or a troubled business located within the area of the USCIS designated Regional Center.  Regional Centers are defined and discussed further below.
  2. Create at least 10 new full-time jobs either directly through the capital investment.

A Regional Center is defined as any economic unit, public or private, which is involved with the promotion of economic growth, improved regional productivity, job creation, and increased domestic capital investment. The organizers of a regional center seeking the regional center designation from USCIS must submit a proposal showing:

  • How the regional center plans to focus on a geographical region within the U.S., and msut explain how the regional center will achieve the required economic growth within this regional area
  • That the regional center’s business plan can be relied upon as a viable business model grounded in reasonable and credible estimates and assumptions for market conditions, project costs, and activity timelines
  • How in verifiable detail (using economic models in some instances) jobs will be created directly or indirectly through capital investments made in accordance with the regional center’s business plan
  • The amount and source of capital committed to the project and the promotional efforts made and planned for the business project.

As can be seen from the above citation, the eligibility criteria for an EB-5 visa are rigorous, but not insurmountable for an applicant who has the assistance of a competent and experienced US Immigration attorney.  Obtainment of EB-5 visas can require a great deal of time and expense in an effort to ensure that the eligibility and application requirements are met at the time of application submission. Laos is a landlocked country in Southeast Asia. In recent years it has become a popular destination among back-pack tourists as well as those wishing to see the majestic splendor of Laos’ natural beauty. As is often the case in countries around the globe, a US Embassy provides services to those seeking a US visa or a other services which can be provided either through the Consulate proper or the American Citizen Services Section. Those wishing to travel to an Embassy are generally advised to check the hours of operation and the local holiday closing schedule in an effort to forestall an unnecessary trip to the Embassy due to Post closure. Staff at a US Embassy or a US Consulate can usually provide assistance, or insight, regarding documentation such as the Consular Report of Birth Abroad (CRBA), Notarized affidavits, Passports, visa pages, etc. In situations where an American Citizen must travel to the American Citizen Services Section of a United States Embassy or Consulate it may be wise to check the US Embassy’s website in order to ascertain whether or not one can set an appointment online. This makes the situation far less cumbersome for both the American and the Consular Officer as the Post can be prepared ahead of time to deal with the petitioner’s request.

With regard to visas, those petitions which are filed in the USA (such as a K1 visa petition or a K3 Visa petition) must first receive approval from USCIS before the petition will be forwarded to the Department of State and the US Embassy.
