			<content:encoded><![CDATA[<p>An Executive Order has been issued by the Trump administration regarding suspension of immigration to the United States for the forthcoming 60 days. However, the order does not appear to apply to those seeking a <a title="K-1 visa" href="http://www.integrity-legal.com/us-visa/k1-fiance-visa.html">K-1 visa</a> to bring a foreign fiance to the USA. Concurrently, it also does not appear to apply to <a title="American visas for the spouses and children of U.S. Citizens" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/medical-examinations-cr-1-and-ir-1-marriage-visa-context/">American visas for the spouses and children of U.S. Citizens</a>. To quote directly from the relevant sections of the order as posted on the <a title="White House" href="https://www.whitehouse.gov/presidential-actions/proclamation-suspending-entry-immigrants-present-risk-u-s-labor-market-economic-recovery-following-covid-19-outbreak/">White House</a> website:</p>
<blockquote>
<p style="text-align: center;"><strong>NOW, THEREFORE, I, DONALD J. TRUMP, President of the United States, by the authority vested in me by the Constitution and the laws of the United States of America, including sections 212(f) and 215(a) of the Immigration and Nationality Act, 8 U.S.C. 1182(f) and 1185(a), and section 301 of title 3, United States Code, hereby find that the entry into the United States of persons described in section 1 of this proclamation would, except as provided for in section 2 of this proclamation, be detrimental to the interests of the United States, and that their entry should be subject to certain restrictions, limitations, and exceptions.  I therefore hereby proclaim the following:</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Section</span> <span style="text-decoration: underline;">1</span>.  <span style="text-decoration: underline;">Suspension and Limitation on Entry</span>.  The entry into the United States of aliens as immigrants is hereby suspended and limited subject to section 2 of this proclamation.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">2</span>.  <span style="text-decoration: underline;">Scope of Suspension and Limitation on Entry</span>.  (a)  The suspension and limitation on entry pursuant to section 1 of this proclamation shall apply only to aliens who:</strong></p>
<p style="text-align: center;"><strong>(i)    are outside the United States on the effective date of this proclamation;</strong></p>
<p style="text-align: center;"><strong>(ii)   do not have an immigrant visa that is valid on the effective date of this proclamation; and</strong></p>
<p style="text-align: center;"><strong>(iii)  do not have an official travel document other than a visa (such as a transportation letter, an appropriate boarding foil, or an advance parole document) that is valid on the effective date of this proclamation or issued on any date thereafter that permits him or her to travel to the United States and seek entry or admission.</strong></p>
<p style="text-align: center;"><strong>(b)  The suspension and limitation on entry pursuant to section 1 of this proclamation shall not apply to:</strong></p>
<p style="text-align: center;"><strong>(i)     any lawful permanent resident of the United States;</strong></p>
<p style="text-align: center;"><strong>(ii)    any alien seeking to enter the United States on an immigrant visa as a physician, nurse, or other healthcare professional; to perform medical research or other research intended to combat the spread of COVID-19; or to perform work essential to combating, recovering from, or otherwise alleviating the effects of the COVID-19 outbreak, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees;  and any spouse and unmarried children under 21 years old of any such alien who are accompanying or following to join the alien;</strong></p>
<p style="text-align: center;"><strong>(iii)   any alien applying for a visa to enter the United States pursuant to the EB-5 Immigrant Investor Program;</strong></p>
<p style="text-align: center;"><strong>(iv)    any alien who is the spouse of a United States citizen;</strong></p>
<p style="text-align: center;"><strong>(v)     any alien who is under 21 years old and is the child of a United States citizen, or who is a prospective adoptee seeking to enter the United States pursuant to the IR-4 or IH-4 visa classifications;</strong></p>
<p style="text-align: center;"><strong>(vi)    any alien whose entry would further important United States law enforcement objectives, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees, based on a recommendation of the Attorney General or his designee;</strong></p>
<p style="text-align: center;"><strong>(vii)   any member of the United States Armed Forces and any spouse and children of a member of the United States Armed Forces;</strong></p>
<p style="text-align: center;"><strong>(viii)  any alien seeking to enter the United States pursuant to a Special Immigrant Visa in the SI or SQ classification, subject to such conditions as the Secretary of State may impose, and any spouse and children of any such individual; or</strong></p>
<p style="text-align: center;"><strong>(ix)    any alien whose entry would be in the national interest, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">3</span>.  <span style="text-decoration: underline;">Implementation and Enforcement</span>.  (a)  The consular officer shall determine, in his or her discretion, whether an immigrant has established his or her eligibility for an exception in section 2(b) of this proclamation.  The Secretary of State shall implement this proclamation as it applies to visas pursuant to such procedures as the Secretary of State, in consultation with the Secretary of Homeland Security, may establish in the Secretary of State’s discretion.  The Secretary of Homeland Security shall implement this proclamation as it applies to the entry of aliens pursuant to such procedures as the Secretary of Homeland Security, in consultation with the Secretary of State, may establish in the Secretary of Homeland Security’s discretion.</strong></p>
<p style="text-align: center;"><strong>(b)  An alien who circumvents the application of this proclamation through fraud, willful misrepresentation of a material fact, or illegal entry shall be a priority for removal by the Department of Homeland Security.</strong></p>
<p style="text-align: center;"><strong>(c)  Nothing in this proclamation shall be construed to limit the ability of an individual to seek asylum, refugee status, withholding of removal, or protection under the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, consistent with the laws of the United States.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">4</span>.  <span style="text-decoration: underline;">Termination</span>.  This proclamation shall expire 60 days from its effective date and may be continued as necessary.  Whenever appropriate, but no later than 50 days from the effective date of this proclamation, the Secretary of Homeland Security shall, in consultation with the Secretary of State and the Secretary of Labor, recommend whether I should continue or modify this proclamation.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">5</span>.  <span style="text-decoration: underline;">Effective Date</span>.  This proclamation is effective at 11:59 p.m. eastern daylight time on April 23, 2020.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">6</span>.  <span style="text-decoration: underline;">Additional Measures</span>.  Within 30 days of the effective date of this proclamation, the Secretary of Labor and the Secretary of Homeland Security, in consultation with the Secretary of State, shall review nonimmigrant programs and shall recommend to me other measures appropriate to stimulate the United States economy and ensure the prioritization, hiring, and employment of United States workers.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">7</span>.  <span style="text-decoration: underline;">Severability</span>.  It is the policy of the United States to enforce this proclamation to the maximum extent possible to advance the interests of the United States.  Accordingly:</strong></p>
<p style="text-align: center;"><strong>(a)  if any provision of this proclamation, or the application of any provision to any person or circumstance, is held to be invalid, the remainder of this proclamation and the application of its provisions to any other persons or circumstances shall not be affected thereby; and</strong></p>
<p style="text-align: center;"><strong>(b)  if any provision of this proclamation, or the application of any provision to any person or circumstance, is held to be invalid because of the lack of certain procedural requirements, the relevant executive branch officials shall implement those procedural requirements to conform with existing law and with any applicable court orders.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">8</span>.  <span style="text-decoration: underline;">General Provisions</span>.  (a)  Nothing in this proclamation shall be construed to impair or otherwise affect:</strong></p>
<p style="text-align: center;"><strong>(i)   the authority granted by law to an executive department or agency, or the head thereof; or,</strong></p>
<p style="text-align: center;"><strong>(ii)  the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.</strong></p>
<p style="text-align: center;"><strong>(b)  This proclamation shall be implemented consistent with applicable law and subject to the availability of appropriations.</strong></p>
<p style="text-align: center;"><strong>(c)  This proclamation is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.</strong></p>

<p style="text-align: left;">Clearly, there are many who might see their cases negatively impacted by this order. To preface any further analysis, it should be noted that visa processing has been suspended at the US Embassy in Bangkok, Thailand as well as the US Embassy in Vientiane, Laos and the US Embassy in Phnom Phen, Cambodia due to the COVID-19 outbreak. So regardless of this order, it is not currently possible to obtain a visa from these posts as interviews have been suspended. Bearing the above in mind, the following analysis will demonstrate that this order will NOT have an impact on <a title="fiance visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/will-my-criminal-history-impact-my-k-1-visa-application/">fiance visa</a> and <a title="marriage visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/why-k-3-visas-may-not-be-optimal-adjustment-status/">marriage visa</a> cases for the fiances and/or spouses of American citizens:</p>
<p style="text-align: left;">The executive order states: &#8220;The entry into the United States of aliens as immigrants is hereby suspended and limited subject to section 2 of this proclamation.&#8221; The K-1 visa is designed for the fiance of an American citizen to to travel to the United States with the <a title="intention of marriage" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/k-1-fiancee-visa-waivers-multiple-filings/">intention of marriage</a>. It grants the bearer <a title="90 days of lawful status" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/comparing-and-contrasting-k-1-visa-and-k-3-visa/">90 days of lawful status</a> in the USA in which to marry their American fiance and file for <a title="adjustment of status" href="http://www.integrity-legal.com/us-visa/adjustment-status.html">adjustment of status</a> to lawful permanent residence (aka <a title="Green Card" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html">Green Card</a> status). It is important to note: the K-1 visa is a non-immigrant visa, albeit a <a title="dual intent visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/american-dual-intent-visas/">dual intent visa</a>. For purposes of processing it is treated as an immigrant visa (for example K-1 cases process through the <a title="Immigrant Visa Unit of the American Embassy in Thailand" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/coronavirus-covid-19-suspension-us-visa-issuance/">Immigrant Visa Unit of the American Embassy in Thailand</a>), but pursuant to United States law it is in fact a non-immigrant visa. The above cited executive order only pertains to immigrant visas. Therefore, this order does not have any bearing upon the processing of a <a title="K-1 fiance visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/k1-visa-thailand-proving-bona-fide-relationship/">K-1 fiance visa</a> case.</p>
<p style="text-align: left;">What about cases involving the spouse of an American citizen where the spouse would enter the USA and be granted an <a title="I-551 stamp" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/us-visas-and-immigration-what-i-551-stamp/">I-551 stamp</a> thereby granting permanent residence to the foreign spouse upon entry? The above executive order speaks directly to such a situation: &#8220;The suspension and limitation on entry pursuant to section 1 of this proclamation shall <span style="text-decoration: underline;"><em><strong>not</strong></em></span> apply to:&#8230;(iv) <strong><em><span style="text-decoration: underline;">any alien who is the spouse of a United States citizen</span></em></strong>&#8220;[Emphasis Added]. Clearly the suspension ordered in Trump&#8217;s executive order will exempt spouses of Americans. Therefore, those foreign spouses of American citizens seeking a <a title="K-3 visa" href="https://www.youtube.com/watch?v=IZq38Vc7kTE">K-3 visa</a>, <a title="CR-1 visa" href="http://www.integrity-legal.com/us-visa/immigrant-visa-process.html">CR-1 visa</a>, or <a title="IR-1 visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/should-i-go-cr-1-or-ir-1-visa-interview-my-spouse/">IR-1 visa</a> will not be adversely impacted by the provisions of this executive order.</p>
<p style="text-align: left;">Finally, the following should be noted: &#8220;This proclamation shall expire 60 days from its effective date&#8230;This proclamation is effective at 11:59 p.m. eastern daylight time on April 23, 2020.&#8221; Thus, unless this order is extended it will expire 60 days from now. We will keep readers updated on this blog as the situation progresses.</p>

			<content:encoded><![CDATA[<p>It has come to this blogger&#8217;s attention that the new administration in the USA has promulgated policies which will place more scrutiny upon those who may be applying for visas to the USA in the future. The proposed &#8220;<a title="extreme vetting" href="https://www.youtube.com/watch?v=VU-i5cSnRkQ">extreme vetting</a>&#8221; of US visa applications in a Consular Processing context appears to be aimed at narrow subsets of &#8220;red flagged&#8221; visa applicants. In order to best summarize this policy shift, it is necessary to <a title="quote directly" href="http://www.reuters.com/article/us-usa-immigration-visas-exclusive-idUSKBN16U12X">quote directly</a> from a relatively recent Reuters article:</p>
<blockquote><p><strong>The final cable seen by Reuters, issued on March 17, leaves in place an instruction to consular chiefs in each diplomatic mission, or post, to convene working groups of law enforcement and intelligence officials to &#8220;develop a list of criteria identifying sets of post applicant populations warranting increased scrutiny.&#8221; Applicants falling within one of these identified population groups should be considered for higher-level security screening&#8230;</strong></p></blockquote>
<p>The new administration appears keen to narrowly target those applicants which are deemed to be appropriate for &#8220;increased scrutiny&#8221;. However, a rather recent proposal has been submitted by the U.S. Department of State requesting implementation of the emergency review procedures of the Paperwork Reduction Act of 1995. In short, the DOS is requesting expedited processing of a request to modify the forms associated with applications for US visas. To quote directly from the US government website <a title="Regulations.gov" href="https://www.regulations.gov/document?D=DOS-2017-0019-0001">Regulations.gov</a>:</p>
<blockquote><p><strong>The Department proposes requesting the following information, if not already included in an application, from a subset of visa applicants worldwide, in order to more rigorously evaluate applicants for terrorism or other national security-related visa ineligibilities:</strong></p>
<ul>
<li><strong>Travel history during the last fifteen years, including source of funding for travel;</strong></li>
<li><strong>Address history during the last fifteen years;</strong></li>
<li><strong>Employment history during the last fifteen years;</strong></li>
<li><strong>All passport numbers and country of issuance held by the applicant;</strong></li>
<li><strong>Names and dates of birth for all siblings;</strong></li>
<li><strong>Name and dates of birth for all children;</strong></li>
<li><strong>Names and dates of birth for all current and former spouses, or civil or domestic partners;</strong></li>
<li><strong>Social media platforms and identifiers, also known as handles, used during the last five years; and</strong></li>
<li><strong>Phone numbers and email addresses used during the last five years.</strong></li>
</ul>
<p>&nbsp;</p>
<p><strong>Most of this information is already collected on visa applications but for a shorter time period, <em>e.g.</em> five years rather than fifteen years. Requests for names and dates of birth of siblings and, for some applicants, children are new. The request for social media identifiers and associated platforms is new for the Department of State, although it is already collected on a voluntary basis by the Department of Homeland Security (DHS) for certain individuals.</strong></p></blockquote>
<p>It is this blogger&#8217;s opinion that the long term implications of these policy changes will be broad. However, from reading the aforementioned notice, it appears that, at the present time, DOS personnel will only be seeking more detailed information on certain individual applicants, and not from all applicants seeking visas to the USA. How will the narrow subset of applicants subject to increased scrutiny be determined? To answer that it is necessary to quote further from the Regulations.gov website:</p>
<blockquote><p><strong>Department of State consular officers at visa-adjudicating posts worldwide will ask the proposed additional questions to resolve an applicant&#8217;s identity or to vet for terrorism or other national security related visa ineligibilities <em><span style="text-decoration: underline;">when the consular officer determines that the circumstances of a visa applicant, a review of a visa application, or responses in a visa interview indicate a need for greater scrutiny.</span></em></strong></p></blockquote>
<p>Notwithstanding the fact that enhanced scrutiny will apparently only be applied on a case by case basis and only upon those individuals who are deemed to be in need of such scrutiny it seems logical to infer that at some point these additional screening protocols may be applied on a broader basis; if for no other reason than the fact that applying such scrutiny across the board might save time and resources of Consular Officials making cases by case determinations. As it stands, as of the time of this writing, the new protocols add a degree of uncertainty to the visa application process and Consular processing in general as it is difficult to foresee what may be considered a trait which warrants heightened scrutiny. Therefore, planning for such an eventuality is problematic.</p>

			<content:encoded><![CDATA[<p>Since the topic of American Investment visas was first broached on this blog, this author has received some questions regarding the way in which United States Investment Visas actually operate in the real world. One of the most frequently asked questions pertaining to EB-5 visas is: &#8220;Can I get US Citizenship by investing in the United States?&#8221; The answer to that question is somewhat nuanced and it requires one to have a rather in-depth understanding of the EB-5 Immigrant Investor visa and the process for obtaining this type of travel document.</p>
<p>There are some countries around the world which have programs whereby investors can obtain virtually instantaneous citizenship simply by investing capital into the economy of the country issuing the nationality documents. In the United States, there is no program that operates this way. However, the EB-5 visa does grant the visa holder lawful permanent residence in the USA. This is a substantial benefit and should not be taken for granted as Lawful Permanent Residence is a highly sought after status that allows the Permanent Resident to permanently reside and work in the United States. Many often refer to Lawful Permanent Residence as &#8220;Green Card&#8221; status. That said, Lawful Permanent Residence is not American Citizenship. Those in the USA in Green Card status are not permitted to vote in elections, run for political office, and such individuals also cannot obtain a <a title="US passport" href="http://integrity-legal.com/legal-blog/us-embassy-china/holiday-closing-schedule-of-the-us-consulate-for-hong-kong-and-macau/" target="_blank">US passport</a>. Although, those in Lawful Permanent Resident (LPR) status may be eligible to obtain a <a title="US reentry permit" href="http://integrity-legal.com/legal-blog/us-visa-immigration/new-fam-protocols-for-sb-1-returning-resident-visas-issued-overseas/" target="_blank">US reentry permit</a> which allows the bearer to leave the United States for as long as two years without raising the presumption of residential abandonment.</p>
<p>Although there is no &#8220;citizenship by investment&#8221; program in the USA, the EB-5 visa could be the first step in the United States Naturalization process. For example, if an immigrant investor is granted an <a title="EB-5 visa" href="http://www.integrity-legal.com/us-visa/eb5-visa.html" target="_blank">EB-5 visa</a> and enters the United States, then that individual would be granted permanent residence upon lawful admission. After residing in the United States for a statutorily prescribed period of time, and assuming all other criteria are met, it may be possible for an EB-5 visa holder to apply for <a title="naturalization" href="http://integrity-legal.com/legal-blog/uscis/information-regarding-newly-updated-naturalization-certificate/" target="_blank">naturalization</a>. Naturalization is the process whereby a foreign national becomes a United States Citizen. The process can be somewhat cumbersome and for those unaccustomed to dealing with immigration matters it may seem complex and frustrating at times, but upon approval of a petition for naturalization an EB-5 Immigrant Investor could theoretically obtain United States Citizenship.</p>

This is a no-cost application and our firm currently does not take clients for Diversity Visas. That said, there are many around the world who are eligible to submit an application to be entered in the <a title="Diversity Visa Lottery" href="http://integrity-legal.com/legal-blog/us-visa-immigration/the-us-visa-lottery-diversity-visa-applications-currently-accepted/" target="_blank">Diversity Visa Lottery</a>. <p><strong><em>SUMMARY: This public notice provides information on how to apply for  the DV-2012 Program. This notice is issued pursuant to 22 CFR  42.33(b)(3) which implements sections 201(a)(3), 201(e), 203(c) and  204(a)(1)(I) of the Immigration and Nationality Act, as amended, (8  U.S.C. 1151, 1153, and 1154(a)(1)(I)).</em></strong></p>
<p><strong><em>Instructions for the 2012 Diversity Immigrant Visa Program (DV-2012)</em></strong></p>
<p><strong><em> The congressionally mandated Diversity Immigrant Visa Program is  administered on an annual basis by the Department of State and  conducted under the terms of Section 203(c) of the Immigration and  Nationality Act (INA). Section 131 of the Immigration Act of 1990 (Pub.  L. 101-649) amended INA 203 and provides for a class of immigrants  known as &#8220;diversity immigrants.&#8221; Section 203(c) of the INA provides a  maximum of 55,000 Diversity Visas (DV) each fiscal year to be made  available to persons from countries with low rates of immigration to  the United States.</em></strong></p>
<p><strong><em> The annual DV program makes permanent residence visas available to  persons meeting the simple, but strict, eligibility requirements. A  computer-generated random lottery drawing chooses selectees for  Diversity Visas. The visas are distributed among six geographic regions  with a greater number of visas going to regions with lower rates of  immigration, and with no visas going to nationals of countries sending  more than 50,000 immigrants to the United States over the period of the  past five years. Within each region, no single country may receive more  than seven percent of the available Diversity Visas in any one year.</em></strong></p>
<p><strong><em> For DV-2012, natives of the following countries are not eligible to  apply because the countries sent a total of</em></strong></p>

<p><strong><em>more than 50,000 immigrants to the United States in the previous five  years:</em></strong></p>
<p><strong><em> BRAZIL, CANADA, CHINA (mainland-born), COLOMBIA, DOMINICAN  REPUBLIC, ECUADOR, EL SALVADOR, GUATEMALA, HAITI, INDIA, JAMAICA,  MEXICO, PAKISTAN, PERU, the PHILIPPINES, POLAND, SOUTH KOREA, UNITED  KINGDOM (except Northern Ireland) and its dependent territories, and  VIETNAM.</em></strong></p>
<p><strong><em> Persons born in Hong Kong SAR, Macau SAR and Taiwan are eligible.  For DV-2012, no countries have been added or removed from the previous  year&#8217;s list of eligible countries.</em></strong></p>
<p><strong><em> The Department of State implemented the electronic registration  system beginning with DV-2005 in order to make the Diversity Visa  process more efficient and secure. The Department utilizes special  technology and other means to identify those who commit fraud for the  purposes of illegal immigration or who submit multiple entries.</em></strong></p>
<p><strong><em>Diversity Visa Registration Period</em></strong></p>
<p><strong><em> Entries for the DV-2012 Diversity Visa Lottery must be submitted  electronically between noon, Eastern Daylight Time (EDT) (GMT-4),  Tuesday, October 5, 2010, and noon, Eastern Standard Time (EST) (GMT-5)  Wednesday, November 3, 2010. Applicants may access the electronic  Diversity Visa Entry Form (E-DV) at http://www.dvlottery.state.gov  during the registration period. Paper entries will not be accepted.  Applicants are strongly encouraged not to wait until the last week of  the registration period to enter. Heavy demand may result in Web site  delays. No entries will be accepted after noon, EST, on November 3,  2010.</em></strong></p>
<p><strong><em>Requirements for Entry</em></strong></p>
<p><strong><em> To enter the DV lottery, you must be a native of one of the listed  countries. See &#8220;List of Countries by Region Whose Natives Qualify.&#8221;  In most cases this means the country in which you were born. However,  there are two other ways you may be able to qualify. First, if you were  born in a country whose natives are ineligible but your spouse was born  in a country whose natives are eligible; you can claim your spouse&#8217;s  country of birth, provided both you and your spouse are on the selected  entry, are issued visas, and enter the United States simultaneously.  Second, if you were born in a country whose natives are ineligible, but  neither of your parents was born there or resided there at the time of  your birth, you may claim nativity in one of your parents&#8217; country of  birth, if it is a country whose natives qualify for the DV-2012  program.</em></strong></p>
<p><strong><em> To enter the lottery, you must meet either the education or work  experience requirement of the DV program. You must have either a high  school education or its equivalent, defined as successful completion of  a 12-year course of elementary and secondary education; OR, two years  of work experience within the past five years in an occupation  requiring at least two years of training or experience to perform. The  U.S. Department of Labor&#8217;s O*Net OnLine database will be used to  determine qualifying work experience. For more information about  qualifying work experience, see Frequently Asked Question 13.  If you cannot meet either of these requirements, you should NOT submit  an entry to the DV program. <p>Those wishing to apply for a Diversity Visa should first ascertain if they are eligible. After determining eligibility an application must be submitted. Should an entrant be chosen to receive the visa, then Consular Processing will still be required. Therefore, applicants for a US diversity visa may still be required to submit themselves for interview at a <a title="US Consulate" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html" target="_blank">US Embassy</a> or <a title="US Consulate" href="http://integrity-legal.com/legal-blog/us-visa-immigration/can-my-indonesian-girlfriend-or-boyfriend-get-a-b2-tourist-visa-to-the-united-states-of-america/" target="_blank">US Consulate</a> outside of the United States. Some find that attorney assistance is beneficial during the Consular Processing phase of this type of application while others choose to file pro se.</p>
<p>It should be noted that the <a title="Visa Lottery" href="http://integrity-legal.com/legal-blog/us-visa-immigration/the-us-diversity-visa-aka-the-green-card-lottery/" target="_blank">Visa Lottery</a> does not require payment of any fees  initially (although winners may need to pay Consular Processing fees and travel expenses). 			<content:encoded><![CDATA[<p>Those who read this blog on a regular basis may have noted that recently less attention has been paid to the <a title="K1 visa" href="http://www.integrity-legal.com" target="_blank">K1 visa</a> than in the past. This development is partly due to the fact that there has been little to report regarding the <a title="US fiance visa" href="http://integrity-legal.com/legal-blog/fiance-visa-thailand/new-lockbox-facility-to-receive-k1-visa-petitions/" target="_blank">US fiance visa</a> as there have been few dramatic changes to the K1 visa process since the beginning of the year 2010. That said, with <a title="Comprehensive Immigration Reform" href="http://integrity-legal.com/legal-blog/us-visa/is-comprehensive-immigration-reform-the-path-to-future-economic-benefits-for-the-usa/" target="_blank">Comprehensive Immigration Reform</a> possibly on the horizon, there are those who believe that many changes will be made to current US Immigration protocols. In a recent announcement, the American State Department sought comments regarding the DS-156K. This form is specifically used for Consular Processing of the K1 fiance visa. To <a title="directly quote" href="http://www.aila.org/content/default.aspx?docid=31939" target="_blank">directly quote</a> an excerpt from the announcement as distributed by the American Immigration Lawyers Association (<a title="AILA" href="http://www.aila.org" target="_blank">AILA</a>):</p>
<blockquote><p><strong><em>We are soliciting public comments to permit  the Department to: Evaluate whether the proposed information collection is  necessary to properly perform our functions. Evaluate the accuracy of our estimate of the burden of the  proposed collection, including the validity of the methodology and  assumptions used. Enhance the quality, utility, and clarity of the  information to be collected. Minimize the reporting burden on those who are to respond,     Abstract of proposed collection: Form DS-156K is used by consular  officers to determine the eligibility of an alien applicant for a non- immigrant fiancee visa. Methodology: The DS-156K is submitted to consular posts abroad.</em></strong></p></blockquote>
<p>In the past, the DS-156K might have also been utilized in a <a title="K3 Visa" href="http://www.integrity-legal.com/us-visa/k3-visa-process.html" target="_blank">K3 Visa</a> application pending before a <a title="US Consulate" href="http://integrity-legal.com/legal-blog/us-embassy-mauritius/holiday-closing-schedule-of-the-united-states-embassy-in-mauritius/" target="_blank">US Consulate</a> or <a title="US Embassy" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html" target="_blank">US Embassy</a>. However, the <a title="National Visa Center" href="http://integrity-legal.com/legal-blog/us-visa-immigration/national-visa-center-to-begin-an-electronic-processing-pilot-program/" target="_blank">National Visa Center</a> announced this year that many of the K3 visa applications will be &#8220;administratively closed&#8221; in cases where the underlying I-130 petition (used for spouse visas such as the <a title="CR1 Visa" href="http://www.integrity-legal.com/us-visa/immigrant-visa-process.html" target="_blank">CR1 Visa</a> and the <a title="IR1 Visa" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html" target="_blank">IR1 Visa</a>) arrives at NVC simultaneously or prior to the arrival of the I-129f petition for a K3 visa.</p>
<p>In the context of the K1 visa, this request for comments would appear to be an attempt by the State Department to assess the utility of the DS-156K in an effort to streamline the processing of future K visa applications. How the comments will ultimately be used remains to be seen, but any attempt to make the visa process more efficient should be greeted positively by this author as the visa process can sometimes prove to be confusing and cumbersome those American Citizens wishing to bring a loved one to the United States.</p>

			<content:encoded><![CDATA[<p>The <a title="United States Customsa and Border Protection Service" href="http://integrity-legal.com/legal-blog/department-of-homeland-security/department-of-homeland-security-testing-iris-scanning-technology-for-uscbp-usage/" target="_blank">United States Customs and Border Protection Service</a> (<a title="USCBP" href="http://integrity-legal.com/legal-blog/department-of-homeland-security/us-armed-forces-could-be-authorized-for-role-along-american-border/" target="_blank">USCBP</a>) is tasked with maintaining the security of America&#8217;s ports and overseeing the execution of customs regulations. In previous posts on this blog, it has been noted that there is a great deal of <a title="economic opportunities in the Asia-Pacific region" href="http://integrity-legal.com/legal-blog/ecommerce/the-rise-of-e-commerce-and-implications-for-modern-business-lawyers/" target="_blank">economic opportunity in the Asia-Pacific region</a>. Some Americans are unfamiliar with a body known colloquially as APEC (Asia Pacific Economic Cooperation). This body has become an increasingly important platform for discussion of various subjects pertaining to inter-jurisdictional matters arising in the Asia-Pacific region. To quote the <a title="APEC website" href="http://www.apec.org/apec/about_apec.html" target="_blank">APEC website</a> directly:</p>
<blockquote><p><em><strong><span class="bodytext">Asia-Pacific Economic Cooperation, or APEC, is  the premier forum for facilitating economic growth, cooperation, trade  and investment in the Asia-Pacific region .</span></strong></em></p>
<p><em><strong>APEC is the only  inter governmental grouping in the world operating on the basis of  non-binding commitments, open dialogue and equal respect for the views  of all participants. Unlike the WTO or other multilateral trade bodies,  APEC has no treaty obligations required of its participants. Decisions  made within APEC are reached by consensus and commitments are undertaken  on a voluntary basis. </strong></em></p></blockquote>
<p><em><strong></strong></em>This consensus driven initiative has proven effective in facilitating international trade, cooperation, and dialogue. In a recent press release it was announced that the USCBP will likely be taking on a more hand-on role within the APEC framework. To <a title="quote" href="http://www.aila.org/content/default.aspx?docid=33153" target="_blank">quote</a> the press release as distributed by the American Immigration Lawyers Association (AILA): <em><strong><br />
</strong></em></p>
<blockquote><p><strong><em>U.S. Customs and Border Protection announced today that it will host the Subcommittee on Customs Procedures as part of the 2011 Asia-Pacific Economic Cooperation (APEC) meetings that will be chaired by the United States. The Sub-committee on Customs Procedures coordinates CBP’s efforts in customs, immigration and counter-terrorism with partner agencies throughout APEC member countries. The yearlong chairmanship will be handed over to CBP from the Japan Customs and Tariff Bureau today.</em></strong></p>
<p><strong><em>“CBP is proud to be hosting the distinguished members of the Sub-committee on Customs procedures for the 2011 APEC meetings,” said Commissioner Alan Bersin. “It is of vital importance to the security of our global economy for the members to coordinate and share<br />
customs best practices.”</em></strong></p>
<p><strong><em>The subcommittee is a working level group within APEC. It brings Customs administrations of APEC Member Economies together to simplify and harmonize customs procedures and to ensure trade moves efficiently and safely across the Asia-Pacific region. APEC is the premier forum for facilitating economic growth, cooperation, trade and investment in the Asia-Pacific region. The APEC region is home to more than 2.7 billion<br />
people and represents approximately 60 percent of the world GDP and 44 percent of world trade.</em></strong></p>
<p><strong><em>Japan officially turns over the Chair of APEC to President Barack Obama at the November 13-14, 2010 Leader’s Meeting in Yokohama, Japan.</em></strong></p></blockquote>
<p>This is a very interesting development from an economic perspective as it would appear that the United States is taking a keener interest in Asia-Pacific affairs. This may be due to the recent downturn in the US economy as well as the rise of The Peoples&#8217; Republic of China as a major player in global economic relations. Whatever the reason for this increasing interest in the region, this author welcomes further streamlining of Customs procedures in an effort to stimulate new transnational trade and facilitate preexisting trading relationships in an effort to increase the volume trade between the United States and the members of APEC.</p>
<p>Hopefully, through voluntary cooperation trade can be increased and the security of the USA and the other APEC member nations will be increased. To further quote the aforementioned press release distributed by AILA:</p>
<blockquote><p><strong><em>U.S. Customs and Border Protection is the unified border agency within the Department of Homeland Security charged with the management, control and protection of our nation&#8217;s borders at and between the official ports of entry. CBP is charged with keeping terrorists and terrorist weapons out of the country while enforcing hundreds of U.S. laws.</em></strong></p></blockquote>
<p>Hopefully, this new multilateral initiative will be beneficial for all concerned as US officials and Customs authorities from other participating nations can pool some resources in an effort to combat international crime and facilitate the execution of relevant immigration laws.</p>
<p>Many Americans and foreign nationals are under the mistaken impression that Customs and Border Protection simply &#8220;rubber stamps&#8221; entrants to the United states who are either from countries participating in the Visa Waiver Program or have a <a title="US Tourist Visa" href="http://www.integrity-legal.com/us-visa/tourist-visa.html" target="_blank">US Tourist Visa</a>. Nothing could be further from the truth as even those entering the USA with a valid visa could be turned away or placed in <a title="Expedited removal" href="http://integrity-legal.com/legal-blog/lgbt-immigration/lgbt-issues-becoming-increasingly-prevalent-in-an-american-immigration-context/" target="_blank">Expedited removal</a> proceedings depending upon their travel history. 			<content:encoded><![CDATA[<p>This author has frequently discussed the myriad problems that Immigrants can face when dealing with an unlicensed American immigration &#8220;<a title="agent" href="http://integrity-legal.com/legal-blog/us-visa-immigration/attorney-general-cuomo-takes-further-steps-to-combat-the-unauthorized-practice-of-us-immigration-law/" target="_blank">agent</a>&#8221; or &#8220;<a title="specialist" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-looks-at-the-unlicensed-practice-of-law/" target="_blank">specialist</a>&#8220;. American law and Federal Regulations are clear regarding the issue of who is allowed to provide legal services in matters arising before the United States Citizenship and Immigration Service (<a title="USCIS" href="http://integrity-legal.com/legal-blog/uscis/new-procedures-for-those-wishing-to-adopt-orphans-from-nepal/" target="_blank">USCIS</a>) specifically; or any of the other agencies which are overseen by the <a title="Department of Homeland Security" href="http://integrity-legal.com/legal-blog/department-of-homeland-security/department-of-homeland-security-testing-iris-scanning-technology-for-uscbp-usage/" target="_blank">Department of Homeland Security</a> (DHS). Only licensed attorneys from the United States of America are able to provide consultations about US Immigration matters for a fee. Furthermore, only an attorney licensed by the Highest Court of least one US State, Commonwealth, or outlying territory is allowed charge fees to represent clients before DHS, including USCIS.</p>
<p>Unfortunately, there are some unauthorized organizations throughout the world claiming to be able to provide advice and assistance in American Immigration matters. The internet has proven to be a great tool for those wishing to research matters pertaining to United States Immigration. Meanwhile, it has also provided a platform for some operations which claim legal expertise without appropriate training or licensure. Such individuals and entities ought to be avoided at all costs since information transmitted to such individuals and entities may not be protected by the usual legal protections accorded to communications conveyed between an <a title="American attorney" href="http://www.integrity-legal.com/bangkok-lawyer.html" target="_blank">American attorney</a> and their client. Furthermore, one who is not legally trained or not licensed to provide legal services in a given jurisdiction or about a particular subject cannot provide effective counsel nor lawful confidentiality to those seeking their assistance. This can be especially important to those conveying sensitive information about a case pending before an immigration tribunal, agency, <a title="US Embassy" href="http://www.integrity-legal.com/us-visa/k1-visa-process.html" target="_blank">US Embassy</a>, or <a title="US Consulate" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-processing-times-california-service-center-nebraska-service-center-vermont-service-center-texas-service-center/" target="_blank">US Consulate</a> abroad. Those engaged in the unauthorized practice of law in the aforementioned manner are thereby placing their own interests, as well as those of their unsuspecting &#8220;clients&#8217;&#8221;, in jeopardy.</p>
<p>When comparing the costs of legal service it is important to understand the pivotal role of licensure when making a decision to retain counsel. No licensed legal professional is likely to have a problem with prospective clients shopping for a reasonably priced service with a professional that they feel comfortable dealing with. In general, licensed American attorneys find that competition with other professionals makes for a healthy and prosperous business environment, but to compare the services of a licensed American immigration attorney with one who is not licensed to practice law creates a false comparison as US law is clear that those without licensure cannot provide the services which they claim they can provide in an immigration context. In short: one cannot compare a legal service with an illegal service from a price standpoint as an illegal service provider simply cannot provide such services at any price.</p>

			<content:encoded><![CDATA[<p>The American Department of State (DOS) is responsible for a great number of government functions performed in the United States of America and abroad. On this blog, we routinely post information about issues connected to DOS in an effort to disseminate useful information to Americans abroad or foreign nationals seeking information about <a title="US Immigration" href="http://www.integrity-legal.com" target="_blank">US Immigration</a>. It recently came to this author&#8217;s attention that the American State Department has released a new edition of a publication designed to provide insight to American law enforcement officials regarding protocols which must be adhered to in situations involving foreign Consular officials. To <a title="quote" href="http://www.aila.org/content/default.aspx?docid=33101" target="_blank">quote</a> a press release from the Department of State and distributed by the American Immigration Lawyers Association (AILA):</p>
<blockquote><p><strong><em>The Department of State is pleased to announce its publication of the third edition of &#8220;The Consular Notification and Access Manual.&#8221; Produced by the Bureau of Consular Affairs and the Office of the Legal Adviser, the manual instructs federal, state and local law enforcement and other officials on actions they must take to comply with U.S. obligations under the Vienna Convention on Consular Relations and other international agreements. It includes details on steps U.S. authorities must take when a foreign national in the United States is arrested or detained, dies, is involved in the wreck of a foreign vessel, or requires the appointment of a guardian.</em></strong></p>
<p><strong><em>The manual, which is available free of charge, supports the Department’s efforts to ensure that the United States meets its international obligations to notify foreign consular officials about their citizens in the United States. <p>The Vienna Convention is an important pillar of American law enforcement policy regarding foreign Missions in the United States. The rules stipulated in the Vienna Convention generally apply to personnel of US Missions abroad. Therefore, reciprocal adherence to Vienna Convention protocols creates a more stable international community for all concerned.</p>
<p>These issues should not be confused with those related to Americans who have been arrested abroad. As a rule, the Vienna Convention does not apply to Americans abroad who have no government affiliation. Thus, an American arrested abroad is unlikely to be treated in the same manner as American government representatives accredited to a given country.</p>
