			<content:encoded><![CDATA[<p>It recently came to this blogger&#8217;s attention that personnel of the United States Justice Department have filed a case challenging the provisions of a recent State immigration law enacted by the sovereign <a title="State of Alabama" href="http://www.alabama.gov">State of Alabama</a>. In order to provide further information this blogger is compelled to <a title="quote directly" href="http://blog.al.com/spotnews/2011/08/hold_us_justice_department_see.html">quote directly</a> from the website <a title="AL.com" href="http://www.al.com">AL.com</a>:</p>
<blockquote><p><strong><em>BIRMINGHAM, Alabama &#8212; The U.S. Justice Department today filed a lawsuit  challenging Alabama&#8217;s new immigration law, which is slated to go into  effect next month. In its lawsuit, the Justice Department says  Alabama&#8217;s law unconstitutionally interferes with the federal  government&#8217;s authority over immigration. &#8220;To put it in terms we  relate to here in Alabama, you can only have one quarterback in a  football game. In immigration, the federal government is the  quarterback,&#8221; said Joyce White Vance, the U.S. Attorney for the Northern  District of Alabama. Justice Department lawyers write in the  lawsuit that the department is filing the action &#8220;to declare invalid and  preliminarily and permanently enjoin the enforcement of various  provisions&#8221; of the state law, according to the <a href="http://media.al.com/bn/other/U.S.%20Justice%20Department%20lawsuit.pdf">lawsuit filed in U.S. District Court in Birmingham</a> this afternoon. Provisions within the state&#8217;s immigration law &#8220;are  preempted by federal law and therefore violate the Supremacy Clause of  the United States Constitution&#8230;&#8221;</em></strong></p></blockquote>

<p>Frequent readers of this blog may have noted that this blogger has rather strong feelings regarding inherent <a title="States' Rights" href="http://integrity-legal.com/legal-blog/us-citizenship/zerohedge-com-discusses-proposed-us-passport-biographical-questionnaire-while-new-york-woman-challenges-constitutionality-of-doma/">States&#8217; Rights</a> and the inherent prerogatives which are reserved to State sovereigns notwithstanding the <a title="enumerated powers" href="http://integrity-legal.com/legal-blog/us-constitution/analysis-of-the-fourteenth-amendment-with-respect-to-the-american-debt-ceiling-and-possible-impact-upon-immigration-matters/">enumerated powers</a> of the federal government pursuant to the United States Constitution. That stated, American immigration is one of the relatively few fields in which Congress has virtually monopolistic power regarding the imposition of laws, rules, and regulations. This is due to the fact that immigration falls into the jurisdiction of Congressional and executive <a title="plenary power" href="http://en.wikipedia.org/wiki/Plenary_power#Plenary_Power_in_U.S._Immigration_Law">plenary power</a>. Therefore, it is little wonder that this recent case was filed since the Alabama law would seem to be operating in violation of that aforementioned plenary power. How this case will ultimately be resolved remains to be seen, but clearly issues pertaining to <a title="US immigration" href="http://www.integrity-legal.com">US immigration</a> can be dramatic in a political context.</p>
<p>Of further interest to those who find the information above to be noteworthy, it recently came to this blogger&#8217;s attention that the American Congress seems to be attempting to create some sort of extra-Constitutional body for legislative purposes. To provide further elucidation regarding these developments it is necessary to <a title="quote directly" href="http://www.huffingtonpost.com/2011/07/23/super-congress-debt-ceiling_n_907887.html">quote directly</a> from the official website of the <a title="Huffington Post" href="http://www.huffingtonpost.com">Huffington Post</a>, HuffingtonPost.com</p>
<blockquote><p><strong><em>This &#8220;Super Congress,&#8221; composed of members of both chambers and both  parties, isn&#8217;t mentioned anywhere in the Constitution, but would be  granted extraordinary new powers. Under a plan put forth by Senate  Minority Leader Mitch McConnell (R-Ky.) and his counterpart Majority  Leader Harry Reid (D-Nev.), legislation to lift the debt ceiling would  be accompanied by the creation of a 12-member panel made up of 12  lawmakers &#8212; six from each chamber and six from each party. Legislation approved by the Super Congress &#8212; which some on Capitol  Hill are calling the &#8220;super committee&#8221; &#8212; would then be fast-tracked  through both chambers, where it couldn&#8217;t be amended by simple, regular  lawmakers, who&#8217;d have the ability only to cast an up or down vote. With  the weight of both leaderships behind it, a product originated by the  Super Congress would have a strong chance of moving through the little  Congress and quickly becoming law. A Super Congress would be less  accountable than the system that exists today, and would find it easier  to strip the public of popular benefits. Negotiators are currently  considering cutting the mortgage deduction and tax credits for  retirement savings, for instance, extremely popular policies that would  be difficult to slice up using the traditional legislative process&#8230;</em></strong></p></blockquote>

<p>This blogger would argue that this proposed so-called &#8220;Super Congress&#8221; is a prima facie violation of the United States Constitution since there is no explicit reference to such an institution within the text of the Constitution itself and because Congress cannot delegate their lawmaking function to this institution per the <a title="doctrine of nondelegation" href="http://en.wikipedia.org/wiki/Non-delegation_doctrine#United_States">doctrine of nondelegation</a>. As noted in the quotation above, under the proposed scheme &#8220;rank and file&#8221; Representatives and Senators would not be able to make amendments or changes to proposed legislation emanating from this questionably Constitutional body, but would be required to vote &#8220;yes&#8221; or &#8220;no&#8221; only. This blogger would not have a Constitutionality issue with the proposed scheme if it were proposed as an Amendment to the Constitution and not as a statute since, again, the Nondelegation precludes such a transfer of power and therefore any law passed pursuant to this scheme may not be in compliance with notions of <a title="due process of law" href="http://en.wikipedia.org/wiki/Due_process#The_U.S._Constitution">due process of law</a> in American jurisprudence since there is a specific Constitutional framework for enacting legislation which does not include a &#8220;Super Congress&#8221;. For those who wish to understand this issue through the prism of analogy there are certain parallels between the argument that this scheme violates the Nondelegation doctrine and the argument that the so-called federal &#8220;<a title="line item veto" href="http://en.wikipedia.org/wiki/Clinton_v._City_of_New_York">line item veto</a>&#8221; violated the <a title="Presentment Clause" href="http://en.wikipedia.org/wiki/Presentment_Clause">Presentment Clause</a> of the American Constitution. The future circumstances of this scheme have yet to unfold, but clearly there are many legal aspects of this plan which could face challenge down the road.</p>

<p>In this blogger&#8217;s opinion, the news above elucidates the fundamental absurdity and ridiculousness of the <a title="Transportation Security Administration" href="http://integrity-legal.com/legal-blog/opinion/civilizations-are-judged-by-how-they-treat-their-most-distressed-and-america-we-have-been-found-wanting/">Transportation Security Administration</a> (<a title="TSA" href="http://integrity-legal.com/legal-blog/us-visa-immigration/federal-subpoena-issued-regarding-us-business-visas-while-tsa-trumps-texas-at-least-for-now/">TSA</a>), as of late, especially in light of the United States Constitution&#8217;s <a title="4th Amendment" href="http://integrity-legal.com/legal-blog/opinion/us-senator-says-there-is-not-time-to-go-through-proposed-patriot-act-extension-anyone-heard-this-before/">4th Amendment</a> protection against unreasonable searches and seizures.To provide poignant context it is again necessary to <a title="quote" href="http://en.wikipedia.org/wiki/Fourth_Amendment_to_the_United_States_Constitution#Text">quote</a> <a title="Wikipedia's 4th Amendment entry" href="http://en.wikipedia.org/wiki/Fourth_Amendment_to_the_United_States_Constitution">Wikipedia&#8217;s 4th Amendment entry</a>:</p>

<p>In what way is it reasonable to assume that groping a former Defense Secretary is reasonable while he is traveling to the funeral of a former First Lady? Where is the probable cause for this activity? Where is the <a title="warrant" href="http://en.wikipedia.org/wiki/Warrant_%28law%29">warrant</a> for such an invasion of Mr. Rumsfeld&#8217;s personal space? These events seem rather ironic since it was Mr. Bush&#8217;s administration that began these Constitutionally-suspect practices. However, that should not divert the reader&#8217;s attention from the severity of this state of affairs. At what point did it become reasonable to deny everyone their Constitutional right to be free from unwanted touching? Or, perhaps more specifically unwanted searches of persons without a warrant supported by probable cause? To provide further insight, it is necessary to <a title="quote" href="http://en.wikipedia.org/wiki/Natural_law#American_jurisprudence">quote</a> from another section of Wikipedia discussing fundamental legal issues associated with the American Constitution:</p>
<blockquote><p><strong><em>The <a title="U.S. Declaration of Independence" href="http://en.wikipedia.org/wiki/U.S._Declaration_of_Independence">U.S. Declaration of Independence</a> states that it has become necessary for the United States to assume  &#8220;the separate and equal station to which the Laws of Nature and of  Nature&#8217;s God entitle them&#8221;. <p>This quotation above is important because it demonstrates the reason for the very existence of the 4th Amendment itself. Namely: to codify extremely important, yet utterly subtle natural rights. The founders were well aware of the fact some natural rights are so inherent to the very fiber of <a title="We The People" href="http://en.wikipedia.org/wiki/Preamble_to_the_United_States_Constitution#Text">We The People</a>&#8216;s being that they are (under the weight of occasionally specious yet tempting legal reasoning) sometimes subject to being taken for granted by dint of their almost ethereal nature.</p>

It is also necessary to point out that the woman in question noted above is innocent until <span style="text-decoration: underline;"><strong><em>proven</em></strong></span> guilty of any charge under American law and the American justice system&#8217;s adherence to <a title="Blackstone's formulation" href="http://en.wikipedia.org/wiki/Blackstone%27s_formulation">Blackstone&#8217;s Formulation</a>. That said, it will, no doubt, be interesting to ascertain the facts surrounding this incident since the lead-up to this incident may, at the least, provide context. Travel is stressful to begin with and, in this blogger&#8217;s opinion, such stress is only compounded by the duress which arises with the prospect of an invasive pat-down and the insistence, with little <a title="legal" href="http://www.legal.com.kh">legal</a> foundation, that such a pat-down be imposed.</p>

Such interposition may be especially imprudent if not fully backed by the <a title="Full Faith and Credit" href="http://integrity-legal.com/legal-blog/lgbt-immigration/same-sex-visa-lgbt-immigration/lgbt-rights-states-rights-comparing-and-contrasting-doma-repeal-legislation-and-uafa/">Full Faith and Credit</a> of American law. With that in mind it recently came to this blogger&#8217;s attention that Member of the United States House of Representatives, <a title="Representative Ron Paul" href="http://paul.house.gov/">Representative Ron Paul</a>, recently announced what would appear to be the re-introduction of a bill that could ameliorate some of the duress currently being borne by innocent Americans. To <a title="quote directly" href="http://paul.house.gov/index.php?option=com_content&amp;task=view&amp;id=1796&amp;Itemid=60">quote directly</a> from the official website of Representative Paul:</div>

In the interest of full disclosure to the reader it must be confessed that these pat-downs are not just the source of academic annoyance for this blogger as he was recently the victim of one of these &#8220;pat-downs&#8221;. When this blogger inquired as to the authority for the search especially in light of the <a title="Right to travel" href="http://en.wikipedia.org/wiki/Citizenship_Clause#Right_to_travel">Right to travel</a> enshrined in the provisions of the <a title="14th Amendment" href="http://en.wikipedia.org/wiki/Fourteenth_Amendment_to_the_United_States_Constitution">14th Amendment</a> and the right to be free from unreasonable searches and seizures without <a title="due process of law" href="http://en.wikipedia.org/wiki/Due_process_of_law">due process of law</a> in the form of a warrant supported by probable cause pursuant to the 4th Amendment this blogger was told that such notions were subordinate to some amorphous and never-fully-explained (supposedly posted, but this blogger never actually saw them since no one was willing to provide them) &#8220;federal regulations&#8221;. This blogger does not have any particular issue with federal regulations per se as they are often the legitimate by-product of legitimate law-making, but they never can contravene Constitutional law as Constitutional law and the protections of the Bill of Rights can only act to <strong><em><span style="text-decoration: underline;">override</span></em></strong> the provisions of federal regulation; and only then, when certain regulations offend the rightful liberties of the American People.</p>
<p>With respect to the this blogger&#8217;s opinion regarding his recent &#8220;enhanced pat-down&#8221; it can only be said that whatever my &#8220;enhanced pat-down&#8221; was, it certainly did not feel like the <a title="legitimate operation of a supreme government" href="http://integrity-legal.com/legal-blog/department-of-homeland-security/new-hampshire-legislator-takes-aim-at-tsa-is-genital-groping-a-legitimate-operation-of-a-supreme-government/">legitimate operation of a supreme government</a>. Therefore, I shall look toward remedies for this issue and the most effective remedies appear to be awaiting at either the ballot box or perhaps one day upon the desk of the <a title="Clerk of the United States House of Representatives" href="http://clerk.house.gov/index.aspx">Clerk of the United States House of Representatives</a>. With respect to the Several States it should be noted that some such as <a title="Texas" href="http://integrity-legal.com/legal-blog/lgbt-immigration/same-sex-visa-lgbt-immigration/aila-legislative-round-up-notes-uafa-and-reuniting-families-act-whilst-texas-appears-poised-to-pass-tsa-related-legislation/">Texas</a> and <a title="Michigan" href="http://integrity-legal.com/legal-blog/department-of-homeland-security/transportation-security-administration-tsa/asean-sees-launch-of-dedicated-tv-channel-while-state-of-michigan-possibly-pondering-tsa-related-legislation/">Michigan</a> may be discussing the the promulgation of State law with respect to involuntary touching at relevant airports. How State legislation of this variety would impact American jurisprudence especially in light of notions such as the <a title="Erie Doctrine" href="http://integrity-legal.com/legal-blog/lgbt-immigration/same-sex-visa-lgbt-immigration/delegate-of-commonwealth-of-virginia-criticizes-local-fed-for-position-on-lgbt-equality-while-china-apparently-decreasing-position-in-us-treasuries/">Erie Doctrine</a> remains to be seen, but it may merely remain an interesting point to speculate upon.</p>

Obama is poised to take a more commonsensical approach to issues pertaining to United States Immigration. <p>This blogger is personally anxious to see a new common sense strategy employed in the administration of America&#8217;s immigration system. In a previous posting on this blog it was noted that the Obama administration in conjunction with <a title="Senator Amy Klobucher" href="http://klobuchar.senate.gov/">Senator Amy Klobucher</a> have taken steps to move forward on legislation designed to reform certain aspects of the <a title="American visa" href="http://integrity-legal.com/legal-blog/us-visa-immigration/officials-in-travel-industry-reportedly-criticize-us-visa-system/">American visa</a> system. This initiative appears to be undertaken in an effort to generate further revenue for America in the form of tourist dollars. Furthermore, there are some who would argue that a reform of the immigration system would result in an increase in <a title="foreign direct investment" href="http://integrity-legal.com/legal-blog/us-embassy-bangkok/federal-court-decision-regarding-consular-non-reviewability-and-discussion-of-issues-associated-with-consular-processing/">foreign direct investment</a> in the USA as foreign nationals travel to America on visas such as the <a title="E-2 visa" href="http://www.integrity-legal.com/us-visa/us-visa-sri-lanka.html">E-2 visa</a> or the <a title="EB-5 visa" href="http://www.integrity-legal.com/us-visa/us-visa-south-korea.html">EB-5 visa</a> in order to engage in trade or start a business.</p>
<p>Credit where credit is due: the administration appears serious about making positive changes to the <a title="US visa process" href="http://integrity-legal.com/legal-blog/uscis/uscis-memo-regarding-dos-and-passport-revocation/">US visa process</a> and for this reason their efforts to that end should be admired. However, not everyone is enthusiastic about every aspect of the Obama administration&#8217;s policies and procedures as was recently discovered by this blogger while surfing the internet for information regarding the recent <a title="Patriot Act Extension" href="http://integrity-legal.com/legal-blog/upcoming-legislation/united-states-of-america-tear-down-this-law/">Patriot Act Extension</a>. It would appear as though the issue of the Patriot Act&#8217;s extension is not the salient point for some as the President&#8217;s method of &#8220;signing&#8221; the recent legislation has been called into question. To <a title="quote directly" href="http://tpmdc.talkingpointsmemo.com/2011/05/rep-tom-graves-r-ga-fear-the-autopen.php">quote directly</a> from an article written by <a title="Benjy Sarlin" href="http://tpmdc.talkingpointsmemo.com/benjy_sarlin_1/2011/05/22-week/">Benjy Sarlin</a> posted on the website <a title="TalkingPointsMemo.com" href="http://talkingpointsmemo.com/">TalkingPointsMemo.com</a>:</p>

<p><a title="Representative Tom Graves" href="http://tomgraves.house.gov/">Representative Tom Graves</a> is not the only one with concerns regarding this method of enacting legislation via &#8220;autopen&#8221; as those who subscribe to a so-called &#8220;<a title="formalist" href="http://en.wikipedia.org/wiki/Legal_formalism#Justice_Scalia_and_formalism">formalist</a>&#8221; or plain language interpretation of the United States Constitution (which this blogger has been known to agree with on certain issues) seem to have taken some offense to the notion of being able to sign legislation, especially legislation as important as the Patriot Act extension, into law through usage of an &#8220;autopen&#8221; especially in light of a plain language interpretation of the U.S. Constitution itself. To further elucidate this point it may be best to <a title="quote directly" href="http://www.cbsnews.com/8618-503544_162-20066922.html?assetTypeId=41&amp;messageId=10841391&amp;blogId=503544">quote directly</a> from a very astute comment on the <a title="CBSnews.com" href="http://www.cbsnews.com">CBSnews.com</a> website attributed to Bojax39 on May 31, 2011:</p>
<blockquote><p><strong><em>Justice Department&#8217;s Office of Legal Counsel: &#8220;&#8230;we conclude that  the President need not personally perform the physical act of affixing  his signature to a bill he approves and decides to sign in order for the  bill to become law. That stated, one is always encouraged to take some opinions posted on the internet with a proverbial &#8220;grain of salt,&#8221; but under the circumstances the points raised in the citation above are valid.</p>
<p>Clearly, there is room for debate as to the legitimacy of &#8220;autopen&#8221; usage in the adoption of legislation. In fact, there could be an argument that failure to fully adhere to Article 1 Section 7 noted above creates an implication that the extension of the Patriot Act fails to conform to notions of <a title="due process of law" href="http://en.wikipedia.org/wiki/Procedural_due_process#The_enumerated_due_process_right">due process of law</a> under the American Constitution. How this issue will play out in the months and days ahead remains to be seen, but it seems likely that further discussion of &#8220;autopen&#8221; usage may arise in the future.</p>
