			<content:encoded><![CDATA[<p>Since the last posting on this blog there have been a number of developments and discussions with respect to both Thai and American immigration issues. One development which has received substantial media coverage has been the Executive Orders signed by President Biden with regard to Immigration policy. Of particular note to the administration of this web log was the order titled: <strong><a title="Executive Order on Restoring Faith in Our Legal Immigration Systems and Strengthening Integration and Inclusion Efforts for New Americans" href="https://www.whitehouse.gov/briefing-room/presidential-actions/2021/02/02/executive-order-restoring-faith-in-our-legal-immigration-systems-and-strengthening-integration-and-inclusion-efforts-for-new-americans/">Executive Order on Restoring Faith in Our Legal Immigration Systems and Strengthening Integration and Inclusion Efforts for New Americans</a></strong>. The content of this <a title="Executive Order" href="https://www.youtube.com/watch?v=lAcQOghHELQ">Executive Order</a> seems designed to impose a new policy paradigm upon the Immigration bureaucracy (or perhaps reimpose of a previously existing paradigm). This effort to change the prevailing paradigm is evidenced in the opening lines of the order itself:</p>
<blockquote><p><strong>Consistent with our character as a Nation of opportunity and of welcome, it is essential to ensure that our laws and policies encourage full participation by immigrants, including refugees, in our civic life; that immigration processes and other benefits are delivered effectively and efficiently; and that the Federal Government eliminates sources of fear and other barriers that prevent immigrants from accessing government services available to them&#8230;The Federal Government should develop welcoming strategies that promote integration, inclusion, and citizenship, and it should embrace the full participation of the newest Americans in our democracy.</strong></p></blockquote>
<p>Clearly, the administration seeks to re-establish a sense of decorum and compassion tot eh immigration system. The order goes on the delineate as to more concrete steps toward those ends:</p>
<blockquote><p><strong>Sec. 3.  Restoring Trust in our Legal Immigration System.  The Secretary of State, the Attorney General, and the Secretary of Homeland Security shall review existing regulations, orders, guidance documents, policies, and any other similar agency actions (collectively, agency actions) that may be inconsistent with the policy set forth in section 1 of this order.</strong></p>
<p><strong>(a)  In conducting this review, the Secretary of State, the Attorney General, and the Secretary of Homeland Security shall:</strong></p>
<p><strong>(i)   identify barriers that impede access to immigration benefits and fair, efficient adjudications of these benefits and make recommendations on how to remove these barriers, as appropriate and consistent with applicable law; and</strong></p>
<p><strong>(ii)  identify any agency actions that fail to promote access to the legal immigration system — such as the final rule entitled, “U.S. Citizenship and Immigration Services Fee Schedule and Changes to Certain Other Immigration Benefit Request Requirements,” 85 Fed. Reg. 46788 (Aug. 3, 2020), in light of the Emergency Stopgap USCIS Stabilization Act (title I of division D of Public Law 116-159) — and recommend steps, as appropriate and consistent with applicable law, to revise or rescind those agency actions.</strong></p>
<p><strong>(b)  Within 90 days of the date of this order, the Secretary of State, the Attorney General, and the Secretary of Homeland Security shall each submit a plan to the President describing the steps their respective agencies will take to advance the policy set forth in section 1 of this order.</strong></p>
<p><strong>(c)  Within 180 days of submitting the plan described in subsection (b) of this section, the Secretary of State, the Attorney General, and the Secretary of Homeland Security shall each submit a report to the President describing the progress of their respective agencies towards implementing the plan developed pursuant to subsection (b) of this section and recognizing any areas of concern or barriers to implementing the plan.</strong></p></blockquote>
<p>It remains to be seen precisely how this will impact the American immigration system, and it should be noted that the apparatus is unlikely to fundamentally change over night. That stated, there is good reason to hope there may be &#8220;light at the end of the tunnel&#8221; after months of seemingly unnecessary delay and obfuscation in the visa process. There does appear to one area of particular interest to the current administration with respect to US immigration. Namely, there have been a number of issues associated with the &#8220;<a title="Public Charge rule" href="https://legal.co.th/resources/visa-immigration-law/us-immigration-law/us-immigration-public-charge-rule-and-i-944-form-thai-language/">Public Charge rule</a>&#8221; and prior to the issue of COVID-19 coming to the forefront of immigration analysis, public charge was shaping up to be a significant obstacle for a number of family based immigration cases (including, but not limited to: the <a title="K-1 visa" href="https://legal.co.th/resources/visa-immigration-law/us-immigration-law/k-1-visa-thailand-new-public-charge-rule/">K-1 visa</a>, the <a title="K-3 visa" href="https://legal.co.th/resources/visa-immigration-law/visa-news/k-3-visa-thailand-injunction-against-new-public-charge-rules/">K-3 visa</a>, the <a title="CR-1 visa" href="https://legal.co.th/resources/visa-immigration-law/us-immigration-law/new-financial-support-rules-cr-1-and-ir-1-visas-thailand/">CR-1 visa</a>, and the <a title="IR-1 visa" href="https://legal.co.th/resources/visa-immigration-law/us-immigration-law/age-difference-issue-ir-1-visa-application/">IR-1 visa</a> categories). The recently promulgated order seems to take this issue seriously:</p>
<blockquote><p><strong>The Secretary of State, the Attorney General, the Secretary of Homeland Security, and the heads of other relevant agencies, as appropriate, shall review all agency actions related to implementation of the public charge ground of inadmissibility in section 212(a)(4) of the Immigration and Nationality Act (INA), 8 U.S.C. 1182(a)(4), and the related ground of deportability in section 237(a)(5) of the INA, 8 U.S.C. 1227(a)(5).  They shall, in considering the effects and implications of public charge policies, consult with the heads of relevant agencies, including the Secretary of Agriculture, the Secretary of Health and Human Services, and the Secretary of Housing and Urban Development.</strong></p>
<p><strong>(a)  This review should:</strong></p>
<p><strong>(i)    consider and evaluate the current effects of these agency actions and the implications of their continued implementation in light of the policy set forth in section 1 of this order;</strong></p>
<p><strong>(ii)   identify appropriate agency actions, if any, to address concerns about the current public charge policies’ effect on the integrity of the Nation’s immigration system and public health; and</strong></p>
<p><strong>(iii)  recommend steps that relevant agencies should take to clearly communicate current public charge policies and proposed changes, if any, to reduce fear and confusion among impacted communities.</strong></p>
<p><strong>(b)  Within 60 days of the date of this order, the Secretary of State, the Attorney General, and the Secretary of Homeland Security shall each submit a report to the President describing any agency actions identified pursuant to subsection (a)(ii) of this section and any steps their agencies intend to take or have taken, consistent with subsection (a)(iii) of this section.</strong></p></blockquote>
<p>It seems the administration is particularly keen to address the difficulties imposed by rules changes pertaining to public charge and hopefully some revision of the rules may be forthcoming sooner rather than later.</p>
<p>Meanwhile, although there has not been a great deal of substantive change to current immigration policy in Thailand, there has been a great deal of discussion regarding possible policy changes to in an effort to <a title="revitalize the Thai tourism sector" href="https://www.youtube.com/watch?v=BzjSUhKHFW8">revitalize the Thai tourism sector</a> which, depending upon the source, seems to have seen between 1-3 million <a title="layoffs" href="https://www.youtube.com/watch?v=byGq4emD0Tk">layoffs</a> since the response to the pandemic began. Once solution discussed has been the notion of a &#8220;<a title="vaccine passport" href="https://www.youtube.com/watch?v=VP68SJ10MVM">vaccine passport</a>&#8221; or &#8220;<a title="immunity passport" href="https://www.youtube.com/watch?v=UXUWkAAMc8A&amp;t=2s">immunity passport</a>&#8220;. Essentially, this notion centers upon the idea that those who can prove they have been inoculated against COVID-19, via one of the many vaccinations currently on the market, will be allowed to travel to Thailand without the need to <a title="quarantine" href="https://legal.co.th/resources/visa-immigration-law/visa-news/are-vaccine-passports-key-quarantine-free-thailand/">quarantine</a> in one of the alternative state quarantine (<a title="ASQ" href="https://legal.co.th/resources/visa-immigration-law/thailand-immigration-law/why-further-quarantine-thailand-past-final-covid-exam/">ASQ</a>) facilities. Notwithstanding the fact that there has ben a great deal of discussion on this matter, it currently appears, as with the so-called &#8220;<a title="travel bubble" href="http://integrity-legal.com/legal-blog/thailand-visa/updates-on-thai-and-american-immigration-news/">travel bubble</a>&#8221; scheme, that this program <a title="will not be implemented any time soon" href="https://www.youtube.com/watch?v=iefTj1W_yFc&amp;t=4s">will not be implemented any time soon</a>. As the tourism sector in Thailand languishes, long stay tourists may avail themselves to <a title="special tourist visas" href="https://legal.co.th/resources/visa-immigration-law/thailand-immigration-law/comparing-thai-retirement-and-special-tourist-visas/">special tourist visas</a> or standard TR visas to stay in Thailand. Furthermore, the <a title="Thai retirement visa" href="https://www.youtube.com/watch?v=PcEwB0E9XuE">Thai retirement visa</a> remains a viable option for those wishing to <a title="travel to Thailand for retirement" href="http://www.integrity-legal.com/thai-visa/retirement-visa.html">travel to Thailand for retirement</a> purposes.</p>

			<content:encoded><![CDATA[<p>An Executive Order has been issued by the Trump administration regarding suspension of immigration to the United States for the forthcoming 60 days. However, the order does not appear to apply to those seeking a <a title="K-1 visa" href="http://www.integrity-legal.com/us-visa/k1-fiance-visa.html">K-1 visa</a> to bring a foreign fiance to the USA. Concurrently, it also does not appear to apply to <a title="American visas for the spouses and children of U.S. Citizens" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/medical-examinations-cr-1-and-ir-1-marriage-visa-context/">American visas for the spouses and children of U.S. Citizens</a>. To quote directly from the relevant sections of the order as posted on the <a title="White House" href="https://www.whitehouse.gov/presidential-actions/proclamation-suspending-entry-immigrants-present-risk-u-s-labor-market-economic-recovery-following-covid-19-outbreak/">White House</a> website:</p>
<blockquote>
<p style="text-align: center;"><strong>NOW, THEREFORE, I, DONALD J. TRUMP, President of the United States, by the authority vested in me by the Constitution and the laws of the United States of America, including sections 212(f) and 215(a) of the Immigration and Nationality Act, 8 U.S.C. 1182(f) and 1185(a), and section 301 of title 3, United States Code, hereby find that the entry into the United States of persons described in section 1 of this proclamation would, except as provided for in section 2 of this proclamation, be detrimental to the interests of the United States, and that their entry should be subject to certain restrictions, limitations, and exceptions.  I therefore hereby proclaim the following:</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Section</span> <span style="text-decoration: underline;">1</span>.  <span style="text-decoration: underline;">Suspension and Limitation on Entry</span>.  The entry into the United States of aliens as immigrants is hereby suspended and limited subject to section 2 of this proclamation.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">2</span>.  <span style="text-decoration: underline;">Scope of Suspension and Limitation on Entry</span>.  (a)  The suspension and limitation on entry pursuant to section 1 of this proclamation shall apply only to aliens who:</strong></p>
<p style="text-align: center;"><strong>(i)    are outside the United States on the effective date of this proclamation;</strong></p>
<p style="text-align: center;"><strong>(ii)   do not have an immigrant visa that is valid on the effective date of this proclamation; and</strong></p>
<p style="text-align: center;"><strong>(iii)  do not have an official travel document other than a visa (such as a transportation letter, an appropriate boarding foil, or an advance parole document) that is valid on the effective date of this proclamation or issued on any date thereafter that permits him or her to travel to the United States and seek entry or admission.</strong></p>
<p style="text-align: center;"><strong>(b)  The suspension and limitation on entry pursuant to section 1 of this proclamation shall not apply to:</strong></p>
<p style="text-align: center;"><strong>(i)     any lawful permanent resident of the United States;</strong></p>
<p style="text-align: center;"><strong>(ii)    any alien seeking to enter the United States on an immigrant visa as a physician, nurse, or other healthcare professional; to perform medical research or other research intended to combat the spread of COVID-19; or to perform work essential to combating, recovering from, or otherwise alleviating the effects of the COVID-19 outbreak, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees;  and any spouse and unmarried children under 21 years old of any such alien who are accompanying or following to join the alien;</strong></p>
<p style="text-align: center;"><strong>(iii)   any alien applying for a visa to enter the United States pursuant to the EB-5 Immigrant Investor Program;</strong></p>
<p style="text-align: center;"><strong>(iv)    any alien who is the spouse of a United States citizen;</strong></p>
<p style="text-align: center;"><strong>(v)     any alien who is under 21 years old and is the child of a United States citizen, or who is a prospective adoptee seeking to enter the United States pursuant to the IR-4 or IH-4 visa classifications;</strong></p>
<p style="text-align: center;"><strong>(vi)    any alien whose entry would further important United States law enforcement objectives, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees, based on a recommendation of the Attorney General or his designee;</strong></p>
<p style="text-align: center;"><strong>(vii)   any member of the United States Armed Forces and any spouse and children of a member of the United States Armed Forces;</strong></p>
<p style="text-align: center;"><strong>(viii)  any alien seeking to enter the United States pursuant to a Special Immigrant Visa in the SI or SQ classification, subject to such conditions as the Secretary of State may impose, and any spouse and children of any such individual; or</strong></p>
<p style="text-align: center;"><strong>(ix)    any alien whose entry would be in the national interest, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">3</span>.  <span style="text-decoration: underline;">Implementation and Enforcement</span>.  (a)  The consular officer shall determine, in his or her discretion, whether an immigrant has established his or her eligibility for an exception in section 2(b) of this proclamation.  The Secretary of State shall implement this proclamation as it applies to visas pursuant to such procedures as the Secretary of State, in consultation with the Secretary of Homeland Security, may establish in the Secretary of State’s discretion.  The Secretary of Homeland Security shall implement this proclamation as it applies to the entry of aliens pursuant to such procedures as the Secretary of Homeland Security, in consultation with the Secretary of State, may establish in the Secretary of Homeland Security’s discretion.</strong></p>
<p style="text-align: center;"><strong>(b)  An alien who circumvents the application of this proclamation through fraud, willful misrepresentation of a material fact, or illegal entry shall be a priority for removal by the Department of Homeland Security.</strong></p>
<p style="text-align: center;"><strong>(c)  Nothing in this proclamation shall be construed to limit the ability of an individual to seek asylum, refugee status, withholding of removal, or protection under the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, consistent with the laws of the United States.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">4</span>.  <span style="text-decoration: underline;">Termination</span>.  This proclamation shall expire 60 days from its effective date and may be continued as necessary.  Whenever appropriate, but no later than 50 days from the effective date of this proclamation, the Secretary of Homeland Security shall, in consultation with the Secretary of State and the Secretary of Labor, recommend whether I should continue or modify this proclamation.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">5</span>.  <span style="text-decoration: underline;">Effective Date</span>.  This proclamation is effective at 11:59 p.m. eastern daylight time on April 23, 2020.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">6</span>.  <span style="text-decoration: underline;">Additional Measures</span>.  Within 30 days of the effective date of this proclamation, the Secretary of Labor and the Secretary of Homeland Security, in consultation with the Secretary of State, shall review nonimmigrant programs and shall recommend to me other measures appropriate to stimulate the United States economy and ensure the prioritization, hiring, and employment of United States workers.</strong></p>
<p style="text-align: center;"><strong><span style="text-decoration: underline;">Sec</span>. <span style="text-decoration: underline;">7</span>.  <span style="text-decoration: underline;">Severability</span>.  It is the policy of the United States to enforce this proclamation to the maximum extent possible to advance the interests of the United States.  Accordingly:</strong></p>
<p style="text-align: center;"><strong>(a)  if any provision of this proclamation, or the application of any provision to any person or circumstance, is held to be invalid, the remainder of this proclamation and the application of its provisions to any other persons or circumstances shall not be affected thereby; and</strong></p>
<p style="text-align: center;"><strong>(b)  if any provision of this proclamation, or the application of any provision to any person or circumstance, is held to be invalid because of the lack of certain procedural requirements, the relevant executive branch officials shall implement those procedural requirements to conform with existing law and with any applicable court orders.</strong></p>

<p style="text-align: left;">Clearly, there are many who might see their cases negatively impacted by this order. To preface any further analysis, it should be noted that visa processing has been suspended at the US Embassy in Bangkok, Thailand as well as the US Embassy in Vientiane, Laos and the US Embassy in Phnom Phen, Cambodia due to the COVID-19 outbreak. So regardless of this order, it is not currently possible to obtain a visa from these posts as interviews have been suspended. Bearing the above in mind, the following analysis will demonstrate that this order will NOT have an impact on <a title="fiance visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/will-my-criminal-history-impact-my-k-1-visa-application/">fiance visa</a> and <a title="marriage visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/why-k-3-visas-may-not-be-optimal-adjustment-status/">marriage visa</a> cases for the fiances and/or spouses of American citizens:</p>
<p style="text-align: left;">The executive order states: &#8220;The entry into the United States of aliens as immigrants is hereby suspended and limited subject to section 2 of this proclamation.&#8221; The K-1 visa is designed for the fiance of an American citizen to to travel to the United States with the <a title="intention of marriage" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/k-1-fiancee-visa-waivers-multiple-filings/">intention of marriage</a>. It grants the bearer <a title="90 days of lawful status" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/comparing-and-contrasting-k-1-visa-and-k-3-visa/">90 days of lawful status</a> in the USA in which to marry their American fiance and file for <a title="adjustment of status" href="http://www.integrity-legal.com/us-visa/adjustment-status.html">adjustment of status</a> to lawful permanent residence (aka <a title="Green Card" href="http://www.integrity-legal.com/us-visa/immigrant-spouse-visa.html">Green Card</a> status). It is important to note: the K-1 visa is a non-immigrant visa, albeit a <a title="dual intent visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/american-dual-intent-visas/">dual intent visa</a>. For purposes of processing it is treated as an immigrant visa (for example K-1 cases process through the <a title="Immigrant Visa Unit of the American Embassy in Thailand" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/coronavirus-covid-19-suspension-us-visa-issuance/">Immigrant Visa Unit of the American Embassy in Thailand</a>), but pursuant to United States law it is in fact a non-immigrant visa. The above cited executive order only pertains to immigrant visas. Therefore, this order does not have any bearing upon the processing of a <a title="K-1 fiance visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/k1-visa-thailand-proving-bona-fide-relationship/">K-1 fiance visa</a> case.</p>
<p style="text-align: left;">What about cases involving the spouse of an American citizen where the spouse would enter the USA and be granted an <a title="I-551 stamp" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/us-visas-and-immigration-what-i-551-stamp/">I-551 stamp</a> thereby granting permanent residence to the foreign spouse upon entry? The above executive order speaks directly to such a situation: &#8220;The suspension and limitation on entry pursuant to section 1 of this proclamation shall <span style="text-decoration: underline;"><em><strong>not</strong></em></span> apply to:&#8230;(iv) <strong><em><span style="text-decoration: underline;">any alien who is the spouse of a United States citizen</span></em></strong>&#8220;[Emphasis Added]. Clearly the suspension ordered in Trump&#8217;s executive order will exempt spouses of Americans. Therefore, those foreign spouses of American citizens seeking a <a title="K-3 visa" href="https://www.youtube.com/watch?v=IZq38Vc7kTE">K-3 visa</a>, <a title="CR-1 visa" href="http://www.integrity-legal.com/us-visa/immigrant-visa-process.html">CR-1 visa</a>, or <a title="IR-1 visa" href="https://www.legal.co.th/resources/visa-immigration-law/us-immigration-law/should-i-go-cr-1-or-ir-1-visa-interview-my-spouse/">IR-1 visa</a> will not be adversely impacted by the provisions of this executive order.</p>
<p style="text-align: left;">Finally, the following should be noted: &#8220;This proclamation shall expire 60 days from its effective date&#8230;This proclamation is effective at 11:59 p.m. eastern daylight time on April 23, 2020.&#8221; Thus, unless this order is extended it will expire 60 days from now. We will keep readers updated on this blog as the situation progresses.</p>

			<content:encoded><![CDATA[<p>For those who have been following the news in recent days it is not new information that <a title="President Donald Trump has signed new executive orders" href="https://www.youtube.com/watch?v=pGFL7D-ocJc">President Donald Trump has signed new executive orders</a> with respect to US immigration and travelers from various countries. Effectively, these orders ban certain foreign nationals from obtaining a visa to the USA or entering the USA for at least 90-120 days. Although at present it appears that these orders will only directly impact nationals of Iraq, Syria, Iran, Libya, Somalia, Sudan, and Yemen there are certain aspects of the order which may impact the US immigration process in a broad sense. For example so-called &#8220;extreme vetting&#8221; protocols which these orders call for may conceivably be implemented by State Department personnel worldwide in connection with the <a title="US visa process" href="http://www.legal.co.th/resources/visa-immigration-law/trumps-recent-executive-orders-impact-legal-terms/">US visa process</a>. Furthermore, it now appears that those who <a title="already hold green cards" href="http://www.bangkokpost.com/news/world/1189020/us-green-card-holders-will-need-additional-screening-white-house">already hold green cards</a>, but are outside of the USA may be turned away by United States Customs and Border Protection (USCBP) or be required to undergo further screening which was not required for <a title="reentry to the USA" href="https://www.youtube.com/watch?v=P9AmRm4H8a4">reentry to the USA</a> in the past.</p>
<p>Many following this story may be asking themselves: by what authority is the President able to impose these recent restrictions? Pursuant to <a title="8 U.S. Code § 1182" href="https://www.law.cornell.edu/uscode/text/8/1182">8 U.S. Code § 1182</a>:</p>
<blockquote><p><strong>Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.</strong></p></blockquote>
<p>It should further be noted that the same statute goes on to mention that the Attorney General has specific powers with regard to the aforementioned issue:</p>
<blockquote><p><strong>Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.</strong></p></blockquote>
<p>Clearly, the President has statutory authority to impose restrictions like those recently created by Trump. The section regarding the power of the Attorney General in this regard is mentioned because in many cases individuals affected by these new rules will be denied the ability to board an airline bound for the USA as airlines and airline personnel do not wish to be the subject of fines and sanctions associated with transporting someone to the USA who has a strong chance of being refused entry.</p>
<p>As of the time of this writing, it remains to be fully seen exactly how these recent executive orders will play out. This is especially true in light of the fact that certain legal actions have resulted in <a title="court orders" href="http://www.cbsnews.com/news/judge-bars-us-from-deporting-travelers-with-valid-visas-covered-by-trump-order/">court orders</a> against implementation of these initiatives. Notwithstanding these developments it is very likely that many of the recently enacted restrictions will remain, at least for practical purposes, in place in the foreseeable future.</p>

			<content:encoded><![CDATA[<p>In light of recent events in the United States election and the campaign promises made by the now President-elect, it seems appropriate to assume that Immigration matters will likely come to the forefront of American political discussion. For this reason, this blogger finds it relevant to provide an overview of the Immigration apparatus and how the components function.</p>
<p>In order to understand U.S. Immigration matters and the enforcement of U.S. Immigration law one must first understand the Department of Homeland Security. This Department oversees most of the Immigration matters arising in the United States (The Department of State deals with matters pertaining to US visas issued abroad, for more information on the role DOS plays in the immigration process please check out the many pages on this blog dedicated to <a title="Consular Processing" href="http://integrity-legal.com/legal-blog/us-visa-immigration/uscis-issues-further-clarification-regarding-faqs-on-same-sex-immigration-petitions/">Consular Processing</a> information).</p>
<p>There are three agencies under the jurisdiction of DHS which deal with different aspects of Immigration law and policy. The first agency that many intending immigrant will no doubt have had dealings with is the United States Citizenship and Immigration Service or USCIS. This agency is tasked with adjudicating petitions for immigration benefits such as immigrant visas, work visas, and certain temporary stay visas. Furthermore, the USCIS also adjudicates I-601 waivers of inadmissibility as well as I-212 waivers for those who have previously been subjected to expedited removal. Those wishing to travel from abroad to the United States on some sort of immigrant or work authorized visa will likely have contact with USCIS.</p>
<p>Another component of DHS which deals with Immigration is the United States Immigration and Customs Enforcement Service or USICE. USICE is often the agency tasked with ascertaining the legal status of foreign nationals physically present in the USA and if found to be present in the USA illegally USICE agents are tasked with apprehending such individuals and placing them in deportation proceedings.</p>
<p>Finally, there is the United States Customs and Border Protection Service or USCBP. In the US visa process, USCBP is arguably the most overlooked yet one of the most significant agencies an intending immigrant will deal with. Unbeknownst to most, notwithstanding the issuance of a valid visa, USCBP has the authority to turn away any alien attempting to enter the USA. In actual practice, an alien with a validly issued visa is unlikely to be refused admission at a port of entry, but it can happen. In most cases such refusal is due to a belief on the part of a USCBP officer that an alien attempting to enter the USA on a non-immigrant visa in fact has <a title="immigrant intent" href="http://integrity-legal.com/legal-blog/us-visa-immigration/american-visas-immigration-and-the-dual-intent-doctrine/">immigrant intent</a>. This happens frequently to tourist visa holders who are attempting to conduct a so-called visa run in order to remain in the USA. In those cases involving immigrant spouses of US citizens holding visas such as the K-3, the CR-1, or the IR-1 refusal to admit the alien spouse is quite rare. The same can be said for foreign fiancees of US Citizens holding a <a title="K-1 visa" href="http://www.integrity-legal.com/us-visa/k1-fiance-visa.html">K-1 visa</a>, but the fact that USCBP has plenary power to turn away any alien seeking admission should not be forgotten.</p>
<p>Meanwhile in an interesting article in <a title="The Intercept" href="https://theintercept.com/2016/10/05/fbi-secret-methods-for-recruiting-informants-at-the-border/">The Intercept</a>, it was noted that certain documents have come to light which apparently show that although USCBP has traditionally recognized law enforcement functions (especially with respect to Customs matters) they also work with the FBI in matters not routinely thought of when pondering USCBP&#8217;s role. To quote directly from the aforementioned article:</p>
<blockquote><p><strong>&#8220;It is no surprise that law enforcement closely monitors border crossings for criminals or terror suspects. The initiatives described in these documents, however, are explicitly about gathering intelligence, not enforcing the law. A person doesn’t have to be connected to an active investigation or criminal suspect in order to be flagged; the FBI might want them for their potential to provide general intelligence on a given country, region, or group. The goal, according to an FBI presentation on an initiative at Boston’s Logan Airport, is “looking for ‘good guys’ not ‘bad guys.’”</strong></p></blockquote>
<p>Although immigration matters are often viewed as a &#8220;boring&#8221; aspect of the United States bureaucracy it should be noted that agents of the Department of Homeland Security play a significant role in maintaining the security of the USA and assist even in the gathering of intelligence.</p>

			<content:encoded><![CDATA[<p>The United States government has recently shut down due to the inability of Congress to make a deal regarding the budget and current debt ceiling level. The reverberations from this recent turn of events will likely be felt in many sectors of the United States government and by those who may have business with the US government. As a general matter, governmental functions which are deemed essential will still be available. However, those governmental activities and employees deemed non-essential will likely be discontinued and work furloughed until such time as Congress reaches an agreement. It has been 17 years since the United States government last shut down. <p>What is the practical impact of the government&#8217;s closure upon the immigration process? It recently came to this blogger&#8217;s attention that the following has been posted on the <a title="official website" href="http://bangkok.usembassy.gov/">official website</a> of the United States Embassy in Bangkok, Thailand:</p>
<blockquote><p><strong>The  U.S. Embassy in Bangkok and Consulate General Chiang Mai remain open to  the public.  As always, our priorities remain providing safety,  security, and service to U.S. citizens. We are open for all consular services, including visa processing.</strong></p></blockquote>
<p>It could be inferred that the Embassy is attempting to dispel rumors that a shutdown will negatively impact the processing of US visa applications as well as applications for US passports, Consular Reports of Birth Abroad (CRBA), and various notarial services requested by Americans living in Thailand. Hopefully, the recently announced government shutdown will not last long and thus not cause any great problems for those seeking visas to the United States of America. However, a protracted shutdown could mean that processing of US visa applications could move at a slower pace, or, in a worst case scenario, be discontinued until such time as a budget is agreed upon. Hopefully, this will not happen and the processing of applications will continue apace.</p>
<p>Meanwhile, it is likely that the shutdown will not affect processing of immigration petitions at the United States Citizenship and Immigration Service (USCIS). As USCIS is funded by the fees paid by petitioners, it seems likely that a government shutdown will not adversely impact those seeking immigration benefits from USCIS. Again, as the United States has not seen a government shutdown in nearly two decades some of the details about the impact of the current shutdown remain somewhat speculative. Readers of this blog should take note that further information will be provided herein as it becomes available.</p>

<p>The issues surrounding the status of same sex couples has been an issue of debate in the United States of America especially as the Presidential elections continue to draw closer. However, politics does not appear to be the core concern of those who are the most effected by these issues. For example, those families wishing to maintain a same sex bi-national relationship with a non-American in the United States could be deeply impacted by both American and Canadian policy regarding <a title="same sex marriage" href="http://integrity-legal.com/legal-blog/lgbt-immigration/same-sex-visa-lgbt-immigration/us-president-stands-up-for-gay-u-s-service-member-as-washington-lobbyists-hope-bi-partisan-strategy-will-lead-to-doma-repeal/">same sex marriage</a>. Hopefully measures will be taken to provide some sort of protection for travelers with disabilities so as to address safety concerns while simultaneously preventing humiliation while traveling.</p>

There are some who would argue that this activity violates the <a title="Full Faith and Credit Clause" href="http://integrity-legal.com/legal-blog/legal-opinion/america-5-0-states%E2%80%99-rights-in-a-global-world/">Full Faith and Credit Clause</a> of the United States Constitution while others could argue that such discrimination violates the <a title="Equal Protection" href="http://integrity-legal.com/legal-blog/lgbt-immigration/same-sex-visa-lgbt-immigration/american-president-notes-support-for-repeal-of-doma-in-lead-up-to-senate-judiciary-committee-hearing/">Equal Protection</a> Clause. In any case, the result in an immigration context is that same sex bi-national couples (even those who have entered into a same sex marriage in a US State) cannot receive the same visa benefits (such as the <a title="CR-1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-hong-kong.html">CR-1 visa</a>, <a title="IR-1 visa" href="http://www.integrity-legal.com/us-visa/k1-visa-singapore.html">IR-1 visa</a>, or <a title="K-1 visa" href="http://www.integrity-legal.com/us-visa/us-visa-south-korea.html">K-1 visa</a>)  as their different-sex counterparts. Some federal legislators, such as New York delegation member <a title="Representative Jerrold Nadler" href="http://nadler.house.gov/">Representative Jerrold Nadler</a>, have attempted to remedy this problem through introduction of bills such as the <a title="Uniting American Families Act" href="http://integrity-legal.com/legal-blog/k1-visa/dhs-takes-measures-to-encourage-business-related-immigration-as-response-is-filed-in-case-challenging-legality-of-doma/">Uniting American Families Act</a> (UAFA: to address the specific issue of discrimination in an immigration context) and the <a title="Respect For Marriage Act" href="http://integrity-legal.com/legal-blog/lgbt-immigration/same-sex-visa-lgbt-immigration/new-york-attorney-general-alleges-that-doma-violates-5th-10th-amendments-while-optimism-surrounds-south-china-sea-guidelines/">Respect For Marriage Act</a> (RFMA: a proposal which would accord federal &#8220;<a title="certainty" href="http://integrity-legal.com/legal-blog/lgbt-immigration/same-sex-visa-lgbt-immigration/us-consulate-chennai-issues-apology-statement-as-cnn-com-discusses-approaching-separation-of-same-sex-bi-national-couple/">certainty</a>&#8221; to State licensed same sex marriages). However, it remains to be seen whether such legislation will ultimately see passage.</p>

Perhaps in the meantime officers in the American immigration system can utilize their statutory authority and plenary powers to provide equitable relief to those who find themselves facing the prospect of being separated from their loved ones due to questionably Constitutional law.</p>

Fernando Jacobs, 72, of  Upland, Calif., and his son, Patrick  Jacobs, 44, of Ontario, Calif., were  sentenced by U.S. District Judge  George H. King. Judge King also ordered  Fernando Jacobs to pay a  $30,000 fine. Fernando Jacobs was remanded into custody  to begin  serving his prison sentence immediately. Patrick Jacobs has been in   custody since his arrest in December 2009. Fernando Jacobs, who was a  supervisory immigration services  officer with USCIS, and Patrick Jacobs were  convicted by a jury of  conspiracy, bribery and honest services wire fraud. Additionally,   Fernando Jacobs was also convicted of visa fraud. The evidence presented during  the two-week trial in U.S.  District Court in April showed the elder Jacobs  accepted bribes in  exchange for helping aliens seeking status in the United  States and  that his son acted as a middleman brokering deals with those   individuals. &#8220;The significance of public  corruption cases like this  cannot be overestimated,&#8221; said U.S. Attorney André  Birotte, Jr. &#8220;The  American public demands honest government service and the  Department of  Justice is committed to policing government and preserving the  public  trust.&#8221; The evidence showed the elder  Jacobs and his son engaged in a  scheme to defraud USCIS of Fernando Jacobs&#8217;  honest services, using his  authority and official position to enrich themselves  by receiving  payments in return for various actions&#8230;</em></strong></p></blockquote>
